You ask me[1] about consoling a mourner by means of a letter[2]. This Mitzvah*, as its name implies, must enable the mourner to be consoled. Moreover, the Rambam* writes in his laws of mourning, at the beginning of chapter 14, that this constitutes an act of chesed* — which is also conceivable in writing. Indeed, chesed can be performed through an intermediary, according to the verse Shmuel* 2, 10:3, which establishes that one need not necessarily perform it personally. True, the Rambam, at that same reference, specifies: "This is the chesed that one puts into practice physically" — but his sole purpose is to distinguish it from Tzedakah*, which he mentions in paragraph 3. One may draw additional proof from the act of carrying on one's shoulder, which can be reinforced in accordance with the ruling that chesed is conceivable toward the living and toward the dead. Now, it is clear that for the latter there is no difference between spoken words and a letter. One may therefore conceive of the consolation of mourners as an act of chesed solely toward the dead. This is precisely the subject of the debate between the Rabad* and the Rambam in the laws of mourning, chapter 13, paragraph 4 — but this point will not be developed here.

True, it is for the mourner to speak first[3]. Nevertheless…

בנוגע לנח"א ע"י מכתב:

לכאורה מובן מצות נחום אבלים הוא כשמה - שהאבל ינוחם עי"ז, ובפרט ע"פ מש"כ (רמב"ם הל' אבל רפי"ד) שזהו גמ"ח, וגמ"ח ישנה אפילו כשבא בכתב. גם מהא דאפשר ע"י שליח (ש"ב י, ג) מוכח דלא הוי ענין (מצוה) דבגופי' דוקא. - ומש"כ ברמב"ם (שם) ואלו הן גמ"ח שבגופו - לא אתי אלא להבדילה מצדקה (שנזכרה שם ה"ג). ולתת על הכתף (דמוסרים לכתפיים) יוכיח. ויש לחזק זה ע"פ ההמשך שם (פי"ד ה"ו) שזהו גמ"ח עם החיים ועם המתים, והרי למתים אין נפק"מ בין דבור למכ', ועיין שבת (קנב, סע"א) מת שאין לו כו' - שאפ"ל נחום אבלים שהוא גמ"ח רק למתים (וי"ל דבזה פליגי הראב"ד והרמב"ם - הל' אבל פי"ג ה"ד. ואכ"מ).

ואף שצ"ל פתיחה תחלה ע"י האבל - מילתא דמסתברא לומר שאין צ"ל פתיחה לכאו"א ביחוד וכיון שפתח לא' - גם שאר הנוכחים מנחמים, וכפשטי' דקרא בצורך הפתיחה: ואין דובר גו' כי גדל הכאב מאד אח"כ (כאשר) פתח איוב גו' (והדר) ויען אליפז (איוב ספ"ב מו"ק בסופה). ועוד ועיקר - באם המכתב נפתח ע"י האבל (אף שיודע שתוכנו - ניחום) והאבל פותח לקרוא בו - אין לך פתיחה גדולה מזו.

עפ"י כהנ"ל - זה שמסיבות שאינן תלויות בו, הרי למרות רצונו וחפצו, אא"פ לו לבוא בעצמו לנח"א, שתי דרכים לפניו: ע"י שליח (דהנ"ל בכתוב), ע"י מכתב (וכמדומה שנמצא בכו"כ שו"ת שמסיימים או מתחילים בנוסח דנח"א), ויש בזה מה שאין בזה - והטוב שניהם יחדיו.
