devotes himself to communal needs,

Greetings and blessing,

In reply to your letter, asking me about the second volume of the Zohar*.

A) On p. 156a: "During the week, at the time of Mincha*, the attribute of severity is suspended in the world, and this moment is not auspicious." Yet Chazal* seem to say the opposite, in Berachos 6b: "One must always recite the prayer of Mincha scrupulously, for it was only during it that Eliyahu was answered."

Here is my answer:

Chassidus* takes up this question and even formulates another one, based on the statement of Chazal in Avodah Zarah 3b that "during the three hours that form the last quarter of the day, HaKadosh Baruch Hu* sits and takes pleasure."

The explanation can be formulated as follows. Generally speaking, the time of Mincha is one of severity. If a person prays then, he wins the victory before the heavenly court precisely when the attribute of judgment is aroused. He can thus accomplish great things, since all opposition disappears. Indeed, the heavenly court itself even answers Amen.

It is not so at Shacharis*, when the attribute of kindness reveals itself. Tefillah* is effective then, certainly, but it cannot yet transform the world. Subsequently, when the attribute of judgment is strong, with the first shadows of evening, a new prosecution can be raised.

Eliyahu had to combat those who challenged the principle of emunah* by combining two religious acts[2]. He had to bring about a transformation, and he could do so precisely at Mincha—the prayer that exerts its effect when the court is in session. It is then that "HaKadosh Baruch Hu sits and takes pleasure."

The Kedushas Levi*, at the end of Parshas Chayei Sarah, notes that when Yitzchak said the prayer of Mincha, "camels arrived." For Hashem then does good (gomel) to Yisrael*[3]. You yourself note in your letter that the matter concerns camels, and Chazal teach in Berachos 56b that "one who sees a camel in a dream should know that death has been decreed against him by the heavenly court, and that he was spared from it." Here too there is a transformation, from one extreme to the other.

What has just been said has a bearing on avodas Hashem* and allows us to establish the importance of the prayer of Mincha. A person finds himself then caught up in worldly preoccupations, which entail severity, the transformation of matter. His nefesh ha'elokis* is therefore in constraint. Yet he interrupts himself, davens*, and unites with his Creator. This is therefore indeed a transformation, from one extreme to the other.

A man proves in such a case that worldly preoccupations have not made him lose his mind, that his nefesh ha'elokis is indeed victorious. It is not so for the prayer of Shacharis, which one says before going to one's activity. The fall is then still possible. When one steps out into the street, one may lose the elevation that was acquired.

You will consult the maamarim* entitled "The lights of Chanukah are lit from sunset," of 5688[4], and "A person must say the prayer of Mincha scrupulously," found in kuntres no. 15.

B) You also say that the night is a time of severity.

Here is my answer:

It is true that the time of Mincha is one of severity in relation to the morning. But the severity of the night exceeds that of Mincha. This can be deduced from Yerushalmi Shekalim, ch. 5, par. 4, and you will also consult the Zohar, vol. 3, p. 222b, the Pri Etz Chaim, on the prayer of Maariv, 4a, and the Siddur of the Arizal*, at the same reference.

But the Zohar, in regard to our subject, specifies when the heavenly court is in session. "The lower world is in the image of the upper world," and consequently the human court does not sit at night, as stated in the fourth chapter of Sanhedrin and in Tur Shulchan Aruch* Choshen Mishpat, par. 5. By contrast, the carrying out of the sentence may take place at night, which is even an auspicious time for it.

C) The Zohar, vol. 2, p. 156a, says that Moshe Rabbeinu* left this world during Shabbos, at the time of Mincha, and you therefore raise a question concerning the statement of Chazal that he wrote, on the day of his passing, thirteen Sifrei Torah*[5].

Here is my answer:

This question has been raised in different texts. You will consult Tosafos on Menachos 30a, the Rosh on the chapter Arvei Pesachim, the Mordechai at the same reference, the Or Zarua in Hilchos Motzei Shabbos, the Sefer Chassidim ch. 356, the Kolbo halacha 40, the Tur Shulchan Aruch Orach Chaim ch. 292, the Bayis Chadash, the Turei Zahav, and the Shulchan Aruch of the Alter Rebbe* at this same reference, the Asara Maamaros of Rabbi Menachem Azarya of Fano, part on the inquiry, vol. 2, ch. 13, the responsa Chasam Sofer*, vol. 6, ch. 29, the Seder HaDoros 2488, the Taamei HaMinhagim, citing the Ateres Tzvi.

All these references lead to three conclusions:

1. There are contradictory midrashim on the matter, and one finds a discussion regarding this between the Tannaim in Bava Basra 15a, which you will consult.

2. The passing of Moshe began on Erev Shabbos and continued until the holy day, at the time of Mincha. One can ask, in this connection, how Moshe wrote[6] "and he was buried" before this actually took place. Likewise, he also wrote[6] "and he died," but it has already been explained on this point that he had then lost his appearance. According to the Zohar, vol. 2, p. 89a, he gave his consent for his burial and then spoke through his soul. You will also consult the Zohar, vol. 1, p. 27b, and vol. 3, p. 280a.

3. The Sefer Torah was written in an unusual manner, with tears, according to the Asara Maamaros, or by animating the quill, according to the Chasam Sofer, citing the Shnei Luchos HaBris (Shelah*). But it is difficult to accept that such a manner of writing would be kosher. For Hashem said to him: "take this Sefer Torah," and one might therefore think that it would systematically be so.

D) It is also said that the doors of the beis midrash* were closed because of Moshe's passing. You therefore ask how an open practice of mourning can be adopted on Shabbos, and why the same is done at the present time.

Here is my answer:

Chazal established that one suspends the beis midrash of a Sage who passes from this world. The two statements[7] simultaneously emanate from them. Following your line of reasoning, you should have asked about the recitation of Tzidkascha[8], which according to the Zohar and Chazal is a formula of acceptance of the decree[9], which therefore cannot be recited from Erev Shabbos in the afternoon. Here too is a specific ruling[10].

במענה על מכתבו השואל בזהר ח"ב,

א) דף קנ"ו, א: בחול בשעתא דמנחה תליא דינא בעלמא ולאו איהו עת רצון, עכ"ל.

ולכאורה הוא היפך מרז"ל (ברכות ו, ב) לעולם יהא אדם זהיר בתפלת המנחה שהרי אליהו לא נענה אלא בתפלת המנחה.

מענה :

מובאת קושיא זו בדא"ח, בצירוף עוד קושיא ממרז"ל (ע"ז ג, ב) ג' שעות רביעיות הקב"ה יושב ומשחק. וקוטב התירוץ הוא: עת מנחה הוא עת דין, ואם האדם מתפלל אז , היינו שהוא נצמח בבית דין של מעלה בעת שהגבורה שולטת, ולכן יכול לפעול גדולות, כי אין עוד מנגד, ואדרבה גם המנגד עונה אמן. משא"כ בתפלתו בשחרית, כשמדת החסד שולטת, יפעול אז בתפלתו, אבל אין זה עדיין אתהפכא, ולכן כשתבוא מדת הדין בתוקפה, כשינטו צללי ערב, אפשר שתוכל למצוא קטרוג חדש. ולכן באליהו כשהיו פוסחים על שתי הסעיפים בעיקר הדת, והוצרך לאתהפכא - נענה בתפלת המנחה. - ותפלת המנחה מהפכת עת ישיבת בית דין , כי דוקא אז י[ו]שב הקב"ה ומשחק. וזהו ג"כ מש"כ בקדושת לוי ס"פ חיי שרה שבתפלת מנחה דיצחק, והנה גמלים באים, הקב"ה גומל חסד עם ישראל, וכמו שהעתיק במכתבו, גמלים דוקא, ע"פ מרז"ל (ברכות נו, ב) הרואה גמל בחלום מיתה נקנסה לו מן השמים והצילוהו, אתהפכא מן הקצה אל הקצה.

ויובן ג"כ בעבודה, שנתבארה מעלת תפלת מנחה, שאז הוא באמצע עסקיו בעניני העולם (דינים, בירורים, נפה"א נמצאת במיצר), ודוקא אז מפסיק ומתפלל ומתייחד עם קונו, אתהפכא מן הקצה אל הקצה. ומזה יש ראי' שמילי דעלמא לא יעבירוהו על דעת קונו, ונפה"א נצח , משא"כ תפלת שחרית שמתפלל קודם הליכה לעסקיו, אפשר שבצאתו לרחוב וכו' יכשל, ח"ו, בדרכו ויפול ממדריגתו.

ויעויין ד"ה נ"ח מצותה [מ]שתשקע תפר"ח, ד"ה לעולם יה"א זהיר (קונטרס ט"ו) ועוד.

ב) מוקשה לו דהלא לילה היא זמן דינים.

מענה :

אמת כן הוא שמנחה היא זמן דין לגבי הבוקר, ולילה זמן דין גם לגבי מנחה (והוא מוכח ג"כ בירושלמי שקלים פ"ה ה"ד, ועייג"כ זח"ג רכ"ב א, פע"ח תפלת ערבית ד' א. - בסי' האריז"ל שם, ועוד). אבל בנדון דידן בזהר, נוגע זמן ישיבת בית דין שלמעלה, ועלמא עילאה ותתאה דא כגוונא דא הם, ואין דנין בלילה (סנהדרין פרק ד', טושו"ע חו"מ ס"ה, וש"נ). אבל מילוי הפס"ד וכיו"ב - יכול להיות גם בלילה, ואדרבה.

ג) בזהר (ח"ב קנו, א), דמשה אסתלק במנחה דשבת, וקשה ממרז"ל דביום הסתלקותו כתב י"ג ספרי תורה.

מענה :

כבר דשו בה רבים - עיין תוד"ה מכאן (מנחות ל, א) רא"ש פ' ערבי פסחים, מרדכי שם, אור זרוע הל' מוצ"ש, ס' חסידים סי' שנ"ו, כל בו דין מ', טושו"ע חאו"ח סי' רצ"ב, ב"ח ט"ז ושו"ע רבינו הזקן שם, עשרה מאמרות (להרמ"ע מפאנו) חלק חקו"ד ח"ב פי"ג, שו"ת חת"ס ח"ו סכ"ט, סדר הדורות ב"א תפ"ח, טעמי המנהגים עפ"ח (בשם ס' עטרת צבי) ועוד.

והמורם מכל הנ"ל י"ל בשלשה: א) דמדרשות חלוקות הם, והיא היא פלוגתת התנאים בב"ב (טו, א) עיי"ש. ב) דהתחלת ההסתלקות הי' בערב שבת וסופה במנחת שבת (וצע"ג איך כתב ויקבור אותו קודם המאורע - מש"כ וימת וגו' כבר תירצו שהוא מפני דנסתלק הצלם שלו - ואולי אפ"ל עפמש"כ בזח"ב פ"ט רע"א דקבורתו היתה ברצון דע"ק ומדבר בנשמתו, ועייג"כ זח"א כז, סע"ב, זח"ג רפ, א). ג) דכתיבת הס"ת הי' ע"י שינוי: בדמעות (עש"מ שם) או ע"י השבעת הקולמוס (חת"ס שם בשם השל"ה). ולכאורה חידוש גדול הוא לומר דכתיבה כזו כשרה היא, ואת"ל דכך הי' הציווי: לקוח את סה"ת וגו' - א"כ נילף מינה גם לכל מקום.

ד) שם, דמפני הסתלקות משה ננעלין תרעי דביהמ"ד וקשה לו אין נוהגין אבלות דפרהסיא בשבת, ולמה נוהגין כן גם עתה.

מענה :

אם רז"ל הנהיגו כן דחכם שמת ביהמ"ד שלו בטל, הרי הם אמרו והם אמרו.

ולטעמי', יותר הו"ל להקשות על אמירת צדקתך שהוא כמו צדוק הדין להזהר ומרז"ל שם - והרי א"א צדוק הדין אפילו בע"ש אחר חצות וכיו"ב - אלא שהוא כנ"ל שתקנתן ביחוד היא.
