To the great Rabbi*, distinguished Chassid* who fears Hashem,

Rabbi Shmuel[1],

I greet you and bless you,

I duly received your letter from the eve of the festival of Sukkot*, to which were attached several pages of your book, the Minchat Shmuel*[2]. I therefore offer you several remarks that have been formulated regarding this book.

Beginning of the Minchat Shmuel*: Rashi*, in his commentary on the Mishnah*[3], at the beginning of tractate Berakhot*, considers, unlike the Rambam*[4], that the Sages* did not require completing the burning of the fats and limbs of the sacrifices before midnight. His position can be explained as follows. This burning was performed by the Kohanim*, who are by nature zealous[5]. For the Rambam*, however, this quality does not manifest in this domain, as the Tosafot* also explain in tractate Pesachim* 85a.

The Maharsha* and other commentators question the assertion of the Tosafot*, and given the force of the argument, one may admit that ultimately the Tosafot* themselves adopt the view of the Maharsha*, even if they advance a stronger explanation. And the reasoning of the Rambam* can also be justified simply. According to him, the burning begins, in this case, when the sacrifice is offered, that is, several hours[6] before nightfall. Consequently, if the fats and limbs have not been burned by midnight, it is then established that in this case the Kohanim* did not display diligence. This interpretation of Rashi's* commentary is also stated, in particular, by the Ramaz*, cited by the Tosafot Anshei Shem*, by the Chiddushei Maharya'h* and by the Nitzotzei Or of Rabbi Reuven Margolis*[7], so that one may wonder why Rashi* does not mention it clearly.

But, in my humble opinion, Rashi* does in fact give this explanation and states it clearly. Indeed, he specifies that: 'the Sages did not limit it to midnight at all' after having first specified the reason why the recitation of the Shema Yisrael* and the consumption of the sacrifices was limited to midnight. He says: 'They prohibited eating the sacrifices before their time so as not to incur the penalty of Karet*, of excision of the soul. And the same applies to the recitation of Shema Yisrael*, since it is then a matter of prompting diligence in the person[6]. (The burning after sunrise is not punishable by Karet* and the Kohanim* are not ordinary people who need to be prompted to diligence). As for the burning of the fats, the Sages did not limit it to midnight at all (not even ab initio, as is the case for Shema Yisrael*)'

Furthermore, Rashi* adds: 'And if the time has passed,' for this is not a certainty with regard to the burning of the fats. If they have been placed at the edge of the altar, it remains possible to burn them. And Rabbah* states, in tractate Zevachim* 87a, that if they have been removed from it, they may be returned, for they have not[6] thereby been rendered unfit. This is the position Rashi* adopts here, in the Mishnah* of Berakhot*, whereas the Rambam* follows the view of Rava*[8], holding that they are indeed rendered unfit.

What has just been said will enable us to understand why Rashi* does not comment[6] on this burning in the passage where it is discussed, but only after specifying why the recitation of Shema Yisrael* was limited to midnight. For it is precisely there, in his view, that the reason lies why the Sages said nothing of the kind regarding this burning.

At the same reference: Is the impurity of a person a state that is superimposed upon him, or is it merely an absence of holiness? In fact, one may consider that both propositions are correct. Consequently, in order to consume agricultural tithes* after purification, it suffices to wait for sunset. In contrast, this is not the case when it concerns consuming consecrated items*. In that case, one must first offer a sacrifice and thereby bring holiness to light.

In any event, with regard to the subject of our discussion, tractates Zevachim* 17a, Kelim* chapter 1, Mishnah* 5, and other texts[6] clearly establish that one who has not yet been fully purified retains thereby a certain form of impurity, even a minor one. Nevertheless, there are several stages of impurity and also of holiness, since these two domains are 'one opposite the other.' Consequently, one who has not yet completed atonement is only prohibited from consuming consecrated items*. Likewise, agricultural tithes* are forbidden to one who still lacks ritual immersion* for purification. These are Torah* provisions, and one should consult in this regard the teaching of the Ari Zal* in the Shaar HaKavanot* and the Pri Etz Chaim*, Gate of Blessings, chapter 3.

Furthermore, these texts show that the distinction that can be made between the holiness of consecrated items* and that of agricultural tithes* is found in the same way between the holiness of Shabbat* and that of the festival, as explained in Likkutei Torah*, Parshat Tzav*, page 11d. However, one may question the assertion of tractate Zevachim* 91a, according to which Rosh Chodesh* is holier than Shabbat*. But this can be explained based on the remark of the Shulchan Aruch* of the Admur HaZaken*, section Orach Chaim*, at the beginning of chapter 242, which notes that regarding Chol HaMoed* the expression 'sacred convocation' is not used. Yet this expression is indeed used regarding the sacrifices, as Rashi* recalls in tractate Zevachim* 91a.

ס' מנחת שמואל. בתחלתו. בפרש"י למשנה ריש ברכות: דהקטר חלבים ואברים לא גזרו חכמים שיהי' עד חצות (משא"כ להרמב"ם ), די"ל הטעם מפני דהקטר הוא ע"י כהנים וכהנים זריזין הן (ולהרמב"ם - בזה לא אמרינן דזריזין הן, וע"ד פסחים פה, סע"א לגבי יוצא, ע"פ התוס' שם).

- (והנה כבר הקשו על התוס' שם - במהרש"א ועוד - ולחומר הקושיא י"ל דלמסקנא גם התוס' ס"ל כמהרש"א, אלא דעדיפא להו משני. וסברת הרמב"ם י"ל בפשטות, דבנדו"ד שההקטר התחיל זמנו בעת הקרבת הקרבן, היינו כמה שעות לפני הלילה (כפסחים רפ"ה) הרי באם עד חצות לילה לא הוקטרו החלבים ואיברים - מוכחא מילתא דהני כהני אינם זריזין).

- והנה בטעם פרש"י כנ"ל - כ"פ גם הרמ"ז (הובא בתוס' אנשי שם), חידושי מהרי"ח, בס' ניצוצי אור (להרב ראובן מרגליות שי') ועוד. ולכאורה צ"ע שלא רמזו רש"י כלל בפירושו.

ולפענ"ד רש"י עצמו כתב נימוקו על אתר ובמפורש, כי מש"כ "והקטר חלבים כו' לא אמרו בו חכמים עד חצות כלל" בא בהמשך למש"כ קודם לזה בטעם הגזירה דעד חצות בק"ש ואכילת קדשים, וז"ל: ואסרום (קדשים) באכילה קודם זמנו כדי שלא כו' יתחייב כרת וכן

בק"ש לזרז את האדם (לכאורה ב' תיבות מיותרות - אלא להדגיש בא, סתם בנ"א) שלא כו' ובתוך כך כו' ועבר לו הזמן (וכיון דבהקטר לאחר עה"ש - אין כרת, וכהנים אינם סתם בנ"א ואין צורך לזרזם, עכצ"ל, כשר) והקטר חלבים כו' לא אמרו בו חצות כלל (אפילו לא לכתחילה כבק"ש). ועוד י"ל בדיוק והוספת רש"י "ועבר לו הזמן", כי בהקטר ג"ז אינו ודאי, כי אם לן בראשו של מזבח מקטר לעולם ולרבה אפילו אם ירדו יעלו (עיין זבחים פז, א) דלא נפסלו - דאליבי' קאי רש"י (ד"ה מצותן) כאן במתניתן בברכות (משא"כ הרמב"ם דפוסק כרבא דנפסלו אפילו בראשו של מזבח).

וע"פ הנ"ל יומתק מה שדיני הקטר פרש"י לא במקומו (בד"ה מצותן) כ"א לאחרי שפירש טעם גזירת עד חצות בק"ש כו', כי אך זה מכריח - לרש"י - לומר דבהקטר לא אמרו חכמים כו'.

שם . אדם שנטמא - אם הטומאה דבר שנוסף או בא ממילא ע"י העדר הקדושה כו', ודי"ל דשניהם ישנם ולכן בתרומה די הערב שמש (המסלק הטומאה) ולקדשים צריך גם קרבן (המשכת קדושה).

ולכאורה אאפ"ל דבא ממילא כו' - שהרי אין טומאה לעכו"ם וכו' אף שהם היפך הקדושה. אלא שבזה יל"פ שאינם בגדר טומאה וטהרה (בחייהם).

ובכל אופן - בנדו"ד, מפורש הדבר שגם במחוסר כפורים עדיין טומאה (קלושה) עליו (זבחים יז, א ושם. עיי"ש. כלים פ"א מ"ה. ובכ"מ ). אלא שכמה דרגות בטומאה וכן בקדושה והן זה לעומת זה, ולכן מחוסר כפורים אסור רק בקדשים וטבול יום גם בתרומה כו' (כלים שם ובכ"מ), ובקודש יש רביעי משא"כ בתרומה רק שלישי כו' (טהרות פ"ב) וכ"ז מן התורה. - ולהעיר מדברי האריז"ל בשער הכוונות ובפרי עץ חיים שער הברכות פ"ג.

ולהעיר אשר משם מובן שכחלוקת קדושת קדשים ותרומה היא חלוקת קדושת שבת ויו"ט (וראה לקוטי תורה צו יא, ד) וראה פסחים (קד, א). וצע"ק בזבחים (צא, רע"א) דר"ח מקודש יותר משבת, ויש לתרץ ע"פ הציון בשו"ע אדה"ז חאו"ח ר"ס רמב בחוה"מ דלא נאמר בו מקרא קודש אלא שקרוי כך לענין קרבנות, וכדיוק רש"י בזבחים דמוספי ר"ח מקודשין כו', ועצ"ע ואכ"מ.
