To the great Rav*, distinguished and pleasant Chassid*,
who fears Hashem, Rav T. H.* (note 1: Rav Tzvi Hirsch Friedman.),
I greet you and bless you,
I have duly received your letter of this Monday, as well as your Torah* explanations that you had previously sent me (note 2: See Likkutei Sichos*, vol. 7, p. 320 and vol. 32, p. 245.). It is well known that my purpose is not to decide the Halachah*, in particular in the domains that are treated by many Decisors. Please excuse me for this.
Our Sages* underscore the importance of commenting on the Torah*. The Rambam*, in his Sefer HaMitzvos*, at Prohibition no. 347, considers that the verse: "and to the wife of your fellow... (note 3: "You shall not give your seed.")" applies only to the man. Such is also the opinion of the Sefer Mitzvos Gedolos*, at Prohibition no. 97. And, it seems that the Sefer HaYereim*, chapter 214, also states: "Our Creator warns us against the immoral man" and not: "against immorality," according to the formulation that appears in certain versions. The Chinuch*, at Mitzvah* no. 35, specifies that: "This prohibition was repeated" and the Minchas Chinuch*, at the same reference, indicates: "If one warns someone, one must mention, in this warning, the two verses at once," which means that he does not explain why this Prohibition applies precisely to the man.
Commenting on the verse Acharei 18:20, the Ramban* says: "Perhaps one must see in this the reason for the prohibition," but one can truly wonder whether this interpretation has an incidence on the Halachah*, for:
1. He himself says that his explanation does not concern the Halachah*, in the case of a punishment,
2. He retracts his position (note 4: The Rebbe* underlines the expression: "retracts his position.") and he subsequently writes: "This is what is correct in my eyes...," but he does not say, for example: "There is another explanation,"
3. He concludes, at this reference: "Our Sages* explain," thereby alluding to the Sages* who state the Halachah* of the Torah*.

...ע"פ מרז"ל בפטפטייא דאורייתא: כדעת הרמב"ם (סהמ"צ מל"ת שמז) דואל אשת עמיתך גו' אזהרה לאיש בלבד - כ"כ גם בסמ"ג ל"ת צז. (וכנראה בס' יראים בסרי"ד ג"כ צ"ל: הזהיר צורנו על הנואף - ולא "הניאוף" כבדפוסים). ובחינוך מצוה לה "וכפל זה הלאו" ובמנ"ח שם "מתרין בו מלאו זה דכאן או מלאו דואל" - עפ"ז חסר הביאור שהיינו דוקא בנוגע לאיש.
מדברי הרמב"ן (אחרי יח, כ): ואפשר שאמר כו' טעם האיסור - צע"ג עם יש ללמוד מזה בנוגע להלכה, שהרי: א) מסיים שאין טעם זה נוגע להלכה (לעונש). ב) חוזר בו וכותב: והנכון בעיני כי בעבור כו' (ולא כתב: ועוד יש לומר או כיו"ב). ג) חותם שם: ורבותינו דרשו - שכוונתו לרבותינו בהלכה שבתורה.
