To the great Rav*, distinguished Chassid* who fears Hashem,
possesses extensive knowledge, devotes himself
to communal needs, Rav* M. (note 1: Rav* Meir Amsel, of Brooklyn. See, regarding him, letters no. 3821 and 6905.),
I greet you and bless you,
I respond to your letters, in which you propose that we correspond for the purpose of clarifying the Halachah* concretely applicable in various domains that you enumerate (note 2: See Likkutei Sichos*, vol. 11, p. 247.). However, you no doubt know that it is in no way my practice to determine the Halachah* as it must be put into practice, in a concrete manner, particularly in domains that are treated by numerous people, analyzing the question from every angle.
Such is the path that was traced by my father-in-law, the Rebbe*, for his household, except in exceptional cases, when there are good reasons, important justifications leading one to intervene in the discussion. Moreover, numerous are those, in New York and, more generally, in the United States, who would be happy if they were asked to formulate an opinion in this matter. Of course, I allude to Rabbanim*, authorized to teach the Halachah*, to decide it without compromise, in a practical manner. Furthermore, they will be grateful to you if you publish their statements. You will therefore kindly excuse me (note 3: For declining this proposal.). In addition to the essential reason, previously stated, I do not have the necessary time, so that the satisfaction of such a request is not timely. With my respects and my blessing,

You will consult the statement of our Sages*, in Tractate* Berachos* 63a, according to which: "when (note 4: The Rebbe* underlines the words: "when," "what," "in opposition," and "all.") all distribute, gather!" and this applies, in the same manner, to what (note 4) is distributed. The great Rav*, Rav* I. M. HaKohen R. (note 5: Rav* I. M. Rappoport.), wrote regarding sunset and I am surprised by the content of his explanation, especially since I have known him for a long time. I therefore do not understand how he could have asserted such a thing. Nevertheless, I do not have at my disposal the Kuntres Hashlamah* (note 6: A supplementary tract.), the Zichron Yosef*, the Bnei Tzion*, the Divrei Channah*, and the Kaneh VeKinamon*. But, perhaps he wished to defend the statements, cited at the end of the work, of the Ramal* and those who support him. The explanation given, in this regard, by the Nimukei Yosef*, Orach Chaim*, chapter 261, must have escaped him. I will say no more.
Regarding what he writes, on this subject, about the position of the Alter Rebbe*, set forth in his Siddur*, without even citing his name, any more than that of the Yerushalmi* or the Radbaz*, he asserts that one cannot consider the opinion of Rabbeinu Tam* as an isolated view, since the Chida* writes, in the Shem HaGedolim*, that the decision of the Shulchan Aruch* emanates from two hundred Gedolim* of his generation. Now, if one were to interpret, in the Halachah*, the words of the Chida* in the manner in which he does, it would have been preferable for his question to concern the Rama*, who contradicts the Shulchan Aruch* on various occasions. Indeed, it has never been said that two hundred and one Gedolim* sat on the court of the Rama*. In any event, this in no way concerns the words of the Alter Rebbe*, who specifies: "Rabbeinu Tam* and those who follow him have an opinion that is not shared," in opposition (note 4) to the Geonim* and those who followed them. Moreover, he writes that the Shulchan Aruch* reversed its position. He also cites the Pri Chadash* and the Aruch HaShulchan*. In this case, all (note 4) indeed adopt the position of the Geonim*. And, the Pri Chadash* is cited by the Siddur*. As for the Birkei Yosef* and the Aruch HaShulchan*, they appear in the Orach Chaim*, chapter 261.
To clarify all his positions, you will also consult the Minchas Cohen*, the Bein HaShmashos*, of Rav* Y. M. Tukachinski, and the article "sunset," in the Talmudic Encyclopedia.

במענה למכתביו, בם מציע אשר אבוא בכתובים לברר פסקי הלכות למעשה בכמה ענינים שמונה וסופר במכתביו.
והנה בודאי יודע - שבכלל אין זה מעניני לתקוע עצמי לפסקי הלכות למעשה, ובפרט בענין שרבים הדנים בזה, וממצים הענין לכל צדדיו.
והרי זוהי הדרך אשר התוה כ"ק מו"ח אדמו"ר בבית הרב - מלבד במקרים יוצאים מן הכלל, שישנם טעמים מסוימים וסיבות חשובות, להכנס לשקו"ט כהאמורות.
ובפרט אשר רבים בניו יארק ובאה"ב בכלל, אשר ישמחו אלי גיל כשיציעו לפניהם לחוו"ד בהאמור (כמובן כוונתי לרבנים אשר ראוים הם לאיצטלא דמורה הוראה, לפסוק דין מבלי משוא פנים ולמעשה בפועל), ובטח גם יחזיקו לו טובה על הדפיסו את דבריהם וכו'.
ואתו הסליחה. נוסף על טעם העיקרי הנ"ל, הרי גם אין הפנאי ואין הזמן גרמא למלאות בקשה כהאמורה.

להעיר ממחז"ל בשעת המפזרים כנס (ברכות סג, א) - וה"ז הטעם גם בענין שבו מפזרים.
במש"כ הרה"ג וכו' וכו' הררי"מ הכהן שי' ר. בענין ביה"ש - תמהתי על תוכנו. ובפרט בידעי את הנ"ל מאז, שאין מובן איך כותב דברים כאלו (אלא - שקונ' השלמה, הס' זכרון יוסף, בני ציון, דברי חנה, קנה וקנמון אינם תח"י). ואולי בא לו משום רצונו להגן עמש"כ בסו"ס חי' הרמ"ל וסייעתי' - ואשתמיטתי' מש"כ בזה בנימוקי או"ח סרס"א. וד"ל.
ובנוגע למש"כ הנ"ל ע"ד אדה"ז בסידורו בזה - לא סמך שם אדה"ז ואף לא הביא שם - לא הירוש' ולא הרדב"ז, ומה שהקשה - דאאפ"ל דר"ת יחידאה הוא כיון שכתב החיד"א בשה"ג דפסקו של השו"ע הוא פסק ר' גדולים בדורו (ואם נפרש כן - להלכה - דברי החיד"א - עדיפא הו"ל להקשות ולהפריך כל דברי הרמ"א בכ"מ שמחולק על השו"ע, כי מעולם לא שמענו שבב"ד של הרמ"א ישבו מאתים ואחד גדולים.
ובכל אופן) אי"ז שייך לדברי אדה"ז שדייק בלשונו ר"ת וסייעתו יחידאי נינהו נגד הגאונים. ואחריהם וכו'. נוסף על כתבו שהשו"ע חזר בו. ולהביאו הפר"ח החיד"א וערוך השלחן - הנה בנדו"ד כולם כתבו כשיטת הגאונים (הפר"ח - הובא בסידור שם. ברכ"י ועה"ש - באו"ח סרס"א שם).
