Igrot Kodesh · Letter 8936 — Teshuvah

Volume 23 · Letter 262 · To: grand Rav

By the grace of Hashem,

12 Shevat* 5725,

Brooklyn,

To the great Rav*, Chassid* who fears Hashem, of

an illustrious family, Rav* Elimelech Alter (note 1: Rav* E. A. Fanet, of Brooklyn.),

I greet you and bless you,

There exists a debate regarding one who consumes Chametz* on Pesach*. Indeed, even though this man transgresses a Prohibition of the Torah*, he nevertheless fulfills, in this way, the Positive Commandment of destroying the Chametz*, so that he no longer contravenes the prohibition of seeing Chametz* in his possession. I found in my notes that this explanation is given by the Teshuvah MeAhavah*, chapter 182. This is not the view, however, of the Taam HaMelech* on the Rambam*, Laws of Chametz* and Matzah*, chapter 1, paragraph 3. But, for the moment, I do not have these works at my disposal.

In the explanations of the Ravad* and the Ramban* on the Baal HaMaor*, commenting on the Rif* on the first chapter of Tractate* Pesachim*, one can find a prohibition against eating (note 2: The Chametz* for the purpose of destroying it.). Nevertheless, one who disregards this Prohibition and eats it has indeed fulfilled a Positive Commandment (note 3: That of destroying the Chametz*, which is accomplished by consuming it.).
