I consider (note 1: This letter is addressed to the directorate of the "Compilation of the Poskim*," Otzar HaPoskim*. See this work, the Otzar HaPoskim*, Even HaEzer*, vol. 9, published in Yerushalayim*, in 5725 (1965), p. 130, as well as Likkutei Sichos*, vol. 12, pp. 193 and 212, or the HaMaor*, issue no. 154, of Tammuz* 5725 (1965).) that it is my duty to draw your attention to the disaster that reigns in the domains treated by these chapters of the Shulchan Aruch*, Even HaEzer*, due to a lack of knowledge on the part of the children of Yisrael*, in their entirety. It is therefore certain that by making widely known the gravity of such a situation, numerous people will remedy it, in the proper manner. I will therefore draw your attention to several points:

A) Regarding the prostate operation (note 2: See, regarding this, letter no. 7633.), nearly all surgeons cut, or sever in another manner, the seminal ducts. Moreover, they begin to do so even before the actual operation proper begins. Now, I have spoken with several Rabbanim* who teach Halachah*, who did not even know that this poses a problem! Certainly, this question is treated at the end of the first volume of the Otzar HaPoskim*, but only in a note and together with other elements, rather than as a separate heading. As a result, very few know that there are discussions on this matter, and even those who are aware of them have no definitive conclusion applicable to concrete action.

One may wonder whether the majority of surgeons who operate will agree not to sever the seminal ducts. On the other hand, it is certain that they will agree to do so only at the end of the procedure. However, for this element to become known, it is necessary to publicize the conclusion, according it the place it deserves, rather than placing it at the end of a volume, amid other points. This information must be given in a prominent place and perhaps even appear in the table of contents and the analytical index. I add that, if surgeons testify that they performed this procedure without severing the ducts and that it was nevertheless successful, there is every reason to think that this will influence other doctors, who will also cease such incisions. Now, even for a doubt of a doubt, such dissemination is justified.

B) To continue with what has just been said, it is observed, in numerous cases, that a testicle is not in its place and the doctors then undertake to bring it down into the scrotum. Another treatment then allows the second testicle to be located. Sometimes, here again, surgery is performed and, in such cases, the Torah* prohibition of severing the reproductive organs is very often transgressed. Now, this treatment can be performed in another manner and, often, in a manner permitted a priori by the Torah*. But, the parents do not know that there is a problem and that a Rav* must be consulted. Moreover, some Rabbanim* who teach Halachah* are themselves unaware of all this. Here again, proper publication in the next volume will undoubtedly allow this obstacle to be overcome. The same is true also for treatments related to an infection of the scrotum, except that these concern not only children but also adults.

C) There is also another problem, immediate and essential, indeed one that, from time to time, becomes increasingly critical — that of the adoption of children (note 3: See, regarding this, letter no. 8700.). The number of those who wish to adopt a child is growing, and I have observed several situations in which couples who scrupulously observe the least enactment of our Sages* take no account (note 4: The Rebbe* underlines the words: "take no account" and "much.") of the prohibition against secluding oneself with these children, embracing and kissing them, which applies, in all its rigor, to those who are adopted. I have seen various books and pamphlets dealing with the precautions necessary, in such cases, so that a brother does not marry his sister. Others inquire about inheritance. Now, all these questions arise only after several years of adoption, they are only a risk and, very often, have only a financial impact, which is not the case for the prohibitions referred to above — for example, that of seclusion — which are certainties and arise many years before the children reach the age of marriage.

It is quite clear that this must be distinguished from the practice of raising in one's home an orphan boy or an orphan girl, a practice that was formerly common among the children of Yisrael*. In the current era, indeed, adoptive parents want to hide from the child that they are not his real parents. They therefore strive, with the greatest scrupulousness, not to make the slightest gesture, not to take any initiative that might arouse the slightest doubt in the heart of the adopted child. The parents must therefore treat him in a manner identical to the others. Moreover, various institutions responsible for placing these adopted children receive from the outset the assurance, or even demand it, that the child will be raised without being troubled or disturbed, which means that he will be regarded, down to the smallest detail, as a true son or daughter. Then, doctors and psychologists add that such a relationship is indispensable for his education not to be undermined. To persons such as yourselves, it is surely unnecessary to say more. I add only that the number of adopted children is much (note 4) greater than what one imagines or what statisticians say. Indeed, a large portion of adoptive parents and, even more so, of institutions responsible for adoptions, want no publicity, for various reasons (note 5: The Rebbe* notes at the bottom of the page: "Does all this also apply to a man marrying a woman who has daughters from a previous husband, or to a woman marrying a man who has sons from a previous wife? It is true that such a situation is comparable. However, as was said regarding the raising of an orphan, of which our Sages* have spoken in praise, one will not hide from the child, in this case, that he is not the daughter of this man or the son of this woman. The two will therefore keep their distance, for we are not speaking here of impious persons. This is not the case, however, for what is the subject of our discussion, since one strives to hide it from the child and habit becomes a second nature." The Rebbe* underlines the words: "one will not hide" and "one strives.").

Consequently, may Hashem grant that any dissemination, any warning about the gravity of the situation that can be included in the next volume will allow the correction of what must necessarily be corrected in this matter. Certainly, such a publication should be made in the framework of a work that will be read by heads of families and by those who wish to adopt. Nevertheless, it is fitting to begin with a compilation like the Otzar HaPoskim*, by underscoring this prohibition in the proper manner, by showing that it is transgressed every day, that, under the conditions of our era, it is practically impossible to guard against it, that scrupulous and permanent observance of these provisions is necessary, including when the adoptive parents have the fear of Hashem.

It is quite obvious that the editorial board of the Otzar HaPoskim* (note 6: See, regarding this, letter no. 8954.), a work of Halachah* destined for those who teach it, will be able to ask the monthlies, the weeklies, the various periodicals, to publish all this. And, one may think that these organs will accede to such a request. I address to you my respects and my blessing that Hashem confer upon you success in your sacred mission, which consists of teaching the people of Hashem the royal Way, that of the supreme King, the Holy One, blessed be He, the path of life, through words whose consequences, as I have said, will manifest themselves until the end of the generations.

... רואה אני חובה להדגיש הפרצה הגדולה השוררת בשטח הענינים עליהם מדובר בסימני שו"ע אבן העזר אלו, עקב חסרון הידיעה בזה בין המוני עם בנ"י. שלכן ודאי שעל ידי פרסום חומר הענין יזהרו כמה וכמה בזה ויתקנו כפי הדרוש. ואציע נקודות אחדות לתשומת לבם:

(א) בנוגע לניתוח הפרוסטטה, רובם ככולם של הרופאים כורתים (או מנתקים באופן אחר) כמה משבילי הזרע, ולא עוד אלא שמתחילים בזה (ניתוק השבילים) עוד קודם להניתוח עצמו. ובדברי עם כמה רבנים בעלי הוראה לא ידעו אשר יש כאן מקום לשאלה. ואף אם כי בכרך ראשון של אוצר הפוסקים בסופו נגעו בהאמור, הנה מפני שבא בחלק ההערות ולא קבעו מדור לענין זה בפני עצמו כי אם ביחד עם ענינים אחרים, מעטים ביותר היודעים ע"ד השקו"ט אשר שם, וגם אלו היודעים אין בידם מסקנא ברורה בנוגע לפועל.

צריך עיון אם רוב הרופאים המנתחים יסכימו שלא לנתק כלל את שבילי הזרע, אבל בודאי רובם יסכימו שיבוא הניתוק בסיום הטיפול, אלא כדי שיתפרסם הדבר צריכה לבוא מסקנא ובאופן דקביעת מקום בפ"ע, ולא בסוף כרך ובתוככי כו"כ ענינים, כי אם במקום מתאים, ואולי גם בהוראה על זה במפתח כללי ובמפתח ענינים וכולי.

ועוד להוסיף, שבאם יבואו רופאים מנתחים בעדות שעשו הטיפול האמור בלי ניתוק שבילי הזרע והצליחו, קרוב לומר שזה ישפיע על כמה רופאים אחרים שלא ינתקו כלל. והרי אפילו משום ספק ספקא כדאי הפרסום.

(ב) מעין האמור ובהמשך לזה, כמה וכמה מקרים ישנם שביצה אחת נמצאת שלא במקומה והרופאים מטפלים בהורדתה לכיס, ויש עוד טיפול לבחון איפה נמצאת הביצה השני' וכו', אשר לפעמים גם במקרים אלו מנתחים ואופן הניתוח לפעמים תכופות קשור באיסור דאורייתא דכרות ונתוק וכו', אף שהטיפול אפשר שייעשה באופן אחר, ובכמה מקרים באופן המותר גם לכתחילה. אלא שאין ההורים יודעים שיש כאן מקום לספק ולשאלת רב. ומה שנוגע עוד יותר הוא שכמה רבנים מורי הוראה אינם יודעים הפרטים האמורים. וגם בזה פרסום בכרך הבא במקום מתאים בודאי שיועיל למנוע מכשול.

כל האמור הוא גם בנוגע לטיפול בשבר שבכיס, בהוספה שזה נוגע לא רק לקטנים אלא גם לגדולים וכולי.

(ג) עוד בעי' והיא קרובה ועקרית, ולא עוד אלא שמזמן לזמן מתגדלת התקלה, והיא בשאלת אימוץ ילדים. מספר המשתדלים לאמץ ילדים הולך ורב, וכפי שראיתי בכמה וכמה מקרים של זוגות המקפידים אפילו בדקדוק קל של דברי סופרים, לא שמים לב כלל שכל עניני איסור יחוד חיבוק ונישוק וכו' וכו' קיימים בתקפם בנוגע לילדים המאומצים, ראיתי בכמה ספרים וחוברות שמטפלים בבעי' איך להבטיח שלא ישא אח את אחותו וכו' וכן יש שדנים בנוגע לשאלת ירושה וכו'; אבל הרי כל זה בא לאחרי כמה שנות אימוץ, והם בגדר ספק, וכמה רק בעניני ממונות, משא"כ איסורים הנ"ל (יחוד וכו') הם בגדר ודאי ומתחילים כו"כ שנים לפני שמגיעים הילדים לפרקם.

פשוט שאין האמור לעיל דומה לענין גידול יתום ויתומה שהי' נפוץ בין בנ"י, כיון שבשנים אלו כוונת המאמצים היא להעלים מהילד המאומץ שאינם הוריו האמתיים, ומשתדלים ומדייקים בזה שלא להראות כל תנועה וענין שיעוררו חשד בלב הילד המאומץ שהיחס אליו אינו דומה להיחס לחבריו מצד הוריהם הם, ולא עוד אלא שכמה מהמוסדות המחלקים ילדים לאימוץ מקבלים (או גם דורשים) הבטחה מראש שהילד יגדל ללא כל סיבוכים והפרעות, זאת אומרת שיהי' היחס אליו בכל הפרטים כמו לבן ובת מבטן ומלידה, ובאים ומוסיפים רופאים ופסיכולוגים שמוכרח יחס כזה כדי שיהי' החינוך בלי תקלות, ובודאי לדכוותייהו האריכות אך למותר, ורק להוסיף אשר מספר הילדים המאומצים הוא כמה פעמים ככה מאשר משערים או מודיעים בעלי הסטטיסטיקה, כיון שכמה מהמאמצים ועוד יותר כמה מהמוסרים ילדיהם

לאימוץ - אינם רוצים כלל בפירסום מכו"כ טעמים*.

ולכן כל הפרסום וכל האזהרות על דבר חומר הענין וכו' שיתנו בכרך הבא, הלואי שיספיק להביא התיקון המוכרח סו"ס לבוא בענין האמור, ואף שלכאורה המקום לפרסום האמור צריך להיות בספר הנקרא על ידי בעלי-בתים ואותם הרוצים לאמץ ילדים, אבל ההתחלה בזה ראוי' שתבוא בספר כאוצר הפוסקים וכיו"ב, בהדגשה מתאימה על האיסור ואשר נשנה האיסור בכל יום ויום, ובתנאי תקופתנו כמעט שאי אפשר להזהר ממנו, כי אם על ידי השתדלות קפדנית ומתמידה, ואפילו אם יהיו מאמצי הילדים יראי השם.

ופשוט שביד מערכת אוצר הפוסקים, בתור קובץ למורי הוראה בישראל, לדרוש מירחונים ושבועונים ומכתבי עתים לפרסם ענין האמור, ויש מקום לומר שימלאו בקשתם ודרישתם בזה.

בכבוד ובברכה אשר יצליח ה' מלאכתם בקדש להורות לעם ה' דרך המלך היא דרכו של ממה["מ ה]קב"ה באורח חייהם, וכנ"ל - בדברים אשר תוצאותיהם עד סוף כל הדורות.
