devotes himself to communal needs, of multiple
areas of knowledge, Rav* S. Y. (note 1: Rav Shlomo Yosef Zevin. See, regarding him, letter 8731.),
I greet you and bless you,
I have duly received your letter of 6 Mar Cheshvan*, with what was enclosed (note 2: See Likkutei Sichos*, vol. 9, p. 361.). I am sending you a copy of the letter that I am addressing to that person (note 3: A. Ron. This is letter no. 8897.), in which I also allude to the problem of Manachat*, which you must know about. Regarding the committee that was designated (note 4: To resolve the conflict between the two school directors. See letter no. 8897.), I was unable to acknowledge receipt until now of the information that was given to me on this subject, due to the many activities of the month of Tishrei*.
Concretely, I have the following question. One of the members of this committee is the brother of one of the directors, which does not seem proper. Certainly, I made his acquaintance when he was here and I was able to observe that he is an upright man, but such a manner of acting is nonetheless surprising. Another point also arouses the strongest astonishment and perhaps even more than that: you yourself are not part of this committee! Certainly, it is not for you to designate the teachers, especially according to my personal opinion that the Mitzvah* you must fulfill in the most scrupulous manner is specifically the publication of the Talmudic Encyclopedia, as I have written to you many times (note 5: See letters no. 2373, 6525, 8017 and 8819.). Despite all this, you should, in my view, be part of this committee and possess a decisive vote in it, when its four other members cannot reach a decision. But, in fact, of the two questions I have just posed, the one provides the answer to the other, in a pleasant and respectful manner. I therefore leave it to your understanding to determine whether it is necessary to reveal that this remark emanates from me or whether one should say, more diplomatically, that the necessity for the change does not come from here. In fact, the reasons invoked are very clear and there is therefore no reason, no necessity to specify that they come from far away, from another continent.
You also respond to my remark regarding the commentary of the Rambam* on the Mishnah*, in Tractate* Demai*, chapter 1, Mishnah* 2 (note 6: See letter no. 8891.). It has been explained, indeed, that the Rambam* had crossed out a certain phrase with a stroke of the pen. But this did not mean that it was an error. In fact, a certain period of time elapsed between the moment when the Rambam* wrote this phrase and the moment when he crossed it out. Indeed, all (note 7: The Rebbe* underlines the word: "all.") editions of the Mishnah* bear this first version and it is on the basis of this assertion that the meaning of this Mishnah* is taught. For now, I have seen no one who contests it. Now, according to this version of the Mishnah*, the interpretation that the Rambam* gives of this text is the same as that of Rashi*, echoing his commentary on the verse (note 8: Shemini* 10:19.): "I consumed the sin-offering on this day." This will also be acceptable to the Rambam*.
What leads me to this conclusion is the desire not to introduce a difference between the Onen* (note 9: Who has just lost a relative and has not yet had time to bury him.) and "one who has a deceased placed before him" (note 10: Who has not yet been buried, regardless of the date of death.), by reference to the verse (note 11: Tavo* 26:14.): "I did not consume the tithe while being an Onen*." Certainly, the Yad HaChazakah*, regarding the Onen*, makes only one category of the second tithe and of all that is consecrated, in general. It cites all the corresponding verses jointly. It is not certain, however, that this is actually the case, for the second tithe is not consecrated. And, the Rambam* cites the verse (note 11): "I did not consume the tithe while being an Onen*" by virtue of the principle according to which he systematically opts for the simplest explanation. And, this can be compared to what is said in the words of the later Sages*, underscoring the independence of the status of Onen* and mourning, since mourning begins precisely when one ceases being an Onen*, that is, at the burial. I have therefore thought that one could advance, based on the version of the commentary of the Mishnah* that we have (note 12: The Rebbe* notes at the bottom of the page: "One should consult the commentary of the Rosh*, at the end of Tractate* Maaser Sheini*. However, one may think that he adopts entirely the view of Rashi*, including for consecrated items."), the following distinction: the prohibition of the second tithe is derived from the verse (note 11): "I did not consume the tithe while being an Onen*," whereas that of consecrated items is established by the other verse (note 8): "I consumed the sin-offering on this day." And, this difference is not clearly made in the Yad HaChazakah* by virtue of the principles of the Rambam* according to which, very often, he does not mention laws presenting a novel idea that do not appear in the Talmud*. בנוגע להועד שבחרו בו, מפני עניני חדש תשרי, אישור קבלת ההודעה נתעכב עד עתה.
בנוגע לפועל, מה שקשה בעיני, שאחד מחברי הועד הוא אחיו של אחד מהמנהלים, שלכאורה אין זה ענין, ואף שכפי שהכרתיו בהיותו כאן, איש ישר הולך הוא, אבל בכ"ז וכו', כן כמובן יש בזה עוד תמי' (ועיקרית ואולי עוד יותר), והיא, שלא ראיתי שם כת"ר שי' בהועד, ואף שבודאי אין זה מענינו להתעסק בבחירת מורים וכו' [ובפרט לשיטתי אני, אשר מצוה דהוא זהיר בה טפי, היא האנציקלופדיא תלמודית לחוד, כמו שכתבתי זה כ"פ], בכ"ז לדעתי צ"ל הוא בהועד בתור מכריע, כשלא יוכלו לבוא לעמק השוה שאר ד' חברי הועד. ובשתי הקושיות האמורות הרי האחת מתרצת את חברתה באופן של נועם וכבוד. ואל בינת כת"ר שי' אשען אם צריך לגלות שהערה האמורה באה מצדי, או שיותר דיפלומטי - שלא מכאן תבוא ההערה להשינוי. והרי טעמים האמורים גלוים הם ואין צריכים וזקוקים להביא ממרחק - מעבר לים - לחמו...
למענתו בנוגע להערתי בפירוש המשניות להרמב"ם דמאי (פ"א מ"ב), שמתרצה בזה, שהרי הרמב"ם העביר קולמוס ע"ז: הנה לא היתה בזה פליטת הקולמוס וכיו"ב, כ"א הפסק (בין הכתיבה והעברת הקולמוס) של כמה זמן כנראה, שהרי כל דפוסי המשניות נכנסה בהם דוקא הגירסא של המשנה הא' ונלמד פירוש המשניות באופן כזה. ולא מצאתי ע"ע מי שיעורר בדבר, ז.א. שלפי גירסא האמורה דעת הרמב"ם בפירוש המשניות שלו כדעת רש"י בזה [וכפי שיתורץ אליבא דרש"י מקרא דואכלתי חטאת היום - מתורץ ג"כ להרמב"ם].
הענין שהביאני לכל האמור הוא שלא לחלק בין "אונן" ו"מי שמתו מוטל לפניו" - ל"אכלתי באוני", כי אף שביד החזקה מערב בנוגע לאונן, מעש"ש וקדשים ביחד וגם הפסוקים ביחד, לכאורה אין זה מוכרח כלל וכלל - שהרי מעשר שני אינם קדשים, ומה שהרמב"ם מביא כתוב באוני, הוא כידוע הכלל שמביא הדרשה הפשוטה יותר, ואז יש להתאים להמובא באחרונים אשר אונן ואבילות אין נפגשים יחד, שאבילות מתחילה לאחרי שעברה האנינות, ז.א. בקבורה, ועלה בדעתי לאמר, שלדעת גירסתנו בפירוש המשניות* - חלוק בזה מעשר שני שאיסורו מלא אכלתי באוני, משא"כ קדשים שאיסורם מאכלתי חטאת היום. ומה שלא מביא חילוק זה בפירוש ביד החזקה - הוא ע"פ כללי הרמב"ם, שלפעמים תכופות אינו כותב דינים חדשים, כיון שלא הובאו בפירוש בש"ס.
