I greet you and bless you,
For a long time, I have seen and observed your enthusiasm and your ardor in the study of the Torah* (note 2: See the beginning of the Dvar Melech on the Rambam*, volume 1, of which the Rav Raytport is the author, as well as the Likkutei Sichos*, volume 4, page 1346, notes 24 to 26, the laws of the Temple, of the Rambam* with the commentaries of the Rebbe*, published by Kehot editions, in 5750-1990, from page 53 and the Likkutei Sichos*, volume 11, at page 248). You devote days and nights to it and you intensify your study from time to time. Consequently, I learned with particular pleasure that you have written and organized your commentaries on the Torah*, so that they may be published, as we discussed. And, this work will appear shortly, with the help of Hashem. I have great hope that this will lead you to redouble your enthusiasm and ardor in the study of the revealed part of the Torah* and of its profound dimension, which, in our era, has been revealed through Chassidus*. May the fear of Hashem be your treasure and you will consult, on this subject, tractate Shabbos* 31a. Indeed, an Injunction of the Torah* is also a power that is granted to put it into practice.
Simultaneously, you disseminate the wellsprings (note 3: Of Chassidus*), you distribute moral Tzedakah* and Tzedakah*, in the literal sense, to one who possesses nothing, in order to vivify the soul of the poor. It is said that: "Tzedakah* elevates a nation," that it allows one to have "a brain and a heart a thousand times more refined." The Admur HaZaken* explains this precisely, at the beginning of his Torah Or*. May Hashem grant that this be in material and spiritual abundance. With my blessing, according to the traditional formulation, to receive the Torah* with joy and in a profound manner, as well as for success in all that has just been said,

N.B.: As a mark of appreciation, I will formulate here some remarks on your book:
Beginning of the introduction: It is said that the Beis HaMikdash* is the foundation (note 4: The Rebbe* underlines the words: "foundation," "make," "purpose," "itself," "solely," "entirety," "those," "sanctity," "action," "scope," "great," "the order," "feared," "subsequently," "constitutes proof," "according to their literal sense," "no further Mitzvah," "different," "eternal," "when there is no obligation," "subsequently," "consequence," "references," "the place" and "own." The notes below were written by the Rav Raytport) of the world, one of the seven elements that preceded it. You mean that from this place the Presence of Hashem, the Shechinah*, so called because it is said: "I will dwell (Shachanti) among them," spreads throughout the entire world, regarding the Sanctuary and this applies, in the same way, to the Beis HaMikdash*. This statement can be compared to the teaching of our Sages, in tractate Sanhedrin* 26b, according to which the Beis HaMikdash* is indeed defined as the foundation. The text also reports another opinion, giving a different interpretation of the verse. However, that opinion does not contest the quality of foundation that the Beis HaMikdash* possesses. This is, moreover, what the Sages say, in tractate Yoma* 54b and the Rambam*, in his commentary on the Mishnah*, at the same reference.
The Baraisa* affirming that seven elements preceded the world also mentions the Beis HaMikdash*, which allows one to establish its anteriority. However, this does not mean that it is the foundation of the world, including according to the literal sense. It is therefore the Torah* that allows this to be established.
At the same reference: The Beis HaMikdash* consists of sacrifices, of a holy Ark. You cite the controversy between the Rambam* and the Ramban*, on this subject. One can formulate several remarks on what is said in your book. You will deduce from what follows in what manner it is fitting, in my humble opinion, to understand the conceptions of the Rambam* and the Ramban* regarding the reason for which one builds the Beis HaMikdash* and regarding the Holy Ark. I have explained all of this at length elsewhere (note 5: See the Likkutei Sichos*, volume 11, at page 116, volume 7, at page 200 and in note 20, volume 16, from page 438, volume 26, at page 177):
A) The Rambam* writes, in his Sefer HaMitzvos*, at Injunction no. 20, that: "He commanded us to build a Beis HaMikdash* in order to serve Him, to offer sacrifices there, to go there, to ascend there during the festivals. It is regarding this that it is said: 'They shall make Me a Sanctuary.'" Indeed, the Rambam* formulates the same statement in his laws of the Beis HaMikdash* and in the Sefer HaMitzvos*, at the twelfth root. The Ramban*, however, holds a different opinion and writes: "The essential reason for the Beis HaMikdash* is the place of rest of the Shechinah*, that is to say the place of the Holy Ark," according to his commentary at the beginning of Parshas* Terumah*. One should also consult his commentary on the verse Eikev* 10, 5.
One could question the opinion of the Rambam*. Indeed, the verse he cites is: "They shall make Me a Sanctuary." Now, this verse specifies the purpose of its construction: "I will dwell among them" and different verses define the place of this "dwelling" and designate the Holy Ark. One will see what the Ramban* says on this subject. And, one finds proof thereof, or at least an allusion, in the words of the Rambam* himself (note 6: See the Likkutei Sichos*, volume 11, at page 137, in note 17, citing the opinion of the Rambam*, in his laws of the vessels of the Beis HaMikdash*, chapter 10, at paragraph 11, which explains the term Shechinah* used by tractate Yoma* 73a and shows that it indeed alludes to the Holy Ark. One should consult this text. See the Likkutei Sichos*, volume 28, at page 64 and in note 31, citing tractate Megillah* 21b, which says: "The western lamp corresponds to the Shechinah*." And, the Rambam*, in his laws of the Beis HaMikdash*, chapter 3, at paragraph 5, mentions the central lamp and specifies: "the one called the western lamp," for "it faces the Holy of Holies"), in his Guide for the Perplexed, volume 3, at chapter 45, which says: "He commanded us to build a Sanctuary for His Name, praised be He, to place therein a Holy Ark." One must necessarily conclude that, according to the Rambam* as well, the purpose of the Beis HaMikdash* is indeed the resting of the Shechinah*, which is realized essentially in the Holy Ark. The integrity of the sanctity of the Sanctuary therefore depends on the presence of the latter.
Consequently, the Beis HaMikdash*, during the period in which it did not possess the Holy Ark, was considered a great platform for sacrifices, according to the Tosefta*, at the end of chapter 13 of tractate Zevachim* and one should also see the Meiri*, on tractate Megillah* 9b. One cannot object that the Beis HaMikdash* retained its sanctity (note 7: This means that the Beis HaMikdash* retains the sanctity of a constructed building. On the other hand, the Rambam* says that: "one offers sacrifices there even if it is not constructed." He thus departs entirely from the notion of a constructed building, as the later Sages emphasize. One should consult the Haggadah* of Pesach* with a collection of explanations, customs and commentaries, edition of 5751, volume 2, page 681, in the note entitled: "Obligation." But this point will not be developed here) also after the Holy Ark was hidden (note 8: According to one opinion, the Holy Ark was hidden by Yoshiyahu, at the time of the first Beis HaMikdash*. According to another opinion, it was removed from the first Beis HaMikdash* at its destruction and taken to Bavel, from where it did not return. It was therefore absent from the second Beis HaMikdash*. One should consult, on this subject, the Likkutei Sichos*, volume 21, from page 156 and in the references indicated there) and even removed (note 9: It will be specified later that, when the Holy Ark is hidden within the Beis HaMikdash*, the latter derives an increased sanctity from it). Indeed, this was so because "the Shechinah* does not depart" (note 10: We have seen, indeed, that the Beis HaMikdash* retains its sanctity. Because the Shechinah* is present, one can offer sacrifices, even if the Beis HaMikdash* is not constructed. The same applies to the specific and additional revelation of the Divine Presence resulting from the presence of the Holy Ark, when it is in its place, as well as to the perfection of the sanctity of the Beis HaMikdash* that is obtained in this way. All of this does not disappear when the Holy Ark is hidden or even removed. One should see, on this subject, the commentary of the Rav Y. P. Perla which will be cited later), according to the expression of the Rambam*, at the end of chapter 6 of his laws of the Beis HaMikdash*. The Mishkan*, on the other hand, received from the outset a provisional character. It was a temporary dwelling, but not the rest and the inheritance (note 11: The sanctity of the Mishkan* is itself provisional, whereas that of the Beis HaMikdash* is immutable, as it is said: "This is My resting place forever." After its construction, the Divine Presence was no longer revealed in any other place. One should see, in particular, tractate Moed Katan* 9a, which says: "The Mishkan* did not have eternal sanctity. That of the Beis HaMikdash*, on the other hand, is immutable." One should consult on this subject, the Likkutei Sichos*, volume 11, at pages 177 and 182, volume 16, at page 305 and in note 52, volume 29, at page 73, volume 16, from page 466, volume 24, from page 79. These references also refer, in particular, to the commentary of the Rav Y. P. Perla on the Sefer HaMitzvos* of Rabbi Saadia Gaon, at Injunctions no. 84 and 85. Consequently, the sanctity introduced into the Beis HaMikdash* by the Holy Ark is eternal as well. The Mishkan*, on the other hand, possessed only the sanctity that the Holy Ark conferred upon it while it was there). Nevertheless, the Rambam* refers to the Mitzvah* enjoined upon the children of Yisrael* to make (note 4) a Beis HaMikdash*, whereas the Ramban* treats of the purpose (note 4) of the Sanctuary itself (note 4), which is: "I will dwell," which was realized essentially by the Holy Ark.
B) One knows the question that is raised by the fact that the Rambam* does not include the making of the Holy Ark in the count of the Mitzvos*, whereas he mentions, on the other hand, the obligation to carry it on the shoulder (note 12: According to the Sefer HaMitzvos*, Injunction no. 34 and the laws of the vessels of the Beis HaMikdash*, chapter 2, at paragraph 12). One finds a lengthy explanation on this subject by the Rav Y. P. Perla, at the end of his commentary on the Sefer HaMitzvos* of Rabbi Saadia Gaon, at Parashah* 52. Moreover, this Sefer HaMitzvos* specifies the reason it does not define as a Mitzvah* the making of the: "Menorah*, the table, the altar and the rest." Indeed, "these are parts of the Beis HaMikdash*, which encompasses all of them together." Now, it does not mention the Holy Ark at all. One could explain that this Ark is solely (note 4) the instrument of: "I will dwell among them" (note 13: See the continuation of this letter), that such is, moreover, the purpose of the entirety (note 4) of the Torah* and the Mitzvos*. Now, "there is no reason to count the Injunctions bearing on the entirety of the Torah*," according to the Sefer HaMitzvos*, at the fourth root, whose commentaries one should also consult. The Injunction to make the Holy Ark is therefore a "specific action" including within it "all the Mitzvos*." It has, consequently, a general scope, in the same way as the Precept: "You shall cease to be stiff-necked," which the Sefer HaMitzvos* cites at this reference. Indeed, the construction of the Beis HaMikdash* also presents other aspects, for example the sacrifices (note 14: It seems that this includes the celebration discussed at the beginning of the laws of the Beis HaMikdash* and in the Sefer HaMitzvos*, twelfth root and Injunction no. 20. See, on this subject, in particular, the Likkutei Sichos*, volume 12, at page 59, in note 16). It is those (note 4) that have been counted (note 15: As the text says, the Rambam* alludes to the Mitzvos* that the children of Yisrael* had to put into practice in the Beis HaMikdash*. It is these that he integrates into the count of the Mitzvos*. See the Likkutei Sichos*, volume 11, at page 124, emphasizing that the offering of sacrifices and the other acts of service, in the Beis HaMikdash*, are indeed linked to the revelation of the Shechinah*. One should consult this text) among the six hundred thirteen Mitzvos*, which is not the case for the Holy Ark. The introduction of the Tablets of the Law (note 16: This is not the same, on the other hand, according to the commentary of the Minchas Chinuch*, at Mitzvah* no. 95, which says: "The Holy Ark is made essentially in order to place therein the Tablets of the Law, as Parshas* Terumah* specifies, at verse 25, 16: 'And you shall place upon the Ark the Testimony.' Likewise, the verse Melachim* 1, 8, 9 says: 'There is nothing in the Ark but the two Tablets of the Testimony.' In the first Beis HaMikdash*, the Holy Ark was stored, with the Testimony, at the time of King Yoshiyahu. A second one was not made and, in the second Beis HaMikdash*, there was therefore none. Indeed, what purpose would it have served since the Tablets of the Law had been hidden? Furthermore, there was no Mitzvah* to make an Ark and its presence was not a sine qua non condition. Certainly, this is indeed one of the aspects of the Mitzvah*, but several of these aspects are not indispensable, a posteriori. The Kineas Sofrim* on the Sefer HaMitzvos*, at the tenth root and in Injunction no. 33, interprets the opinion of the Rambam* in this way. One should also see the Likkutei Sichos*, volume 26, at page 177, the commentary of the Rav Y. P. Perla, at this reference, at page 199b-c and the Talmudic Encyclopedia, at the end of the article: "Holy Ark") into the Holy Ark (note 17: According, in particular, to the Minchas Chinuch* and the Kineas Sofrim*, previously cited, the Holy Ark is made for the Tablets of the Law that are placed therein, even though this Ark must be in the Holy of Holies. This is not the case, on the other hand, according to the interpretation given here. On the contrary, the Tablets of the Law are placed in the Holy Ark not for their own sake, but indeed for the sanctity of this Ark. Thus, the Ark is made solely in order to be the receptacle of the revelation of the Shechinah* and the fact that the Tablets of the Law are placed therein is only another aspect characterizing it. One must therefore indeed accept this interpretation for, if one defines the Ark as not only the instrument of the divine revelation, but also the place of the Tablets of the Law, as such, it would have been necessary to include it in the count of the Mitzvos* as being a "specific action," just as the building of the Beis HaMikdash* is part of these Mitzvos*, because one offers sacrifices there, for example, as was said, in the same way that there is an Injunction to carry the Ark on the shoulder or an Interdiction according to which: "One shall not remove the poles"), according to this interpretation, is therefore only a specific detail of this Ark and of its sanctity, which does not persist in every generation. Despite this, the Rambam* counts an Injunction to carry it on the shoulder and an Interdiction according to which: "one shall not remove the poles" (note 18: Sefer HaMitzvos*, Interdiction no. 86 and laws of the vessels of the Beis HaMikdash*, chapter 2, at paragraph 13). According to him, indeed, the sanctity (note 4) of the Holy Ark does not depend on this, since its purpose is: "I will dwell among them." There is only an Injunction that is specifically made to the Kohanim* (note 4), who must carry it on the shoulder (note 19: This is the opinion of the Rambam*. The Ramban*, on the other hand, considers that this obligation falls upon the Leviim*. See, in particular, the Likkutei Sichos*, volume 21, at page 160 and in note 35, volume 18, at page 194 and in note 71, volume 19, at page 316, volume 28, from page 49).
It is however difficult to accept this way of reading the commentary of the Rambam* (note 20: According to this explanation, even if there is an Injunction to perform a "specific action" that we cannot determine through the other Mitzvos*, whose general scope encompasses the entire Torah* and all the Mitzvos* together, this does not for all that form part of the count of the Mitzvos*. It is therefore said here that this conclusion is difficult to accept. Indeed, what does this general scope matter? There is an action for which we received an Injunction and we do not deduce it from the other Mitzvos*. One does not count an Injunction of general scope because: "Hashem did not ask us to do what we already know" through the other Mitzvos*. Therefore, when the action is "specific," as is the case here, even if it has a general scope, it must indeed appear in the count of the Mitzvos*. What is said here, according to the fourth root, allows one to understand that this is not the case, but this remains nonetheless difficult to accept. However, this point will not be developed here and one should consult, on this subject, the Likkutei Sichos*, volume 4, at page 1131, at pages 1144 and 1145, as well as in note 5) for, ultimately, if there is an Injunction to perform a "specific action" (note 4), in this case to make the Holy Ark, why not include it in the count of the Mitzvos*? And what does it matter that it has a general scope (note 4) (note 4), since there is indeed an Injunction regarding this "specific action"? Thus, the Rambam* defines an Injunction to have faith in Hashem (note 21: Sefer HaMitzvos*, Injunction no. 1 and the beginning of the laws of the foundations of the Torah*), which has an even more general scope and how much more so should the one that is the subject of our discussion therefore be a Mitzvah*. On this subject, one should consult the Sefer HaMitzvos* of the Tzemach Tzedek*, at the beginning of the Mitzvah* of faith in Hashem. In any case, it follows from this analysis that one must propose another reading of the opinion of the Rambam*. And, it is fitting, beforehand, to pose great (note 4) questions:
A) Why does the Rambam* omit the laws relating to the making of the Holy Ark (note 22: See the Likkutei Sichos*, volume 11, page 118, at note 24)?
B) How did Yoshiyahu permit himself to remove the Holy Ark from the place where the children of Yisrael* had received the order (note 4) to place it (note 23: According to the verse Terumah* 26, 33), in order to hide it? And, the Talmud*, in tractate Yoma* 52b, specifies that he received no Injunction to do so, but that he feared (note 4) that it would be taken to Bavel subsequently (note 4).
To answer all of this, one can, first of all, observe that the episode of Yoshiyahu constitutes proof (note 4) that the verses (note 24: This does not mean that one deduces a new Law from the behavior of Yoshiyahu. It is solely the revelation of what had already been established beforehand, as indicated by tractate Bava Kamma* 2b. Thus, the verses relating to the making of the Holy Ark are indeed to be interpreted in the literal sense) must be interpreted (note 25: These are the verse Terumah* 25, 10 and the following verses: "They shall make an ark of shittim wood... and you shall place in the ark the Tablets that I will give you... and in the ark you shall put the testimony that I will give you, I will make Myself known to you from there") according to their literal sense (note 4). Thus, the making of the Holy Ark and its introduction into the Holy of Holies had no other purpose than to fulfill the terms of the verse: "I will make Myself known to you there." When this was established and this revelation became definitive, there was no longer, subsequently, a Mitzvah* (note 4) to make a holy ark. As long as it exists, and after it will be revealed, in the World to Come (note 26: See the remarks of the Ramban* on the Sefer HaMitzvos*, in particular at the third root and at Injunction no. 33), it will only be necessary to carry it on the shoulder and not to remove the poles. Consequently, the making of the Holy Ark is not a Mitzvah* for all generations (note 27: As the Sefer HaMitzvos* explains, at the third root, which establishes that a Mitzvah* not practiced in all generations cannot form part of the count of the Mitzvos*) and the laws of this making are not reported, for "what is past is past" (note 28: See tractate Yoma* 5b. The answer given there, concerning the meaning of the verses, does not concern the Yad HaChazakah*, which is only a compilation of Halachos*, as this book and various other works establish repeatedly). Thus, since the building of the first Beis HaMikdash*, there is no longer an Injunction in this matter. This also explains why, during the wars against the Pelishtim* (note 29: Indeed, they could have been concerned, fearing that the Pelishtim* would capture it. And, moreover, this is indeed what happened, as the verse Shmuel* 1, 4 and the following verses relate), for example, the Holy Ark was not hidden until the end of the battles, as Yoshiyahu did. One can, indeed, understand this in light of what has just been said for, in the Mishkan* of Shiloh*, if the Ark had been removed from its place (note 30: See the Likkutei Sichos*, volume 9, at page 198, in note 17, which says: "The verse Hoshea* 24, 26 specifies that the Holy Ark was taken to Shechem* and one should consult, on this subject, the commentary of the Radak* on verse 24, 1. This seems to mean that the transport of the Ark to that place, on the occasion of this episode, had an exceptional character." And, one can truly question the commentary of the Tiferes Yisrael*, on this subject, at paragraph 38, which considers that the Ark was brought there from the outset. How would the Yom Kippur* service therefore have been possible? Another point, which is essential, it is surprising to affirm that, for decades, the entire Mishkan*, with all its vessels, was in one place, while the Holy Ark was in another! Indeed, I have observed that the Tiferes Yaakov* also questions this explanation of the Tiferes Yisrael*, but, in any case, this point will not be developed here), one would have annulled the fulfillment of the verse: "I will make Myself known to you there." By removing it, the Mishkan* became a great platform intended to receive the sacrifices, as was said. Indeed, it was only the provisional dwelling of the Divine Presence. Nevertheless, in a situation of force majeure, for example during the death of the men of Beis Shemesh*, as the verse Shmuel* 1, 6, 19 relates (note 31: And the following verses: "He struck the men of Beis Shemesh*, who had looked at the Ark of Hashem. He struck seventy men and fifty thousand men of the people. And the men of Beis Shemesh* exclaimed: Who can stand before Hashem, this holy Elokim*? They sent emissaries to the inhabitants of Kiryas Yearim* to tell them: the Pelishtim* have returned the Ark of Hashem. Come down and bring it up to you. The men of Kiryas Yearim* came and brought up the Ark of Hashem. And, it was from the day that the Ark resided at Kiryas Yearim*, many days passed and twenty years elapsed." One should also see, in particular, tractate Sotah* 35a and the following pages), or when Uzza died, according to the verse Shmuel* 2, 6, 7, it was permitted not to return the Holy Ark to the Mishkan*.
In light of what has just been said, one can establish that the episode of Yoshiyahu is strong proof supporting the conception of the Rambam*, according to which there is no Mitzvah*, from the building of the Beis HaMikdash* onward, to make a Holy Ark. In my humble opinion, all of this is quite clear and evident. Despite this, Yoshiyahu hid the Ark precisely in the Beis HaMikdash* and not in another place. Indeed, even though "the Divine Presence does not depart," Its revelation can receive different (note 4) forms, within the Beis HaMikdash*, as tractate Yoma* 21b observes. There was therefore an eternal (note 4) Injunction according to which the revelation of the Beis HaMikdash* would always remain identical to that which had been obtained when the Ark had received its definitive residence therein. And, if the children of Yisrael* have the merit, they can even receive a revelation that is even higher, since the Ark is still in the Beis HaMikdash*, although it is hidden there. But, the highest revelation is possible only when it is in its place, in the Holy of Holies.
However, one can still formulate the following question. According to an opinion stated by the Yerushalmi*, in tractate Yoma*, chapter 5, at paragraph 4, the sprinkling performed on the cover of the Ark must reach the Ark itself. How, then, did Yoshiyahu permit himself to hide the Ark, which had the consequence that the sprinkling could not reach it, whereas this is necessary, at least a priori? One can advance, on this subject, the following explanations:
A) The fear that the Ark would be exiled to Bavel is sufficiently strong to justify hiding it, including a priori, when there is no obligation (note 4) that it be in the Holy of Holies, even if, subsequently (note 4), this will have the consequence (note 4) that, on Yom Kippur*, the sprinkling will not be able to touch it. And, one can state several illustrations of this principle (note 32: See the Likkutei Sichos*, volume 8, page 63, in note 12, which says: "One knows the discussion on the necessity of preparing what will enable one to fulfill the Mitzvah*, before the time of this fulfillment. And, one should consult, on this subject, the Shulchan Aruch* of the Admur HaZaken*, chapter 248, at paragraph 13. Thus, according to one opinion, it is permitted to undertake a voyage within a caravan that departs three days before Shabbos*, including when one has certainty that one will be led, subsequently, to transgress Shabbos* as a result. And, the reason is given at the same reference, at paragraph 5. The first three days of the week are therefore not at all linked to the following Shabbos*. According to a second opinion, such a voyage is forbidden and all agree to proscribe it also during the three days that precede Shabbos*. Nevertheless, such a prohibition is only of rabbinical order. One should consult the Sdei Chemed*, collection of laws, at the article 'Yom Kippur*,' chapter 1, at paragraph 10, which asks whether it is permitted and necessary to fast on Tzom Gedaliah*, when one knows that this will have the consequence of an impossibility to do so subsequently, on Yom Kippur*. The text concludes that such a fast is permitted, including according to the second opinion previously cited. And, one should consult, on this subject, the Likkutei Sichos*, volume 3, at page 1000, in note 22), including in cases where a clear prohibition or obligation is issued. One should see, on this subject, the Sdei Chemed*, collection of laws, at the article "Yom Kippur*," chapter 1, at paragraph 10 and the references (note 4) of the Talmud* that it indicates, as well as those of the early Sages.
B) The one who holds the opinion that the sprinkling must reach the Ark itself will adopt the opinion that considers that Yoshiyahu did not hide it, but that it was indeed taken to Bavel. The Rambam*, however, does not hold this opinion and considers that it was indeed hidden.

It is reproduced here in order to complete the subject being treated), one can conclude that no specific act of the service of Hashem performed in the Beis HaMikdash* was linked to the Ark, as was the case for all the other vessels of the Sanctuary. This Ark was solely the receptacle of the Divine Revelation. And, this leads one to question the sprinkling that was done between the poles of the Ark (note 34: This seems indeed to designate the sprinkling on the cover of the Ark, according to the Mishnah* of tractate Zevachim* 47a. And, one should note that the sprinklings between the poles of the Ark, on the cover and on the golden altar, are all necessary, such that the absence of one disqualifies the others, according to tractate Menachos* 27a and the Rambam*, in his laws of improper sacrifices, chapter 2, at paragraph 3). On this subject, a preliminary question must be formulated: what was done during all the years in which the Mishkan* remained at Nov* and Givon* (note 35: Gilgal* is not mentioned here, although the Holy Ark was not there in a fixed manner, because the most common expression is used, the one found repeatedly in the Gemara* and in the writings of the early Sages. Furthermore, one cannot question the manner of practice adopted at Gilgal*, since Yehoshua* acted then according to the Word of Hashem, as the Tosafos* on tractate Eruvin* 63b emphasize. At the beginning, at page 23: Concerning the gardens of Yerushalayim*, its wall and its sanctity, one should consult the Tzafnas Paaneiach*, of the Gaon of Ragatchov*, on tractate Makkos* 18a and at page 19, which establishes a comparison with the words of the Rambam*, basing itself on the principle according to which certain acts must be performed inside and others are disqualified if they are practiced outside. At the same reference, at page 51: During Shabbos*, it is forbidden both to perform an action and for the action to be performed. פתיחה. בתחלתה. דביהמ"ק יסוד העולם, שהרי הוא מז' דברים שקדמו לעולם.
וכוונתו שמשם תתפשט השכינה (דנק' כן ע"ש ושכנתי בתוכם - הנאמר בעשיית המשכן דאיקרי מקדש) בכל העולם.
ויש לייסד זה במחז"ל כי השתות - אילו ביהמ"ק (סנה' כו, ב). ואפילו למאן דפליג שם בפי' הכתוב, לא פליג בגוף הדבר שביהמ"ק הוא שתי' ויסוד העולם, שהם דברי חכמים (יומא נד, ב. וכהרמב"ם בפיה"מ שם).
מהברייתא דז' דברים נבראו קודם שנברא העולם כו' ביהמ"ק - ראיה על הקדימה, אבל לא שהוא יסודו של עולם ויסוד גם כפשוטו. ותורה ותשובה וכו' יוכיחו.
שם. ביהמ"ק ענינו קרבנות וארון כו' מחלוקת הרמב"ם והרמב"ן כו'. עיי"ש.
יש להעיר כמה במש"כ בספרו ומובן מהבא לקמן מה שנלפענ"ד בביאור שיטת הרמב"ם והרמב"ן: א) בתכלית בנין ביהב"ח. ב) בענין הארון - (והארכתי בכ"ז במק"א):
א) כתב הרמב"ם בסהמ"צ (מ"ע מצוה כ) ציוונו לבנות ביהב"ח לעבודה בו יהי' ההקרבה כו' ואליו תהי' ההליכה ועלי' לרגל כו' והוא אמרו ית' ועשו לי מקדש. ועד"ז הוא ברמב"ם ריש הל' ביהב"ח ובסהמ"צ שורש יב. לא כן דעת הרמב"ן שכתב: עיקר החפץ במשכן הוא מקום מנוחת השכינה שהוא הארון (ר"פ תרומה. וראה ג"כ רמב"ן עקב י, ה).
ולכאורה יוקשה בדעת הרמב"ם, שהרי כתוב זה עצמו שמביאו "ועשו לי
מקדש" - מבאר כוונת העשי' "ושכנתי בתוכם", ומקום "ושכנתי" זה - ג"כ מפורש בכ"מ בקרא שהוא הארון (עיי"ש ברמב"ן). וראי' (ועכ"פ - זכר) לדבר גם מדברי הרמב"ם עצמו (מו"נ ח"ג פמ"ה) וז"ל: וצוונו אנחנו שנבנה היכל לשמו יתעלה ונשים בו הארון שיש בו כו'.
ועכצ"ל שגם לדעת הרמב"ם החפץ במקדש הוא מנוחת השכינה, ובעיקרה הוא על הארון, ובמילא מובן שבו תלוי' גם שלימות קדושת המשכן.
- ולכן המשכן בזמן שלא הי' בו הארון, הי' לו דין במה גדולה (תוספתא זבחים ספי"ג.
וראה ג"כ מאירי מגילה ט, ב). ואין להקשות מהא דביהמ"ק בקדושתו גם לאחר שנגנז (ואפילו לאחר שניטל) הארון - כי הוא לפי ש"שכינה אינה בטילה" (רמב"ם הל' ביהב"ח ספ"ו); משא"כ המשכן שהי' מלכתחילה רק "לפי שעה", דירת עראי ולא מנוחה ונחלה. -
אלא שהרמב"ם מדבר בענין המצות שנצטוו בנ"י לעשות בביהב"ח, והרמב"ן מדבר בענין וחפץ אשר במשכן עצמו , שהוא "ושכנתי" וזה הי' בעיקר - ע"י הארון.
ב) ידועה הקושיא על שלא מנה הרמב"ם עשיית הארון במנין המצות (ובפרט - שמנה מצות משאו בכתף. ושקו"ט בכ"ז בארוכה בפי' רי"פ פערלא לסהמ"צ לרס"ג בסופו פרשה נב). ולא עוד אלא שבסהמ"צ שם כשמבאר הטעם שאינו מונה את עשיית "המנורה והשלחן והמזבח וזולתם" כי "כלם מחלקי המקדש והכל יקרא מקדש", אינו מזכיר כלל את הארון. - ולכאורה יש לתרץ - כי הארון ענינו רק כלי שיהי' "ושכנתי בתוכם", וזהו כללות ענין כל התומ"צ, "ואין ראוי למנות הציווים הכוללים התורה כולה" (סהמ"צ שרש ד'.
וראה נ"כ שם). והציווי לעשות הארון אף שהוא "מעשה מיוחד", הרי ענינו - כולל עניני "התורה כולה" ו"המצות כולם" ולכן נחשב כציווי כולל, וע"ד וערפכם לא תקשו עוד - שמביא בסהמ"צ שם. - ובכ"ז נמנה בנין ביהב"ח אף שענינו "ושכנתי בתוכם", כי בענין ביהב"ח ישנם עוד ענינים: ההקרבה וכו', והם הם שנמנו בתרי"ג המצות - משא"כ בארון. (נתינת הלוחות בארון - לפי' זה - אינה אלא פרט מעניני (קדושת) הארון או - שאינה לדורות). - ובכ"ז מונה הרמב"ם מ"ע דמשא בכתף ומל"ת דלא יסורו, כי - לדיעה זו - אין תלוי' בזה קדושת הארון וענינו ד"ושכנתי בתוכם", כ"א ציווי מיוחד הוא לכהנים שישאוהו בכתף וכו'.
אבל פי' זה בשיטת הרמב"ם דוחק הוא, דסו"ס כיון שיש ציווי על מעשה מיוחד", עשיית הארון - למה לא יכנס במנין המצות? ומה בכך שענינו כולל, כיון שנוסף ציווי "מעשה מיוחד". ולא עוד אלא שכש"כ הוא ממ"ע דאמונת ה' דמונה הרמב"ם אף שענינה כולל עוד יותר (ולהעיר מסהמ"צ להצ"צ ריש מצות האמנת אלקות).
ולכן צ"ל פי' שיטת הרמב"ם באופן אחר, ובהקדם התמי' גדולות : א) למה השמיט הרמב"ם כל דיני עשיית הארון? ב) איך זה נטל יאשיהו הארון ממקומו שנצטוו בנ"י לשומו שם וגנזו? ובש"ס (יומא נב, ב) מוכח שלא הי' זה ע"פ הציווי וכיו"ב, כ"א שדאג שמא יגלה לבבל לאחרי זמן?
ולתרץ כל הנ"ל י"ל - דמעשה יאשיהו מוכיח דקראי כפשוטם , דעשיית הארון והבאתו לקדה"ק הוא אך ורק כדי שיהי' "ונועדתי לך שם". ולאחרי שנעשה זה ובאופן ד"אינה בטילה" לעולם - שוב לא מצינו מצוה בעשיית הארון. אלא שכל זמן שישנו (ולאחרי שיתגלה לעת"ל) - נצטוו לשאתו בכתף ושלא יסירו הבדים. - ולכן לא נמנית עשיית הארון במצות (לדורות) ולא הובאו דיני עשייתו, כי מאי דהוי הוי, ומזמן בנין ביהמ"ק הא' - אין כל ציווי בזה. ובזה מתורץ ג"כ הא דבמלחמות פלשתים וכיו"ב לא גנזו את הארון עד עבור המלחמה (וע"ד שעשה יאשיהו) - וע"פ הנ"ל מובן, כי במשכן שילה וכו' - נטילת הארון ממקומו היתה מבטלת ה"ונועדתי לך שם", שהרי בנטילתו הי' למשכן רק קדושת במה גדולה וכנ"ל, (והטעם - מפני שהיתה רק דירת עראי)
- ורק שבמקום פקו"נ (מיתת אנשי בית שמש - ש"א ו, יט - ומיתת עוזה - ש"ב ו, ז) הותר שלא להחזיר הארון למשכן -
וע"פ הנ"ל, מעשה יאשיהו - ראי' חזקה לשיטת הרמב"ם דאין מ"ע כלל (משנבנה ביהמ"ק) לעשות ארון. - ולפע"ד כ"ז ברור וגם פשוט.
אלא שמ"מ גנז יאשיהו את הארון בביהמ"ק דוקא ולא במקום אחר, כי אף ש"שכינה אינה בטילה", מ"מ כמה דרגות בהשראת השכינה שבבית המקדש, כמפורש ביומא כא, ב.
ונצטוו במ"ע נצחית - שבביהמ"ק תהי' אותה דרגת ההשראה שבאה ע"י שהכניסו לשם הארון באופן דדירת קבע. ובעת שישראל זוכין יש דרגא נעלית מזו: כשהארון נמצא (עכ"פ גנוז) שביהמ"ק, יותר מזה - כשנמצא במקומו (בקדה"ק וכו').
אלא שעדיין יש להבין: לדעת המ"ד (ירוש' יומא פ"ה ה"ד) דהזי' על הכפורת צריך שיגע - איך זה גנז יאשיהו את הארון, שהרי (עכ"פ לכתחילה) צריך שיגע. - וי"ל: א) דהדאגה שיגלה לבבל מספיק כוחה לגנוז הארון בזמן שאין כל חיוב (אפילו לכתחילה) שיהי' בקה"ק, אף שלאח"ז בדרך ממילא לא תוכל להיות הנגיעה ביוהכ"פ (וכמה דוגמאות לזה, ואפילו בחיוב ואיסור ברור. וראה בזה שדי חמד אס"ד מע' יוהכ"פ ס"א סק"י. וש"נ לש"ס, ראשונים וכו'). ב) מ"ד דצריך שיגע - יסבור כמ"ד דלא גנזו יאשיהו (אלא שניטל הארון לבבל). [ודלא כפסק הרמב"ם - דנגנז].

עפ"י הנ"ל לא הי' בארון שום עבודה (כמו בשאר כלי המשכן); וענינו הוא כלי להגילוי שלמעלה.
וצע"ק מענין ההזי' על בין הבדים וכו'. וי"ל בהקדם התמי' איך הי' בזה כל אותן השנים שהי' המשכן בנוב וגבעון והארון בקרית יערים ועיר ציון. וע"כ צ"ל שהעיקר בזה מקום (בדי) הארון שבקדה"ק. אבל קשה למ"ד דהזי' על הכפורת צריך שיגע בכפורת (ירושלמי שם). ועכצ"ל דגם לדידי' אינו מעכב כלל ונוב וגבעון יוכיחו. ועצ"ע.

בתחלתו. ע' כג. גגי ירושלים וחומתה וקדושתן וכו'. עיין צפנת פענח - להגאון הרגצובי - למכות (יח, א) ודף יט שמשווה דברי הרמב"ם וכו' - ע"פ ההנחה דיש דבר הצריך פנים ויש דבר שפסול בחוץ והנ"ל וכו' לא הוי חוץ וגם פנים לא הוי. - שוב ראיתי שנגע בזה בספרו (ע' כו).
שם ע' נא. דחיובי שבת הוא שלא יפעול הפעולה ולא שלא תיעשה הפעולה, ולדוגמא בכתיבה וכו'. - אין לומר כן בכל חיובי שבת, כדמוכח בכ"מ ובפרט בנוגע לכתיבה - מחיוב נטלו לגגו דחי"ת ועשאו ב' זייני"ן (שבת קד, סע"ב). ואף דפרש"י שם והספר לכך צריך - אין הטעם משום משלים וכו' (כי זהו פי' רבא שם), אלא דחשיב כותב ב' אותיות (ואף שלכאורה ראי' להיפך מהא דכתיבה בשמאל פטור - י"ל הטעם שא"א שתהי' כתיבה ביד כהה (ועיין צ"צ לשבת פי"ב מ"ה (נ, ג)) - כזו שביד ימין שלו ). ולהעיר גם מהוציא חצי גרוגרת ואח"כ עוד חצי גרוגרת שאם קדם והגבי' ראשונה פטור (שבת פ, א).
וצע"ק ממה שצ"ל כדרך המוציאין דוקא (שבת צב, א) וי"ל שא"ל לא מקרי הוצאה.
ולהעיר מתוד"ה בהעלם (ב"ב נה, סע"ב). ואכ"מ.

נתינת הלוחות.. פרט מעניני.. הארון: שלדעת המנ"ח והקנאת סופרים ועוד (כנ"ל בציון הקודם) תכלית עשיית הארון הוא לשם הלוחות - נתינת הלוחות בתוכו (אלא שמקומו של הארון הוא בקודש הקדשים), משא"כ לפירוש המבואר כאן, הוא להיפך, שהלוחות ניתנו בארון לא לצורך הלוחות, אלא לשם קדושת הארון, והענין בעשיית הארון הוא אך ורק להיות כלי להשראת השכינה, ונתינת הלוחות בו אינו אפילו ענין נוסף בעשיית הארון. - וההכרח בזה הוא, שאם נאמר שבנוסף לזה שהארון הוא כלי להשראת השכינה יש בו גם הענין של נתינת הלוחות (בתור ענין בפני עצמו) - הי' צריך למנותו במנין המצות מחמת ה"מעשה המיוחד" הזה, בדוגמת בנין ביהב"ח שנמנה במנין המצות מחמת הענינים דהקרבה וכו', כנ"ל, ובדוגמת המ"ע דמשא בכתף ומל"ת דלא יסורו דלקמן בפנים.
ומל"ת דלא יסורו: סהמ"צ מל"ת פו. הל' כלי המקדש פ"ב הי"ג.
ציווי.. לכהנים: כ"ה דעת הרמב"ם (ולהרמב"ן הציווי הוא על הלויים) - ראה לקו"ש חכ"א ע' 160 הערה 35. חי"ח ע' 194 הערה 71. חי"ט ע' 316. חכ"ח ע' 49 ואילך. וש"נ.
אבל פי' זה.. דוחק הוא: לפי' הא' הנ"ל, אפילו אם יש ציווי על "מעשה מיוחד", שאין אנו יודעים עליו משאר המצות, אלא שענין הציווי כולל את התורה והמצות כולן - אינה נמנה במנין המצות. וע"ז כתב כאן שהוא דוחק. כי מה בכך שענינו כולל, אבל המעשה שעליו נצטוינו אין אנו יודעים אותו משאר המצות. והרי הטעם שאין ציווי כולל נמנה הוא מפני "כי לא צוה לעשות זולת מה שידענו" כבר משאר המצות. וא"כ כשהמעשה הוא מיוחד, כבנדו"ד, אף שענינו כולל, יש למנותו במנין המצות (ולפי' הא' שג"ז כולל בשורש הד' - יש לתרץ זה אבל בדוחק. ואכ"מ). - וראה לקו"ש ח"ד ע' 1131. ע' 45 - 1144 הערה 5.

ממקומו שנצטוו כו': תרומה כו, לג.
מוכיח דקראי כפשוטם: היינו, שאי"ז שלומדים דין חדש ממעשה יאשיהו, אלא גילוי מילתא בעלמא הוא (ראה ב"ק ב, ב) שהפירוש בהכתובים שבהם הציווי על עשיית הארון, הוא כפשוטם.
דקראי: בתרומה כה, י ואילך: ועשו ארון עצי שטים וגו' ונתת אל הארון את הלוחות אשר אתן אליך.. ואל הארון תתן את העדות אשר אתן אליך, ונועדתי לך שם גו'.
ולאחרי שיתגלה לעת"ל: ראה רמב"ן בהשגותיו לסהמ"צ שורש ג, מ"ע לג, ועוד.
ולכן לא נמנית.. במצוה (לדורות): כמבואר בסהמ"צ שורש ג, שמצוה שאינה נוהגת לדורות אינה נמנית במנין המצות.
לא הובאו.. מאי דהוי הוי: ראה יומא ה, ב (והתירוץ שם "למיסבר קראי" - אינו שייך לס' היד שענינו רק "הלכות הלכות", כידוע וכמבואר כמ"פ בספר זה ובכ"מ).
דבמלחמות פלשתים כו': והרי גם בזה הי' מקום לדאגה שמא ישבוהו פלשתים, וכמו שהי' בפועל - ראה שמואל א ד (ואילך).
נטילת הארון ממקומו כו': וראה לקו"ש ח"ט ע' 198 הערה 17, וז"ל: וביהושע (כד, כו) שהביאו הארון לשכם (וכ"פ ברד"ק שם כד, א). אבל לכאורה פי' שבאותו מאורע הובא (ע"פ הוראת שעה) הארון לשכם ולא דמלכתילה הובא לשכם (וצע"ג פי' התפא"י שם סקל"ח דמלכתחילה הובא - דאיך יפרנס העבודה ביוהכ"פ וכו'. ועוד ועיקר התמי' לומר דבמשך עשיריות בשנים הי' כל המשכן וכליו במקום אחד והארון במק"א! - שוב ראיתי בתפארת יעקב שם העיר בדברי התפא"י) ואכ"מ.
ש"א ו, יט: (ואילך) ויך באנשי בית שמש כי ראו בארון ה' ויך בעם שבעים איש חמשים אלף איש.. ויאמרו אנשי בית שמש מי יוכל לעמוד לפני ה' האלקים הקדוש הזה.. וישלחו מלאכים אל יושבי קרית יערים לאמר השיבו פלשתים את ארון ה' רדו העלו אותו אליכם.
ויבאו אנשי קרית יערים ויעלו את ארון ה'.. ויהי מיום שבת הארון בקרית יערים וירבו הימים ויהיו עשרים שנה גו'. - וראה סוטה לה, סע"א ואילך. ועוד.
וכמה דוגמאות לזה: ראה לקו"ש ח"ח ע' 63 הערה 12*, וז"ל: ידועה השו"ט בגדרי החיוב להכין מכשירי מצוה וכיו"ב, לפני זמן חיוב קיום המצוה - ראה שו"ע אדה"ז או"ח סרמ"ח סי"ג, שלפי דעה א' מותר לצאת בשיירא קודם ג' ימים לפני השבת, גם כשיודע בבירור גמור שבודאי יצטרך לחלל שבת אח"כ (והטעם: כי ג' ימים הראשונים שבשבוע אינם מתייחסים לשבת הבא - שם סעיף ה'); וגם לפי דעה השני' שם שיש איסור בזה (וכן האיסור בג' ימים שלפני השבת - לד"ה), האיסור הוא רק מד"ס. וראה שד"ח אס"ד מע' יו"כ סי' א' סק"י - שקו"ט אם מותר (וצריך) להתענות בצום גדלי', באם א"א יהי' לו עי"ז להתענות ביו"כ שלאחריו. ושם (ד"ה אמנם נראה), שגם לדעה השני' הנ"ל מותר להתענות.

ההזי' על בין הבדים וכו': לכאורה הכוונה ב"וכו'" הוא לההזיות שעל הפרוכת (משנה זבחים מז, א) - ולהעיר שההזיות על בין הבדים ועל הפרוכת ועל מזבח הזהב מעכבות זו את זו (מנחות כז, א. רמב"ם הל' פסוהמ"ק פ"ב ה"ג).
בנוב וגבעון.. ונוב וגבעון יוכיחו: הא דלא נקט ג"כ גלגל, שגם שם לא הי' הארון קבוע, י"ל: א) שיגרא דלישנא נקט, שכ"ה בכ"מ בגמרא וראשונים. ב) אין להקשות איך הי' בגלגל, כי אז עשה יהושע עפ"י הדיבור (תוס' עירובין סג, ב ד"ה ע"ש). ג) ועיקר: אם כי בגלגל לא הי' הארון קבוע (כלשון המאירי הנ"ל) מפני שהי' יוצא אתם למלחמה אבל יתכן (ומסתבר לכאו') שבין מלחמה למלחמה החזירוהו לאהל מועד (חוץ מבהוראת שעה - ראה המובא לעיל בפיענוח "נטילת הארון ממקומו כו'"). וא"כ - ביוה"כ הי' הארון במקומו.
שהעיקר בזה מקום (בדי) הארון: היינו שאין הארון סיבה להזאות שבין הבדין שלו, אלא רק סימן בלבד על המקום שבו צריך להזות. ונמצא שאין שום עבודה בהארון כלל.
ועצ"ע: אולי - מפני שזה שבנוב וגבעון לא הוחזר הארון למשכן - הי' מטעם פיקו"נ, כנ"ל.
