accomplishments, the Rav N. M. (note 1: Rav N. M. Perlov, Rabbi of Novominsk) Shlita*,

I greet you and bless you,

I have duly received your letter of the 25th of Teves*, which has just reached me (note 2: See the Likkutei Sichos*, volume 32, at page 244), in which you allude to a person desirous of adopting a child (note 3: See, on this subject, letter no. 8700). In this matter, I am surprised not to have found, to this day, anyone who concerns himself with what will be set forth below. Numerous and detailed responsa have been published on various aspects of adoption. On the other hand, no one poses this question, which is the most fundamental.

I have had doubts because adoption, in our day, is no longer what it was in previous generations, when one put into practice the Mitzvah* of raising an orphan in one's home. At the time, everyone, including the adopted child, knew that the couple was not the parents. At the present time, however, the opposite (note 4: The Rebbe* underlines the word: "opposite") is true. One does everything possible to hide this fact. Moreover, under the pressure of doctors who consider themselves specialists of the psyche, one decides that it is forbidden to reveal to the child who he truly is, that the tranquility of his mind could be called into question. It follows that one behaves toward the adopted child as if he were a true child. Consequently, one is alone with him, one kisses him, one embraces him every day. It is even impossible not to do so, including when the adoptive parents are animated by a sincere fear of Hashem.

Even if one reveals to the child, when he grows up, that these are not his real parents, one can truly wonder whether one will then succeed in abandoning a behavior that one has adopted for several years already. Now, in this case, there is certainly here, in a definite manner, a prohibition of our Sages and even, according to the Rambam* (note 5: In his laws of forbidden relations, chapter 22, at paragraph 2. See the Otzar HaPoskim*, volume 9, laws of marriage, at the beginning of chapter 22), a prohibition of the Torah*! Moreover, even if one admits that it is only a rabbinic enactment, in this case, such a situation remains particular since the transgression is ceaselessly repeated. To this is added what is cited and explained in the revealed part of the Torah*. You will also consult Iggeres HaTeshuvah*, of the Admur HaZaken*, at chapter 7.

What has just been said allows one to truly question the very principle of adoption, which can be permitted only so that those who have recourse to it act inadvertently (note 6: For, if this practice were forbidden to them, they would not be able to prevent themselves from having recourse to it nonetheless). However, it also seems evident that many would not have recourse to adoption, if they knew all this. You will also consult the Shulchan Aruch*, Orach Chaim*, at chapter 608 and the Shulchan Aruch* of the Admur HaZaken*, at the same reference, which set forth several principles establishing the fact that it is preferable to act inadvertently (note 7: Rather than to deliberately transgress a prohibition). It follows that this permission is not self-evident, in this matter. To someone like you, it is surely unnecessary to say more. With my consideration, my respects and my blessing,

מאשר הנני קבלת מכתבו מכ"ה טבת - שהגיעני ז"ע - בו כותב אודות אמוץ ילד ע"י...

בהוקרה ובכבוד ובברכה.

בכללות הענין דאימוץ ילדים, פלא שלא מצאתי עד עתה מי שישים לב להבא להלן. ואף שכבר נדפסו כמה שו"ת ומפורטות בכמה דינים המשתלשלים מענין האמוץ, אין מעורר על עצם הענין וכו'.

והחששות שנתעוררו אצלי, שהרי האמוץ בימינו אלה הוא לא כבדורות שלפנינו, בקיום המצוה דלגדל יתום בתוך ביתו וכו', אשר כל הסביבה כולל גם המגודל ידעו שאין זה ההורים שלו. ועתה הוא להיפך - עושים ככל האפשרי להעלים פרט זה, ולא עוד אלא שע"פ לחץ רופאים, האומרים שהם מומחים לעניני נפש, מחליטים שאסור לגלות זה להילד (כי עלול לפגוע במנוחת נפשו וכו'), - שמזה תוצאה, שתהי' הנהגתם עם המאומץ כאילו הי' זה ילידם ממש, שבמילא ישנם כל הענינים דיחוד, חבוק ונישוק וכו' וכו' בכל יום. ובודאי אי אפשר להזהר מזה באם אפילו המאמצים יראי שמים באמת.

ואפילו באם מגלים להמאומץ כשיגדל שאין זה הוריו, צע"ג האפשר לשנות אז הנהגה שהיתה מכמה שנים מקודם. והרי בהאמור - איסור דרבנן ודאי ישנו, ולדעת הרמב"ם גם איסור דאורייתא. והרי גם בנוגע לאיסור דרבנן - שאני כשהוא דבר ההולך ונשנה ונשלש וכו'. (נוסף על המובא ומבואר בספרי נגלה בזה - יעוין ג"כ אגרת התשובה לרבנו הזקן פרק ז'). ולכאורה ע"פ האמור צע"ג בכל ענין האמוץ, וטעם דהיתירא בכגון זה דמוטב שיהיו שוגגין וכו' - לכאורה ברור, אשר כו"כ ימנעו מאמוץ באם ידעו את הנ"ל. ועיין ג"כ שו"ע או"ח סי' תר"ח ובשו"ע רבנו הזקן שם כמה גדרים במוטב שיהיו וכו' - שע"פ זה אין ההיתר דמוטב וכו' ברור בנדון דידן. ובודאי לדכוותי' דכת"ר - האריכות אך למותר.
