Igrot Kodesh · Letter 7356 — Faith & Bitachon
Volume 19 · Letter 328 · To: grand Rav
By the grace of Hashem,
8 Tammuz* 5720,
Brooklyn,
To the great Rav, distinguished Chassid* who fears Hashem, devotes himself to communal needs, of multiple areas of knowledge, the Rav Sh. Y. (note 1: Rav Shlomo Yosef Zevin, of Yerushalayim*. See, regarding him, letter no. 7066),
I greet you and bless you,
I am responding to your letter of 3 Tammuz* and I will address its points in order. You ask me a question about the application of the principle according to which: "the tenth shall be sacred" (note 2: See letter no. 7333) in any case, including inside the pen, on the condition that subsequently this animal passes through the same gate as the others. It is then established retroactively that it was so from the outset. You ask me what difference it makes whether it exits the pen and through where. One can answer on the basis of logic or by reference to what is written.
The logic is quite simple. The exit through another gate is comparable to the constitution of a new domain, which, moreover, even annuls the count previously established in proper form. If this is so for the exit through the gate, one can accept that this applies equally to the death of the animal, which also causes it to disappear from the domain in which it was found. How could such a lamb be consecrated because there are nine others in a different pen? In other words, the exit through another gate makes it a new pen. In this matter, no distinction need be made between the ninth animal and the tenth. It is said that "the tenth shall be sacred" even if it has not left the pen. In fact, the principle according to which a clarification has retroactive value is applied in various domains, in this manner or in the reverse.
What is written also enables us to establish that this is so, as I cited in my previous letter. Thus, Rashi*, commenting on Tractate Bechoros* 59b, which speaks of the animal that died or exited through another gate, emphasizes: "the tenth was not sanctified" when there were not ten animals gathered.
I am very surprised by your citation of a book that I do not possess, according to which the formulation of this commentary of Rashi* is not precise, since in any case the tenth animal is consecrated. Now, Rashi* clearly says that it is not. Perhaps the author saw a manuscript and not the commentary itself. The same applies to the commentary of Rabbeinu Chananel* on Tractate Bava Metzia* 6b, which says: "If there are ten animals in a pen and the tenth jumped out, the nine others are released from any obligation, because the count was carried out in the manner fitting for the tithe, although the tenth did not leave the pen."
I was very pleased by your intervention for the rabbinate of Ramat Gan (note 3: See, on this subject, letters no. 7265 and 7282). I await good tidings in this matter. In my opinion, this involves both the good of the individual and that of the community. I am surprised to note that in the public remarks made on the occasion of the bicentennial of the Hilloula* of the Baal Shem Tov*, I have not seen, for the time being, that anyone emphasized what, in my view, must specifically be highlighted — the fact that the Baal Shem Tov* added light to the Torah* and the Mitzvos*, that he did not remove the slightest aspect, Heaven forbid (note 4: See, on this subject, letter no. 7052), even though he recalled the teaching of the Sages* according to which: "Hashem desires the heart." With my blessing that you give me good tidings of all this, of your communal and personal achievements, as well as with my blessing on the occasion of the festival of liberation — that of my father-in-law, the Rebbe (note 5: The 12th and 13th of Tammuz*, from the Soviet prisons), but also our own liberation,
M. Schneerson,
