To the great Rav*, distinguished Chassid* who fears Hashem and

devotes himself to communal needs, Rav Shmuel (note 1: Rav S. Yalow. See, regarding him, letters no. 6353 and 6387),

I greet you and bless you,

I am responding to your letter of 9 Marcheshvan*, concerning Kaddish* and the anniversary of the death of a child, commemorated by his father. According to your letter, the parents of the father pay no attention to it, for their part. Likewise, there is no cause to consider a conflict with other mourners (note 2: The Rebbe notes, at the bottom of the page: "According to the custom in force in this country, whereby all recite the Kaddish together"). You yourself cite the Shulchan Aruch*, Yoreh De'ah*, chapter 376. You will also see the Pischei Teshuvah*, same chapter, paragraph 3, stating the law that applies to someone who passed away before the age of twenty. This subject is detailed by the Sdei Chemed*, collection of laws, under the heading: "mourning," paragraphs 151, 162, and 212. You will also see the Shulchan Aruch*, chapter 344, paragraph 4. These texts indicate that the recitation of Kaddish* and the observance of the anniversary of the death are beneficial once the child has passed the age of thirty days. You will see what the Sifsei Kohen* says. Some make a distinction between the Kaddish* following the acceptance of the judgment (note 3: Recited at the time of the burial) and the others, which enable the elevation of the soul. Perhaps one should not recite it for a child under thirteen years of age, who is not yet obligated to practice the mitzvos*. Such a practice has already been rejected, in the references cited by the Sdei Chemed* and by the Kol Bo* on mourning of Rav Greenwald.

It is true that the Yalkut Das VaDin*, of Rav David Assaf, published in Haifa in 5705 (note 4: 1945) reports a letter from Rav T. P. Franck (note 5: Rav Tzvi Pesach Franck, who subsequently became the Chief Rabbi of Tel Aviv), according to which, before the age of thirteen, one does not recite Kaddish* and does not observe the date of death. But this assertion is not supported by any reference, and the previously cited books affirm the contrary. You know the question that is raised on this subject, as reported by the Noda BiYehudah*, second edition, Yoreh De'ah*, chapter 8, on tractate Sanhedrin* 104a. But various texts find an answer in the Tosafos*, on tractate Sotah* 10b, affirming that prayer brings salvation. In this regard, a lengthy explanation is found in the testament of the Rebbe Rashab*, which is printed in the pamphlet Chanoch LaNa'ar*, on page 19, which you will consult attentively. This text also says that the father has, in this matter (note 6: In reciting the Kaddish), a precedence that the other family members do not have. This is self-evident.

To pass from one subject to another (note 7: While remaining in the same context), you allude, at the end of your letter, to the fixing of the date of the anniversary of death — on the day of death or on that of the burial (note 8: See, on this subject, letter no. 4667). There is, in this regard, a teaching of my father-in-law, the Rebbe, whose merit protects us, according to which one retains the day of death, from the first year, even if the burial was delayed, as reported in the HaYom Yom*, on the date of 13 Shevat*. May Hashem grant that the promise be fulfilled soon, according to which: "He will turn the hearts of the fathers toward the children and the hearts of the children toward their fathers." Then, "He will eliminate death forever" and "they will awaken and rejoice, those who rest beneath the earth." You will consult the wondrous allusions reported regarding the verse: "He will eliminate death forever" in the Dan Yadin, volume 3, of the Sefer Karnayim, whose author is the divine Tzaddik*, versed in Kabbalah*, Rav Sh. of Ostropola. This work establishes a connection with Yonah*, son of Amitai, of whom it is known that he drew divine inspiration during the celebration of Simchas Beis HaSho'eivah* (note 9: The rejoicings that were celebrated in the Beis HaMikdash* when the water for the libations was drawn). May Hashem grant that this be fulfilled soon, with the building of the third Beis HaMikdash*, with the coming of our righteous Moshiach*. With my respects and my blessing to give good tidings,

במענה למכתב כת"ר מט' מ"ח בהנוגע לקדיש ויארצייט דתינוק - ע"י אביו שי' וכו', ונראה מסגנון מכ' כת"ר שהורי האב אין מקפידין ע"ז כו'. כן להעיר, אשר אין מקום לדיון ע"ד השגת גבול שאר אבלים*.

והרי כבר ציין כת"ר, לשו"ע יו"ד סי' שע"ו. ראה שם פ"ת ס"ק ג' הדין באם הנפטר פחות מכ' שנה. ומפורש הענין עוד יותר בשדי חמד, אסיפת דינים מערכת אבלות ס"ק קנ"א קס"ב ורי"ב, וראה ג"כ שו"ע שם סי' שד"מ סעיף ד'. דמכל הנ"ל משמע - דתועלת האמירת קדיש (וגם יארצייט) משעבר עליו שלשים יום, עיין בש"ך שם. ומה שיש רוצים לחלק בין הקדיש שלאחרי צדוק הדין, משא"כ קדיש סתם, שהוא לעילוי הנשמה, אפשר דקודם י"ג שנה, שאינו בר חיובא, אין לאמרו.

כבר נדחה עפמש"כ בספרים המצוינים בשדה חמד האמור. ובס' כל בו על אבילות להרב גרינולד.

איברא דבס' ילקוט דת ודין (להרב דוד אסף, חיפה, תש"ה), נדפס מכתב הרה"ג וכו' רצ"פ פרנק שי' שקודם י"ג שנה אין נוהגין בו לא יא"צ ולא קדיש. אבל לא הביא כל סמוכין לדבריו, והרי בספרים הנ"ל איפכא מסתבר.

והנה ידועה הקושיא בזה, הובאה בנודע ביהודא מהד"ת יו"ד סי' ח' מש"כ סנהדרין ק"ד ע"א, אבל מובא בכ"מ דמתורץ בתוספת סוטה יו"ד ע"ב ד"ה דאייתי, דתפלה מצלת.

ומבואר בארוכה בזה, בצוואת כ"ק אדמו"ר מוהרש"ב נ"ע (נדפסה בקונטרס חנוך לנער, עמוד י"ט, עיי"ש באר היטב). ומשם מוכח ג"כ דמעלה באב לגבי שאר קרובים, וק"ל.

ומענין לענין, לסיום מכתבו בחשבון יום היארצייט, מיום המיתה או מיום הקבורה. - מובאה בזה הוראת כ"ק מו"ח אדמו"ר זצוקללה"ה נבג"מ זי"ע: יא"צ - ביום המיתה אפילו בשנה ראשונה, ואפילו כשיום הקבורה רחוק מיום המיתה (נדפס בהיום יום י"ג שבט).

ויהי רצון שבקרוב ממש נזכה לקיום היעוד, והשיב לב אבות על בנים ולב בנים על אבותם, כי בלע המות לנצח, ויקיצו וירננו שוכני עפר.

ויעוין רמזים נפלאים בלשון "בלע המות לנצח", דוקא, בפירוש דן ידין מ"ג - על ספר קרנים - להמקובל האלקי הר"ש מאוסטרפולה, דשייך ליונה בן אמיתי, אשר ידוע דשאב רוה"ק בשמחת בית השואבה. ונזכה בקרוב בקיומה - בבנין בית השלישי בביאת משיח צדקנו.
