On the occasion of the new year, which approaches, for us and for all Israel, for good and for blessing, I express to you herewith my wishes, for yourself and for all your family, that you be inscribed and sealed for a good and sweet year, materially and spiritually. With my respects and my blessing,

P.S.: I thank you once more for your gift, your book Chemdas Moshe*, responsa on the four parts of the Shulchan Aruch*. My time does not at all permit its thorough examination, due to the content of these days. And one knows what the Birkei Yosef* says, cited by the Elef LaMatteh*, in the Matteh Efrayim*, chapter 581, paragraph 15. Despite this, as a mark of affection, I formulate here some remarks:

At the beginning of the introduction: Regarding the commentary of the Or HaChaim* on the verse: "And the sea returned," you will consult the Or Torah* of the Maggid of Mezeritch*, on this subject. A story of my father-in-law, the Rebbe, whose merit protects us, on this subject, is reproduced in the Hayom Yom*, on the date of Shabbos* Parshas* Beshalach* (note 2: Relating to the condition imposed on the Red Sea at the time of creation, that it should open before the children of Israel).

At the beginning of the foreword, paragraphs 2 and 3: You will consult the Yerushalmi*, tractate Taanis*, chapter 1, paragraph 1, which says: "with five elements... He saw..."

Responsa, chapter 1: Many are those who observe the Torah* and the mitzvos* but stay, nevertheless, in hotels (note 3: Belonging to non-Jews, without concern. See, on this subject, letter no. 6937), but my father-in-law, the Rebbe, did not carry anything during Shabbos* in the corridor of a hotel. In any case, those who have recourse to hotel services have strong reasons to do so:

A) A permission is given in this matter because the owner possesses belongings in the rooms, which means that he has not entirely removed his property from them. It is therefore as if he himself resided there, so that all are his guests, as the Shulchan Aruch* of the Alter Rebbe* says, chapter 370, paragraph 2. Moreover, the rental of a hotel room is subject to various limitations not found in ordinary lodging.

B) There are almost always, in the room, objects belonging to the owner that the renter does not use. In this way, the owner remains a stakeholder, even if it were an ordinary rental.

C) According to the Pri Megadim*, chapter 370, paragraph 3, it suffices that the owner has the right to store his belongings there. But the Mishnah Berurah* does not share this view.

D) One stays there for fewer than thirty days. Even if one stays longer, the rental is paid weekly. And the owner can terminate the rental at any time, since there is no contract, unlike a standard lease. It is therefore, each week, a new rental. You will see the Shulchan Aruch* of the Alter Rebbe*, at the end of chapter 370, according to which one who fixes his stay for more than thirty days is not subject to the prohibition during the entire period. And those who pay a monthly rent, including on the basis of the standard calendar according to which a month can have thirty-one days, are also not subject to the prohibition, except if the thirty-first day is a Shabbos*, and in that case, only during that Shabbos*. You will consult the Or Zarua* and the Biur Halachah* of the Mishnah Berurah*, at the end of chapter 370, regarding the thirty days.

The responsa of the Rashag*, volume 2, published in Bordiyov in 5699 (note 4: 1939), chapter 123, state a permission in this matter, invoking reasons A and C. This work concludes by citing as proof the fact that one does not affix a Mezuzah* (note 5: On the door of the hotel room) in such a case, including for those who spend more than thirty days in non-Jewish hotels.

Beginning of the passages: One can truly question how to explain the view of the Rambam*, in his Laws of Disqualified Sacrifices, chapter 3, paragraph 22. According to him, sacrifices that have been slaughtered are rejected. You will also see the Kesef Mishneh*, Laws of Idolatry, chapter 7, paragraph 10, as well as the Rambam*, Laws of Disqualified Sacrifices, chapter 2, paragraph 22. Now, they should have been considered as slaughtered animals and not as living animals.

Conclusion of the Talmud: "Rabbi Yehoshua ben Levi said... each Tzaddik* and each Tzaddik*..." You give the explanation of this repetition, which alludes to the Tzaddik* and to the one who has attained Teshuvah*. Certainly, one does not challenge a commentary (note 6: Since it is always possible to propose another one), according to the Shaar HaPesukim* of the Arizal*, regarding the verse: "They embittered their lives." One can, however, find support for it in tractate Kiddushin* 49b, according to which, in accordance with Halachah*, and with certainty, one who has attained Teshuvah* can be called a "Tzaddik*."

This is, moreover, connected to the content of this period, since this statement of our Sages*, regarding each Tzaddik*, does not correspond to what Rabbi Chiya bar Abba says in the name of Rabbi Yochanan, in tractate Berachos* 34b. One can also see in this the basis of the halachic* ruling, in particular of the Rambam*, according to the view that contradicts his and says that: "the level attained by the one who achieves Teshuvah* is not within the reach of the perfect Tzaddik*." You will also see Iggeres HaTeshuvah* of the Alter Rebbe*, at the end of chapter 8.

שו"ת ס"א . כו"כ משומרי תומ"צ מקילין בהאטעלס [כ"ק מו"ח אדמו"ר לא הי' מטלטל בש"ק בפרוזדרי האטעלס] ולכאורה יש להם על מה שיסמוכו סמיכה חזקה: א) עפמשנ"ת טעם ההיתר ביש לבעה"ב כלים בבתים כיון שזה מראה שלא סילק עצמו מבתים אלו מכל וכל כו' נעשה כאילו דר בהם כו' נעשו כולם כאורחים אצלו (שו"ע רבנו הזקן סש"ע ס"ב) - והרי כמה הגבלות ישנם בשכירות חדר בהאטעל לגבי שכירות דירה באופן הרגיל.

ב) כמעט תמיד נמצאים בחדר חפצי בעה"ב שאין השוכר משתמש בהם כלל , והוי תפיסת ידו, אפילו באם היתה שכירות ממש.

ג) להפמ"ג סש"ע א"א סק"ג (ודלא כמשנ"ב) עו"ש ותוס"ש - באם יש לבעה"ב רשות להניח ג"כ מספיק.

ד) מתארחים לפחות מל' יום, ואפילו אלו הדרים יותר משלמים השכירות מדי שבוע בשבוע ואז ברשות בעה"ב לסלקו לגמרי (כי אין כל חוזה, ודלא כשכירות בתים) ז.

א. שבכל שבוע נתחדשה דירתו. וראה שו"ע אדה"ז סו"ס ש"ע דאפילו הקובע ליותר מל' יום אינו אוסר עד לאחר ל' יום, וא"כ אפילו המשלמים אחת לחודש ע"פ מספר העמים שיש בהם חדש של ל"א יום, אינו אוסר מלבד באם חל יום הל"א בש"ק ורק ש"ק זה. - ועיין א"ר וביאור הלכה להמשנ"ב סו"ס ש"ע בנוגע ליום ל'.

ובשו"ת מהרש"ג ח"ב (בארדיאב תרצ"ט) סקכ"ג התיר בהרוחה מטעמים א' ג' הנ"ל.

ומסיים בראי' מהא דאין קובעין מזוזה בכהנ"ל אפילו המתארחין (בהאטעלס דנכרים) יותר מל' יום.

סוגיות. בתחלתן. צע"ג בישוב דעת הרמב"ם - דהרי ס"ל דקדשים שחוטים נדחים (הל' פסוהמ"ק פ"ג הכ"ב. וראה ג"כ כ"מ הל' ע"ז פ"ז ה"י, רמב"ם הל' פסוהמ"ק פ"ב הכ"ב) והד"ס צ"ל דינו כשחוטים ולא כבע"ח.

הדרן לש"ס . אריב"ל כו' צדיק וצדיק - ומפרש הכפל, צדיק ובע"ת. ואף דאין משיבין על הדרש (שער הפסוקים להאריז"ל עה"פ וימררו את חייהם) יש להעיר דמסייע לי' מקדושין (מט, ב) אשר גם להלכה בודאות קורין לבע"ת צדיק.

ומענין ימים אלה - מרז"ל זה דלכל צדיק וצדיק כו' הוא דלא כר"ח בר אבא אר"י (ברכות לד, ב). וי"ל דזהו ג"כ היסוד להפס"ד (רמב"ם ועוד. וראה ג"כ אגרת התשובה לרבנו הזקן ספ"ח) כמאן דפליג עלי' ואמר מקום שבע"ת עומדין צד"ג אינם עומדין.
