Igrot Kodesh · Letter 676 — Tzedakah
Volume 3 · Letter 282
By the grace of Hashem,
16 Menachem Av 5710,
To the Rabbi, distinguished Chassid* who fears Hashem,
Rav A. D.,
Greetings and blessings,
I reply to your two letters, of Monday and Tuesday:
A) An explanatory note to the sicha* of 12 Tammuz was omitted [1]. Here it is: "Tractate Bava Metzia, at the end of the second chapter, says that one must seek the lost object of one's master before seeking that which has been lost by one's father. And the end of Tractate Kerisos gives precedence to the master in all cases. But this raises no difficulty, for the disciple is bound to honor his master [2]. One must therefore take into account the good he brings him [3]. Now, a little of the World to Come [4] is preferable to the totality of this world [5].
Moreover, Tractate Kerisos, at the same place, says that the father is also obliged to honor the master. It is not the same regarding a miracle [6]. One then recites a blessing because one personally benefits from the miracle that occurred [7]. In such a case, the criterion is proximity [8]. That of the son and the father is, of course, more evident [9]."
B) You ask me about the Shnei Luchos HaBris*, "Gate of Letters," page 100b, and I am surprised by your question, for when we had spoken of it, I told you to consult the commentary of the Ramban on the verses Bereishis 31:35 and Vayikra 18:19. The Shnei Luchos HaBris says nothing else.
C) You deduce from this a proof that the prohibition of touching [10] is motivated by impurity and not by the intimacy that risks being created thereby. This is not exact, for if such were the reason, it would be even more grave to speak with her and to look at her. Yet it is clearly stated that: "the Torah did not at all forbid this. On the contrary, the Sages sought the good of Jewish women in this matter. Our Sages report, in Tractate Shabbos 64b, the practice of the elders and the intervention, in this domain, of Rabbi Akiva." You will also consult the commentary of Rashi and Tractate Kesubos 61a, which speaks of her labors.
Why is it permitted to speak with her? The Rambam explains it in his responsa, which are printed in the Shlesinger edition, in the volume Kedusha, chapter 169: "The Sages distinguish, indeed, what is impure or pure from what is forbidden or permitted."
D) Why did our Sages not forbid these practices on account of impurity? One can justify it in different ways:
1. The Shnei Luchos HaBris says that they perceived that the people could not bear it.
2. Out of deference for women, as the Shulchan Aruch* Orach Chaim says, at the end of chapter 8.
3. Out of modesty, so that the members of the family would not perceive [11], as the Reishis Chochmah explains, which the Shnei Luchos HaBris cites at the same reference.
4. The Karaites adopted such practices, claiming that they emanated from the Torah, as the Rambam says in the responsa previously cited. To distinguish ourselves from them, these prohibitions were not adopted. Only a few persons did so, in a personal capacity. Tractate Parah 3:7 reports a similar approach [12], in an even stronger manner.
This subject is well known and one may consider that Hashem grants His protection in this regard. One therefore safeguards oneself and is conscious of the danger, as the Tzemach Tzedek* notes in his responsa Even HaEzer, at the end of chapter 11.
I conclude by extending my blessing,
M. Schneerson
