Blessings and greetings,

I am responding to your letter of 16 Elul*, in which you mention the payments and reparations that you should now receive from Germany. You are of the opinion that they should be refused and you give me the reason. Now, it is clear that the current situation is completely different from the one that prevailed some time ago, when one debated whether to accept these reparations or not. This point has been on the agenda for several years and has been very widely disseminated. The action of an individual in this matter — whether or not he asks for what is rightfully his — will therefore not change the negative sentiment you report, any more than their rehabilitation or the proximity with them.

You say that when a thief returns the object of his theft, his punishment is alleviated, which is not the case if this restitution is not accepted. Now, various texts of our Torah* establish that one must take back the stolen object from him, even if this thief is a non-Jew. Moreover, if he retains the stolen object, he will be strengthened by it. How much more so in this case, since the thief has remained one, even to this day. Strengthening him would therefore not serve the good of the world. Of course, this is not called receiving Tzedakah* from non-Jews, for these reparations are paid to the rich and the poor alike. It is therefore in no way a form of Tzedakah*.

In my view, you should therefore do everything in your power to claim the largest possible sum, for it is rightfully yours. But, following what is mentioned in your letter, you will set aside one-fifth for Tzedakah*. Of course, those who pay you these reparations will in no way share in the merit of this Tzedakah*, for they are merely returning what was stolen to its owner, who uses the amount as he sees fit. You surely know the positive custom of Jewish women, which consists of setting aside Tzedakah* before lighting the candles, on the eve of Shabbos* and the holidays. At the very least, you will adopt it from now on. With my blessing that you be inscribed and sealed for a good year,

ברכה ושלום! במענה למכתבה מט"ז אלול, בו מעוררת שאלת קבלת הכספים דשלומים ופיצוים מאשכנז העומדת אצלה על הפרק, ואין דעתה נוטה לקבלם, ומפרטת הטעמים בזה.

מובן ששונה בתכלית המצב עתה, מאשר הי' בעת הדיון לפני כמה זמן באם להסכים לקבלת פיצוים אלו או לא, כי כיון שכבר נמשך הדבר כמה שנים ובפרסום הכי גדול, מובן שאין ביחס יחיד להאמור (כוונתי באם יתבע המגיע לו או לא), לשנות אותו הרושם הבלתי רצוי שכותבת אודותו (הרמת קרנם, קירוב הדעת אליהם וכו').

כן במ"ש שכשהגזלן מחזיר הגזילה, מקילין בעונשו, משא"כ באם לא תקבל.

ידוע בכ"מ בתורתנו שצריך להוציא הגזילה מיד הגזלן גם עכו"ם, ובפרט שכשתשאר הגזילה בידו, ה"ז מחזק מעמדו וענינו, ובפרט בנדון דידן שהגזלן נשאר גזלן גם עתה, הרי חיזוק כחו, אינו מחזק צד הטוב שבעולם.

ומובן ג"כ שאין בהאמור מענין קבלת צדקה מן העכו"ם, שהרי הפיצוים הם בין לעניים ובין לעשירים בשוה, ואין בזה ענין של צדקה.

ולדעתי תעשה את התלוי בה, לתבוע סכום הכי גדול המגיע להם, אלא שבהמשך למכתבה, יפרישו חומש מזה לצדקה, ומובן וגם פשוט שאין בצדקה זו, כל זכות לאלו ששלמו הפיצוים, שהרי הם החזירו הגזילה לבעלי', והבעל עושה כפי רצונו הוא.

בודאי יודעת ממנהג הטוב של בנות ישראל להפריש לצדקה קודם הדלקת הנרות בכל ערב שבת וערב יום טוב, ובכל אופן תנהג בזה מכאן ולהבא.
