I am responding to your letter of this Monday, in which you write to me that you envision renting a suitable place and founding a Talmud Torah* there. You have already found a store that serves the purpose and you ask me what I think about it. According to the Halachah*, there is no unfair competition in the matter of Torah* study, as the Shulchan Aruch*, Yoreh Deah*, rules at the end of chapter 245. Despite this, it is appropriate to verify from the outset that there will be no opposition in your surroundings, if there is, nearby, a similar institution. Indeed, this opposition could have negative effects. It is possible to verify all of this in a diplomatic manner.

You tell me that you envision conceiving this Talmud Torah* for eighty students and that there are, in your neighborhood, hundreds of Jewish families, may Hashem* multiply them. If this is so, one must, of course, hurry to verify all the details so that, at enrollment or at the beginning of the school year, all of this is already settled. You make reference to the necessary permits. One must, of course, address the corresponding administrations. May Hashem*, Who feeds and sustains everyone, with kindness, grace, beneficence, and mercy, allow you to meet your needs and those of your family, in a manner that will be good for you, both materially and spiritually. במענה למכתבו מיום ב' בו כותב אודות הסברא לשכור מקום מתאים ולסדר שם ת"ת, וכבר מצא חנות המתאימה לזה, ושואל דעתי.

והנה אף כי ע"פ דין תורה אין בענין דת"ת ענין דהשגת גבול, ונפסק הדין להלכה בשו"ע יו"ד סו"ס רמ"ה, הנה בפועל נוגע לברר מתחלה באם לא תהי' התנגדות בהסביבה, באם יש שם במקום קרוב ביותר מוסד ע"ד האמור, והרי אפשר שההתנגדות זו תתבטא באמצעים בלתי רצוים, והרי בודאי אפשר באופן דיפלומטי לברר את האמור.

במ"ש שבתכניתו לסדר ת"ת עד לשמונים תלמידים, כיון שהשכונה בה דרים מאות משפחות יהודים צ כן ירבו צ מובן שאם כן צריך להזדרז בבירור כל הפרטים בכדי שלזמן הרישום או זמן הלימוד יהי' כבר כל הפרטים בזה מסודרים.

במ"ש אודות רשיון צ מובן שצריך לברר זה במשרדים המתאימים. ויהי רצון אשר השי"ת הזן ומפרנס לכל בטוב בחן בחסד וברחמים ימציא לו פרנסתו ופרנסת ב"ב שי' באופן הטוב לפניהם בגשמיות וברוחניות גם יחד.
