To the great Rav*, distinguished Chassid* who fears Hashem*, Rav David (note 1: Rav D. Winchester, of Chicago. See, on his subject, Letter no. 6035),

Shalom* u'vracha*,

I am responding to your letter from this Wednesday, in which you address a question that has been widely debated, that of the time of the conclusion of Shabbos*. You conclude by citing the Shulchan Aruch*, chapter 293, at paragraph 1, according to which, it would seem, one must wait seventy-two minutes (note 2: After sunset for night to fall). The Alter Rebbe*, author of the Tanya* and halachic* authority of the hidden part of the Torah*, author of the Shulchan Aruch* and halachic* authority of the revealed part of the Torah*, emphasizes that this time is not the same according to the period of the year in which one finds oneself and the place where one is. You will consult his "order of the entry of Shabbos*," which is printed in his Siddur*. Therefore, in each place, one must determine the calculation corresponding (note 3: See the Kuntres HaNeshek*, volume 2, notes 7 and 14) to its latitude. Moreover, a distinction must be made according to the period in the year.

The practice that I have observed here, in New York, consists of waiting approximately fifty minutes after sunset. Of course, I do not take responsibility for this. In general, it is good, as you know, to delay the conclusion of Shabbos*. Nevertheless, at the synagogue, one must do so in such a manner that those present can bear it (note 4: Some being eager to leave). Of course, this is a matter of a better practice and not of a halachic* prohibition. And, "great is Shabbos* which is considered equivalent to all the mitzvos*." במענה למכתב כת"ר מיום ד', בו נוגע בשאלה אשר דשו בה רבים, בנדון זמן מוצש"ק, ומסיים שמשו"ע סי' רצ"ג סעיף א' נראה, שצריך להמתין ע"ב רגעים.

והנה ידוע פסק דין רבנו הזקן בעל התניא (פוסק בנסתר דתורה) והשולחן ערוך (פוסק בנגלה דתורה) שאין זמן המתנה האמור שוה במשך כל השנה ובכל המקומות, עיין סדר הכנסת שבת לרבנו הזקן הנדפס בסידורי, שלכן בכל מקום יש לדעת החשבון מתאים להאופק שלו, וגם בזה חילוק בזמן השנה עצמה.

מה שראיתי נוהגים כאן, בנ.י. הוא לחכות לערך חמשים רגעים לאחרי השקיעה, אבל מובן שאיני אחראי בזה, ובכלל הרי ידוע מעלת המאחר במוצש"ק אלא שבבית הכנסת צריך להיות באופן שרוב הצבור יכולים לעמוד, ופשוט שזהו בהנוגע להידור אבל לא בהאסור ע"פ דין והרי גדולה שבת ששקולה כנגד כל המצות.
