Igrot Kodesh · Letter 6144 — Tzedakah

You (note 1: This letter is addressed to Rav Shmuel Yalow. It was written on his own letter of 10 Adar 5718. See, on his subject, Letter no. 2776) make remarks (note 2: Rav Yalow wrote: "The Tanya* evokes sending spies into all the synagogues. Now, this term 'spy' has a slanderous connotation. How can a man believe what another comes to report to him? The latter must therefore bear testimony before him. And, he furthermore retains the possibility of pushing him away with both hands") on Iggeres HaKodesh*, at the end of chapter 1:

A) Concerning the term "spies," you will see the verse Shmuel* I, 26:40 and you will carefully consult the Likkutei Torah*, at the end of Parshas* Shelach*.

B) One can bear testimony only before a tribunal.

C) One must not push away with both hands. Similarly, our Sages* say, in Tractate Berachos* 28a, that "I seized him only to justify my opinion."

There are several differences between the context of Iggeres HaKodesh* and these teachings of our Sages*, as well as, above all, in the conditions of testimony. Tractate Berachos* refers to one who has already acted and adopted a certain behavior. It is not so when one establishes a fence, takes a precaution for the future, and strengthens the practice of the Torah*, as is clearly established by the fact that one strikes and punishes, according to Tractate Sanhedrin* 46a, even if no prior warning was given.

...בהערות כת"ר באגה"ק סוס"א: א) הביטוי מרגלים - ראה ש"א כו, ד. לקו"ת ס"פ שלח, יעו"ש היטב.

ב) הרי אין מעידין אלא בפני ב"ד. ועוד.

ג) הרי אין לדחות בשתי ידים. וכן הלא ארז"ל (ברכות כח, א) דרק לאיתובי דעתי אחזיוהו.

כמה חילוקים בנדון דאגה"ק מעניני דמרז"ל אלו. והעיקרי - התנאים בעדות והא דברכות הוא בהנוגע לזה שכבר עשה מעשה ומתנהג באופן מסוים - משא"כ בעשית גדר ואזהרה על להבא וסייג לתורה. ובמכש"כ וק"ו מהא דמכין ועונשין כו' (סנה' מו, א) ואף שלא הזהירו מקודם.

בהערתו: במכתבו: בספר התניא... לשלוח לכל המנינים מרגלים... והמילה מרגל מציין איש המוציא דיבה... והאיך יאמין אדם מה שאחר מספר לו... צריכים להעיד בפניו. וגם זה האם יש ביכולתו להרחיק בשתי ידים.
