Rav Chadakov* informed me of the discussion he had with you. This is the reason I am writing you the present letter, despite the many letters I had received previously that still await their response. I therefore begin by thanking you. I have received your book "The Jews of Remembrance" and I thank you for it. The purpose of remembrance is to bind a person to his memory, which must exert an influence upon him. May Hashem* therefore grant that the memory of the persons about whom you write influence the readers of your book, who will follow the path of these Jews of Remembrance — the path of life according to the Tradition of Israel.

You question me and formulate remarks about the conversation you had with Rav Chadakov*:

A) You know the issue posed by the name Eretz Yisrael* or that of State of Israel. I specify that it is an issue posed by this name and only that. Indeed, this name was established by the Elokim* of Israel, as the Torah* states, in particular in the prophecy of Yechezkel* (40:2): "In the heavenly visions, He brought me to Eretz Yisrael*." Our Sages*, in the Mishnah*, the Gemara*, and the Midrash*, speak of the Holy Land, of the particular land, as it is said: "When you come into the land." Of course, as with everything decided by the Creator of the world, Who directs it, and with everything pertaining to the Torah* and the mitzvos*, a human being has no power to change this name or modify it to speak of a State of Israel, even if the majority accepts it. There is no need to schedule a vote on this point.

The refusal of a vote on what is stated in the Torah* is a fundamental principle. This is not merely a discussion about a word or an expression. It is a point with concrete implications, for a real difference exists between these designations. The kingdom of the Khazars, after their conversion to Judaism, became a State of Israel, but not Eretz Yisrael*. Whenever my words are cited, I insist that the name mentioned be the one appearing in the Torah* — the name of the three-thousand-year-old tradition.

B) The concepts of settlement in Eretz Yisrael* and the Return to Tzion* are, of course, different. Some confuse them and mention one in place of the other. This has had, and continues to have, the effect of several confusions and erroneous conclusions. Settlement in Eretz Yisrael* is a concept of the Torah*. According to some opinions, it was in force during the era of the Beis HaMikdash*, when the Jews were on their land. According to others, it remains valid also during the time of the exile. The Return to Tzion*, in the literal sense, is linked to the redemption, at the conclusion of the exile. Of course, it applies after the destruction of the Beis HaMikdash*, since it is a return. Such an idea is not new and did not arise from nothing. It appears in the Torah*, for example in the verse Tehillim* 126:1.

Such are the words of the great master, the Rambam*, in his Mishneh Torah*, regarding the Return to Tzion*, in chapter 11 of the Laws of Kings: "The king Moshiach* will arise and will restore the kingdom of David to its original state, to its initial sovereignty. He will rebuild the Beis HaMikdash* and will gather the dispersed of Israel. The Torah* bears testimony about him, as it is said: 'Hashem* will restore your captivity. He will have compassion upon you, and will gather you again.'" At the end of this chapter, the Rambam* adds: "A king will arise from the house of David, learned in the Torah* and devoted to the mitzvos* like David his ancestor, according to the Written Law and the Oral Law. He will lead all the Jews to follow the Torah* and to strengthen it. He will rebuild the Beis HaMikdash* in its place and gather the dispersed of Israel."

As is known, the Rambam* is precise in every word he employs in his Mishneh Torah*, as well as in the order he adopts — what he introduces first and what he cites last. Indeed, the halachah* specifies that the order of the Torah* is an integral part of it. First, therefore, will come the king Moshiach*, who will restore the kingdom. Subsequently, he will rebuild the Beis HaMikdash* and only then will he gather the dispersed of Israel, in accordance with the promise of the Torah*: "He will gather you again. If you are banished to the ends of the heavens, Hashem* will bring you." As the preceding paragraph stated, a decision of the Torah* cannot be put to a vote and decided by majority opinion.

Various teachings of our Sages* corroborate and explain all of this. Nevertheless, I have chosen here the halachic* ruling appearing in a book that is accepted by our entire people, the Children of Israel. As was said, this work is particularly precise in the words it employs and the order it adopts. It is, of course, unnecessary to emphasize that the common element in all that has been said and in the discussion that was held regarding the other bank of the Jordan and, more generally, the borders of Eretz Yisrael*, is an integral part of the Holy Land, an integral part of the redemption of the people of Israel.

It is forbidden and even impossible to renounce the name Eretz Yisrael*, even if one proposes to replace it with that of State of Israel. Furthermore, it is equally forbidden and impossible to renounce the Return to Tzion*, even if one proposes to replace it with a settlement in Eretz Yisrael*, even if this settlement involves tens of thousands of people. It is forbidden and impossible to renounce any part of Eretz Yisrael*, even if the majority accepts it.

The assurance has been given to us that the refusal to concede brings closer the end of the exile — exile of the body and exile of the soul — and that, ultimately, this attitude will bring about the redemption, our redemption, and the liberation of our souls.

בקשר עם מה שמסר לי הרב חדקוב שי' אודות שיחתו עם מר, כותב הנני עתה מכתב זה, למרות רבות המכתבים שקדמו לענין זה והמחכים למענה. ומתחילים בתודה.

אישור קבלה ותודה על ספרו "יידן צום געדענקען". ויהי רצון אשר, מתאים לתכליתו של ענין הזכרון, שצריך הוא לקשר את האדם להענינים אותם מעלה בזכרונו, קשר שיביא להשפעה עליו.

הרי גם זכרון אישים אלו אודותם כותב, ישפיע על קוראי הספר, שימשיכו באותה הדרך בה הלכו היידן צום געדענקען, דרך חיים ברוח ישראל סבא.

בשאלתו - הערתו בהשיחה עם הרב חדקוב שי':

א) ידועה השיטה בהנוגע לבעית השם : ארץ ישראל, או מדינת ישראל. - מדגיש הנני בעית השם , כי אין כאן המדובר, כי אם בהנוגע לקביעות השם -

והיא:

אשר אין בזה מקום לספק, לאחרי שנקבע השם מאז ומקדם על ידי אלקי ישראל, וכנאמר בתורה בנבואת יחזקאל: במראות אלקים הביאני אל ארץ ישראל, (מ, ב) ועוד.

וחכמינו ורבותינו ז"ל במשנתם, בגמרא ובמדרש כן קוראים לארץ קדושה זו (או בשם הארץ - ארץ המיוחדת, וכלשון הכתוב, כי תבואו אל הארץ). ומובן ופשוט אשר, ככל הענינים שנקבעו ע"י בורא עולם ומנהיגו, עניני התורה ומצותי' גם שם זה אין ביד האדם לשנותו או להחליפו בשם מדינת ישראל, ואפילו אם יסכים עליו הרוב - כי אין זה בגדר הצבעה.

ושלילת הצבעה על ענין שבתורה, הרי זה עיקרון פרינציפיוני, ואין זה פלפול סתם אודות תיבה וביטוי. - ישנה גם נקודה בהנוגע לפועל המבליטה החילוק שבין שני השמות, והיא: מלכות הכוזרים (לאחרי שנתגיירו) מדינת ישראל הייתה, אבל לא ארץ ישראל.

ומדייק הנני בכל מקום שמזכירים הדבר בשמי, שיהי' השם נקרא בו בתורה, שם מסורתי זה כשלשת אלפים שנה.

ב) המושג ישוב ארץ ישראל, והמושג שיבת ציון, מובן שנפרדים הם, ומה שישנם מערבים אותם ומחליפים אחד בחבירו, הביא וגם מביא, לכמה בלבולים, מסקנות בלתי נכונות ועוד.

ישוב ארץ ישראל, הוא ענין בתורה ויש אומרים אשר נוהג הוא בזמן הבית וישראל על אדמתם, ויש אומרים שגם בזמן הגלות. שיבת ציון - הוא כפשוטו, ענין הקשור עם הגאולה מן הגלות. וכמובן חל הוא רק לאחרי החורבן, שהרי זהו ענין השיבה.

כי גם מושג זה לא חדש הוא וגם לא זכינו בו מן ההפקר. והוקבע מכבר בתורה (תהלים קכו, א).

ואלו הם דברי המורה הגדול רבנו הרמב"ם בספרו משנה תורה, בהנוגע לשיבת ציון (הלכות מלכים פרק י"א): המלך משיח עתיד לעמוד ולהחזיר מלכות דוד ליושנה לממשלה הראשונה ובונה המקדש ומקבץ נדחי ישראל כו' התורה העידה עליו שנאמר ושב ה' אלקיך את שבותך ורחמך ושב וקבצך וגו', ובסוף הפרק: יעמוד מלך מבית דוד הוגה בתורה ועוסק במצות כדוד אביו כפי תורה שבכתב ושבעל פה ויכוף כל ישראל לילך בה ולחזק בדקה כו' ובנה מקדש במקומו וקבץ נדחי ישראל כו'.

וידועה דייקנותו של הרמב"ם בכל מלה ומלה שבספרו משנה תורה, ובסדר הדברים בקדימה ואיחור. וכאמור הסדר ע"פ פסק דין התורה הוא, שבתחלה יעמוד מלך המשיח ויחזיר המלכות, ואחרי כן יבנה המקדש, ואחרי כן יקבץ נדחי ישראל. וזוהי ההבטחה שבתורה: ושב וקבצך וגו', אם יהי' נדחך בקצה השמים וגו' והביאך ה'. וכאמור בסעיף הקודם - פסק דין שבתורה אינו ענין להצבעה ולהכרעה על פי דעת הרוב.

כמה מרז"ל ישנם בביסוס ובהרחבת האמור לעיל, אבל בחרתי בפסק דין שבספר הלכה המקובל על כל עמנו בני ישראל, ואשר כאמור מדוייק הוא בתכלית בביטויו ובסדרם.

בודאי למותר להדגיש, הצד השוה אשר בהאמור לעיל, ובמה שנדבר מאז בהנוגע לעבר הירדן (ולגבולות ארץ ישראל בכלל), אשר חלק הוא מארץ ישראל, וחלק מגאולת עם ישראל.

כי אסור וגם אין אפשריות - לוותר על השם ארץ ישראל, אפילו אם מציעים להחליפו בשם מדינת ישראל, אסור וגם אין אפשריות לוותר על הענין דשיבת ציון אפילו אם מציעים להחליפו בענין דישוב ארץ ישראל ואפילו כשהישוב ע"י אלפי אלפים, אסור וגם אין אפשריות - לוותר על חלק מארץ ישראל איזה שיהי', ואפילו אם יסכים על זה הרוב.

והובטחנו אשר דוקא שלילת הוויתור - מקרבת קץ הגלות, גלות הגוף וגלות הנשמה, ותביא, סוף סוף, את הגאולה, גאולתנו ופדות נפשנו.
