To the great Rabbi, distinguished Chassid* who fears Hashem,

Rav Y.[1],

I greet you and bless you,

I have duly received your letter of the 15th of Mar'Cheshvan*, setting out the instructions given to you by the Rabbi*[2] regarding the Mikveh*, and I thank you for it[3]. Upon receipt, I sent a copy to the one who had inquired of me, naturally mentioning your name. Enclosed you will find another copy of this copy.

At first glance, the following questions arise:

A) If the two basins are built side by side, there is at all times the possibility of verifying that the one containing rainwater possesses the necessary quantity. Indeed, the ground absorbs an indeterminate quantity of water each day, or else sediment settles at the bottom of the basin.

This is not the case when the two basins are situated one above the other. And very often, water — hot or cold — is added in any case to the upper basin. It may therefore take some time before one notices that it is lacking water.

B) At paragraph 4: The water rises onto the ground[4]. It may perhaps be explained that this is to prevent three Log* of water distributed by the public utility from gathering in the lower part of the upper basin before the rainwater passes through.

In any case, what must be done when the upper basin is maintained without touching the lower basin?

C) At paragraph 6: It seems difficult to immerse oneself by stretching out one's entire body, as the water carries one upward and one therefore needs to hold onto something.

This is what the Tikkun HaMikveh* of the Admor HaZaken* says: 'One will hold on with one's hand.' It follows that the body will have folds, and the precaution taken in this way therefore leads to a less scrupulous situation.

D) At paragraph 9: You say: 'On the soil of the courtyard, with the intention of doing so.'

I do not know what intention is referred to here[5].

E) At paragraph 14: You say that the Mikveh* must contain 726 liters of water, and I am somewhat surprised. Having adopted the most stringent opinions in all the matters previously mentioned, why do you not do so in this matter as well, by requiring 757.5 or even 762 liters? This is what the Tel Talpyot*, edition of 5666[6], says in paragraph 8. Its words are reproduced in the Kitzur Shulchan Aruch* of Rav Feldman. One should also consult the Darkei Teshuva*, chapter 19, paragraph 27, which I do not have.

I thank you in advance for your explanations and your clarifications — with an Alef*[7] — regarding all these points.

I have just obtained the Darkei Teshuva* cited above, and according to the interpretation of the Chatam Sofer*, 779 liters are necessary. This point is discussed in the first paragraph of the Shiyurei Torah*, which adopts a very lenient position in this matter, by the Arugat HaBosem* and by the Netivim BeMei HaYam*, volume 3, chapter 23, which has just been printed in the Holy Land*.

בת"ח הגיעני מכתבו מט"ו מ"ח, עם ההוראות שקיבל מכ"ק אדנ"ע בנידון המקוה.

ותיכף לקבלתו שלחתי העתקה מחלק מכתבו זה להשואל, כמובן בהוראת שמו, ומוסג"פ ג"כ העתקה כזו:

ומה שצ"ע בהשקפה ראשונה א) אם עושים ב' המקוות זו אצל זו - ישנה תמיד היכולת לבחון שלא חסר השיעור במקוה דמי גשמים (ע"י שנבלע בקרקע יום יום חלק מים שאינו ניכר להדיא. ע"י שנתמלא חלק המקוה עפר וכיו"ב), משא"כ כשהם זעג " ז , ולעתים קרובות מוסיפים בלאה"כ מים חמים וקרים במקוה העליונה, הרי אפשר שיעבר כמה זמן עד שיכירו שחסרים המים.

ב) לס"ד. שיעלו על הרצפה. אולי אפ"ל הטעם, כדי שלא יתקבצו ג' לוגים מים הבאים ממפעל העירוני במקום נמוך שבמקוה העליונה טרם שישיקו המים. ובכל אופן - כשירצו לנקות מקוה העליונה בלא התחתונה, איך יתנהגו?

ג) לס"ו. טבילה במתיחת כל הגוף. לכאורה דבר קשה הוא, כי המים מגביהים, וצריך להתאחז באיזה דבר, - ולהעיר מ"תיקון המקוה" לאדה"ז: ובידי' תאחוז כו' - ובמילא נעשו קמטים. וחומרו נעשה קולו.

ד) לס"ט. בקרקע החצר בכונה . לא הבנתי הפירוש והכוונה.

ה) לסי"ד. שעור מקוה תשכ"ו ליטר. תמי' קצת, שלאחרי כל החומרות דלעיל, לא רצו לצאת ידי דעת המגדיל שיעור מקוה עד כדי תשנ"ז וחצי או גם תשסב ליטר לערך (בתל תלפיות לשנת תרס"ו אות ח. והועתק בקצוש"ע של הרב פעלדמאן. ויל"ע בס' יט סקכ"ז דרכי תשובה ואינו עתה תח"י).

ות"ח מראש על ביאוריו והארותיו - באל"ף - בכהנ"ל.

המפתח בטח נתקבל כבר, ות"ח אם יודיעני מה שיש להעיר בו, ולהוסיף וכו'.
