Greetings and blessings,

I duly received your letter of Tuesday of Parshas Nasso, with its contents. Being yesterday (note: erev Rosh Chodesh) at the holy resting place (Ohel*) of my father-in-law, the Rebbe, whose merit protects us, I mentioned your name. Indeed, holiness never departs from the place it occupies, as stated in Iggeres HaKodesh*, chapter 27, and its commentary. It is therefore clear that a leader of Israel, when his soul ascends to heaven, continues to invoke Divine mercy for all who are connected to him, regarding all their concerns.

It is said that "on this day (note: Rosh Chodesh Sivan), they arrived in the Sinai desert" (Shemos 19:1), and I therefore conclude by evoking what is timely. Thus, in accordance with the formulation of our master, my father-in-law, the Rebbe, I wish you to receive the Torah with joy and in a profound manner.

P.S.: I am returning to you the Torah explanations of your son-in-law (note: Rav Yosef Geldtzeller; see letter no. 524), and as a token of friendship, I have quickly written a few notes, having only limited time:

"(note: this is the text of Rav Geldtzeller, annotated by the Rebbe) Tractate Bechoros 12b teaches that valuations are made at the time they are decided, that the redemption of the firstborn of man is performed after thirty days, and that the redemption of the firstborn donkey (peter chamor*) is immediate. The Gemara raises the following question: Is it not stated that the valuation, the redemption of the firstborn of man, that of the Nazir, and that of the firstborn of man cannot be performed before thirty days, even though they may be delayed indefinitely? Rav Nachman explains: This means that if a redemption has been performed, it is indeed valid. A priori, one must therefore wait thirty days, as for the firstborn of man, but if one proceeded contrary to this principle, an immediate redemption is also valid. However, the mitzvah* of redemption is not fulfilled in this manner, as Rashi clarifies at this reference.

Rav Sheshes explains that there was no transgression in this way — meaning that the mitzvah of redemption is indeed immediate, but transgression occurs only after thirty days. Rami bar Chama poses to Rav Sheshes the following question: It is stated that the firstborn donkey must be redeemed within thirty days and, beyond this time, slaughtered. Is it not a mitzvah to keep it during these thirty days, as Rav Nachman says, which would contradict the view of Rav Sheshes? He replies in the negative and specifies that the redemption can take place at any time during these thirty days. Then he objects: If so, one should say that after this period, either one redeems it or one transgresses this mitzvah. Finally, he concludes: According to Rava, there is no difficulty here. In one case, it is the view of Rabbi Elazar; in the other, that of the Sages. Rashi explains: According to Rava, it is a mitzvah to keep it. However, we do not accept Rav Nachman's explanation, and this raises no difficulty (note: thus, even though Rami bar Chama challenges Rav Sheshes, why is the essential distinction not stated — that subsequently one commits a transgression? This is how it should be phrased. However, in the manner the Rambam reports this teaching, no question arises; see note 11). For when it is said that one must keep it for thirty days, this follows the view of Rabbi Elazar, who compares the firstborn animal to the firstborn of man. There is therefore no difficulty in understanding that the Sages speak of immediate redemption.

The Rambam, in his Laws of Firstborn, chapter 12, paragraphs 6 and 20, says: 'From when must one redeem it? From its birth until thirty days. After this period, one may choose between slaughtering it and redeeming it. There is merely a delay of the mitzvah.' The Kesef Mishneh states that according to an established principle, the halachah* follows Rav Sheshes regarding prohibitions. This is why it is specified that in such a case, there is merely a delay of the mitzvah. This is the transgression of which Rav Sheshes speaks. Now, one may question this. For if the halachah follows Rav Sheshes, why did the objection raised against him say that one redeems or slaughters, when it should have said that one redeems or commits a transgression? There is no answer to this question, posed by the Mahari Korkos (note: the Rebbe notes at the bottom of the page: 'Of course, no question arises according to the Kesef Mishneh, since according to him, the delay of the redemption is a transgression').

In paragraph 1, the Rambam also writes: 'If he does not wish to redeem it, it is a positive commandment to slaughter it, as it is said: The firstborn of a donkey, you shall redeem with a lamb, and if you do not redeem it, you shall break its neck.' The Rabad objects to this, saying that slaughtering it is not a mitzvah, but on the contrary, a fault, a wrong, since one thereby withholds from the Kohen his due. Rav Yom Tov Algazi finds the source for both conceptions in the Mechilta, on Parshas Bo, which says: 'If you do not redeem it, you shall break its neck. This teaches us that the mitzvah of redeeming takes precedence over that of slaughtering. Another explanation: If you do not redeem it, break its neck. You caused the loss of the Kohen's property. Your property shall therefore also be lost.' The first explanation is based on the Mishnah on page 13a, stating that the mitzvah of redeeming takes precedence over that of slaughtering. The second explanation corresponds to the teaching of Levi on page 10b, requiring that he lose his property, inasmuch as he caused the Kohen to lose his. Such is the view of the Rabad, and the Rambam rules according to the Mishnah on page 13a.

Concerning the teaching of Levi, Rashi says: 'That is why he must lose his money. The court will compel him to slaughter it, at the end of thirty days, as this chapter explains, and it will be forbidden to derive benefit from it.' The later Sages question this: from where does he deduce that the court compels him? And if it strikes him, at the risk of endangering his life, as is the case whenever one refuses to fulfill a positive commandment, why not compel him instead to redeem it (note: the Rebbe notes: 'It is impossible to compel him to do what the Torah has made dependent on his decision, according to Yevamos 39b: if you do not redeem it, you shall break its neck'), which takes precedence over slaughtering? It appears that Rashi contrasts the teaching of Levi with the Mishnah on page 13a. According to Levi, slaughtering the animal is a fine imposed, whereas for the Mishnah, it is a mitzvah. Rashi deduces that both conceptions are correct.

How so? It is a mitzvah for the court to adjudicate the slaughter of the animal (note: the Rebbe notes: 'Perhaps one could say that this is also the view of the holy Zohar, according to the Rashbatz, on Commandment 19. But in fact, this is a third view, which is neither that of the Rabad, who holds it is not a mitzvah to slaughter, nor that of the Rambam, who writes in the Mishneh Torah and in the Sefer HaMitzvos, Commandment 82, that there is a mitzvah to slaughter, but not to have the court adjudicate. All the more so for one who speaks of a fine, when no such thing has been mentioned here'). It is the court that decides to impose a fine, in this case as in all others. Now, if the court decides on a fine, it is clear that it must do so after the allotted time. For if this were not the case, why would it impose the fine, when this man can still redeem the animal whenever he wishes? Likewise, the Gemara is correct in saying that he caused the loss of the Kohen's property. But why speak of loss if redemption is still possible? One must conclude that the fine of slaughter applies only after the allotted time. It is indeed in this sense that one can speak of loss of the Kohen's property. Rashi deduces that the court will compel him to slaughter it at the end of thirty days. As stated, the court then has a mitzvah to adjudicate the fine to be imposed for wanting to slaughter the animal.

Through this analysis, we will understand more precisely the terms of the Rambam, who writes in paragraph 6: 'At the end of thirty days, if he wants to slaughter it, he may do so; if he wants to redeem it, he may do so as well. One can then only reproach him for the delay.' But did he not specify in paragraph 1 that the option to redeem takes precedence over that of slaughtering? Why does he mention them here in reverse order? In fact, the explanation is as we stated. The mitzvah of slaughtering applies only when the time has passed — that is, according to our Sages' assessment, after thirty days. The Rambam deduces that at the end of this period, one slaughters rather than redeems (note: the Rebbe notes: 'It is impossible to make such a claim, for it is said: if you do not redeem it, you shall break its neck — meaning the condition for being able to slaughter is solely the desire not to redeem'), and he bases this on the teaching of Levi, as we have shown. In this matter, he therefore departs from Rashi's view and considers that by slaughtering, one performs a mitzvah, just as by redeeming.

What has been said resolves, in a satisfactory manner, the question of the Mahari Korkos. The Rambam does not repeat the exact terms of the Gemara upon which Rav Sheshes bases himself. He writes precisely that the option to slaughter the animal takes precedence over that of redeeming it, in order to emphasize that this redemption has a specific time. At the end of this period, the mitzvah of slaughtering begins. This is exactly what Rav Sheshes says — that transgression begins at thirty days (note: the Rebbe notes extensive further analysis reconciling the Rambam, Kesef Mishneh, Mahari Korkos, Tossefta, Mechilta of Rabbi Shimon ben Yochai cited in Torah Shelemah, and the Minchas Chinuch at the end of Commandment 23, with two alternative explanations for why the Rambam mentions slaughter before redemption in paragraph 6).

I heard an explanation, developed by my father-in-law, whom Hashem should grant long life, in the name of the Rebbe of Lubavitch Shlita, on the necessity of giving a gift to the young couple on the occasion of their marriage (note: see letter no. 5224 addressed to Rav Yalles). I thought that the simple explanation could be the following: Our Sages say that one who marries has all his sins forgiven. He therefore finds himself in the situation that prevailed before the sin — that is, before it was said: 'You shall eat bread by the sweat of your brow' (Bereishis 3:19). He can therefore earn his livelihood without any effort on his part (note: the Rebbe notes: 'According to this explanation, the same should be said of the convert and of one who ascends to a high position of authority')."

ובהיותי אתמול על הציון הק' של כ"ק מו"ח אדמו"ר זצוקללה"ה נבג"מ זי"ע הזכרתים, והרי כיון שאין קדושה נעקרה ממקומה (עיין אגה"ק סי' ז"ך בביאור) מובן שנשיא ישראל גם בעלות נשמתו השמימה עומד הוא ומעורר ר"ר על כל השייכים אליו ועניניהם.

כיון שהיום הזה באו מדבר סיני, אחתום מענינא דיומא ובלשון הרב הוא כ"ק מו"ח אדמו"ר, לקבלת התורה בשמחה ובפנימיות.

בבכורות דף י"ב ע"ב, תנן התם הערכין בשעתן ופדיון הבן אחר שלשים יום פדיון פטר חמור לאלתר. ופריך בגמרא ורמינהו אין בערכין ופדיון הבן ובנזירות ובפטר חמור פחות משלשים ומוסיפין עד עולם, אמר רב נחמן לומר שאם פדאו פדוי, דלכתחילה ימתין עד שלשים כפדיון הבן ובדיעבד לאלתר נמי פדוי, אבל עיקר מצות פדיון לא מקיים כדפירש רש"י שם. ורב ששת תירץ לומר שאינו עובר עליו, פירוש דלעולם מצות פדיון לאלתר ואינו עובר עליו עד שלשים יום, ומכאן ואילך עובר. ומתיב רמי בר חמא לרב ששת מדתניא מצותו כל שלשים יום מכאן ואילך אי פודהו עורפו, מאי לאו מצוה לשהותו כל שלשים יום כרב נחמן וקשיא לרב ששת, ומשני לא מצותו לפדותו כל שלשים יום, ופריך אי הכי מכאן ואילך או פודהו או עובר עליו מבעיא לו ומסיק אלא אמר רבא לא קשיא הא ר' אלעזר הא רבנן, ע"כ. ופירש רש"י אלא אמר רבא מצוה לשהותו ואפ"ה כרב נחמן לא מתריצנא ולא קשיא הוא דקתני כל שלשים יום מצוה לשהותו רבי אלעזר היא דמקיש בכור בהמה לבכור אדם והא דקתני לאלתר רבנן דלא מקשי, עכ"ל.

וברמב"ם פי"ב מהל' בכורים הל' ו' כ' וז"ל: מאימתי חייב לפדותו משיולד ועד שלשים יום, ומאחר שלשים יום אם רצה עורפו אם רצה לפדותו פודה ואין כאן אלא מצות עיכוב בלבד, עכ"ל. ובכסף משנה כתב דידוע דהלכה כרב ששת באיסורי ולפיכך סיים ואין כאן אלא מצות עיכוב בלבד דהיינו עובר עליו דקאמר רב ששת. וקשה אי פסק כרב ששת האיך כתב הברייתא שהקשו ממנה לרב ששת בלשונה או פודהו או עורפו ואילו לרב ששת הקשו דאו עובר עליו מיבעיא לי' ולא תירצו בה דבר, כן הקשה המהר"י קורקס ז"1ל.

והנה בהל' א' כתב הרמב"ם וז"ל: ואם לא רצה לפדותו מצות עשה לעורפו שנאמר ופטר חמור תפדה בשה ואם לא תפדה וערפתו והראב"ד משיג שם דעריפה אינה מצוה אבל עבירה ומזיק נקרא ומפסיד ממנו של כהן ע"כ. וברי"ט אלגזי כתב דשתי שיטות אלו יוצאים ממכילתא פ' בא וז"ל: אם לא תפדה וערפתו מכאן אמרו מצות פדי' קודמת למצות עריפה, דבר אחר אם אין אתה פודהו ערופהו הואיל ואיבדת נכסי כהן אף נכסיך יאבדו עכ"ל. דרש הא' הוא מתני' בדף י"ג ע"א דמצות פדי' קודמת למצות עריפה והשני היינו מה דתני לוי בדף י' ע"ב הוא הפסיד ממונו של כהן לפיכך יופסד ממונו, והיינו דעת הראב"ד והרמב"ם פסק כמתני' בדף י"ג ע"א.

והנה רש"י פירש גבי תני לוי וז"ל: לפיכך יופסד ממונו יכפוהו ב"ד לעורפו לאחר ל' יום כדמפורש בפרקא ויאסר בהנאה עכ"ל. והאחרונים הקשו מנא לן הא דב"ד כופין ואם הוא מדין מכין אותו עד שתצא נפשו ככל מצות עשה אמאי לא יכפוהו ב"ד על פדי'8 דפדי' קודמת לעריפה. ונראה דהוקשה לו לרש"י תני דלוי אמתניתן בדף י"ג ע"א דמתני דלוי משמע דעריפה קנס הוא וממתניתן משמע דמצוה הוא לפיכך ס"ל לרש"י דשניהם אמת, כיצד, דעריפה היא מצוה על ב"ד 3לדון הקנס דעריפה ככל דיני קנסות דמצוה על ב"ד לדונם ואם הוא מצוה על ב"ד ע"כ אית דין דלאחר זמן קצוב יש להם לדון הקנס דאי לא תימא הכי אימתי ידונו הקנס הא יכול לפדותו כל שעה, וכן מדוייק לשון הגמר' הוא הפסיד ממונו של כהן, וקשה אמאי קרי לי' "הפסיד" הא עדיין יכול לפדותו, אלא ע"כ דלאחר זמן מתחילה קנס דעריפה והיינו הלשון דהוא הפסיד ממונו של כהן לפיכך פירש רש"י דב"ד יכפוהו לעורפו לאחר ל' וכמו שבארנו דמצוה הוא על ב"ד לדון הקנס דעריפה.

אחרי הדברים האלה נדקדק בלשון הרמב"ם דכתב בהל' ו' ומאחר שלשים יום אם רצה לעורפו עורפו ואם רצה לפדותו פודה ואין כאן אלא מצות עיכוב בלבד, עכ"ל. וקשה הא פסק בהל' א' דמצות פדי' קודמת למצות עריפה ולמה כתב כאן עריפה קודם פדי' אלא הן הן הדברים אשר כתבנו דמצות עריפה מתחלת אחר זמן קצוב (ושיערו חז"ל אחר ל') לפיכך כתב הרמב"ם דלאחר ל' עריפה קודם פדי'4 ומקורו מתני דלוי כדבארנו, ובהא מיהו פליג ארש"י וסבירא לי' דעריפה היא מצוה כמו פדי'.

ולפי זה מיושבת קושית מהר"י קורקס ז"ל בטוב טעם דלשון הר"מ אינה לשון הברייתא דאיתותב מינה רב ששת דדקדק בלשונו וכתב דעריפה קודם פדי' לומר דפדי' זמן אית לה ולאחר זמן מתחלת מצות עריפה והיינו ממש דברי רב ששת דאמר שעובר עליו לאחר 5שלשים.

על מה ששמעתי מאמר מכ' חותני שליט"א בשם אדמו"ר מליובאוויטש שליט"א אודות ענין נתינת מתנות לחתן וכלה ביום חופתם חשבתי על דרך פשוט כיון דאמרו חז"ל דמוחלין לו כל עוונותיו הוא בבחינת קודם החטא וקודם גזירת בזיעת אפך תאכל לחם וממילא פרנסתו היא בלא 6יגיעה.

5) דעובר עליו לאחר ל' יום. - עפ"ז עכצ"ל דל' "מצות עיכוב" שברמב"ם, היינו - עובר עליו (כפי' הכס"מ. ושהרי"ק אומר שאין לפרש כן). - וא"כ שוב א"צ לכל השקו"ט לתרץ קושית הרי"ק, כיון דקושיא מעיקרא ליתא. דהיינו התוספתא וכר"ש, וכהכס"מ.

והנה הצ"ע ברמב"ם ה"ו הוא מה שהקדים עריפה לפדי'. וי"ל בשנים: א) לדעת הרמב"ם עריפה מתחלת "מאחר ל' יום",

אולי מקורו מתוספתא הנ"ל. ואף שמקשה בש"ס דאינה כר"ש - ס"ל להרמב"ם דאף הפוסקים כר"ש - לא ידחו מהלכתא מפני קושיא זו. וכ"פ נמצא עד"ז ברמב"ם. ובכל אופן - הוא דלא כמכילתא דרשב"י הובאה בתורה שלימה: את שלא בא לכלל עריפה לא בא לכלל פדי'. ועייג"כ במנ"ח סוף מ"ע כג.

ולכן פתח בעריפה - שכולו מחודש לאחר ל' יום.

ב) כיון דתיכף לאח"ז בא הדין "לא רצה לפדותו" סמכו ענין לו לפדי'. ובמילא הוקדמה עריפה. וידועה דייקנותו של הרמב"ם גם בסידור הענינים. ובפרט בפרק זה עצמו מוכרח לבאר באופן זה סידור דברי הרמב"ם - בהט"ז. וק"ל.

6) לטעמי' - גם בגר ובהעולה לגדולה צ"ל כך.
