Igrot Kodesh · Letter 544 — Rosh Hashanah and Sukkot Halachic Practices
Volume 3 · Letter 140
By the grace of Hashem,
17 Mar'Cheshvan 5710[1],
I greet you and bless you,
I received your letter in due time and my reply was delayed due to my many activities. I respond to your questions:
A) The apple is eaten on the first night of Rosh Hashanah*, at the beginning of the meal, after reciting the blessing of HaMotzi*[2]. The new fruit is eaten on the second night, before washing one's hands for the meal[3]. Consult the pamphlet published for Shabbat Shuvah*, page 30.
The reason for this distinction is quite evident. The apple, independently of the fact that it must be dipped in honey, may be eaten before or after washing one's hands. It is therefore preferable that it be after, so that the beginning of the meal be as close as possible to the Kiddush*.
The new fruit, on the other hand, must be eaten before washing one's hands for the beginning of the meal, in order to preserve the benefit of the blessing of Shehecheyanu*, which pertains to it[4].
B) The Yehi Ratzon* recited over the apple[5] is said after the blessing Bore Peri HaEtz*[6] and before eating it. This may be inferred from the formulation adopted by the Siddur* of the Admur HaZaken*, 'one shall then say,' which differs from that of the Shulchan Aruch*.
C) The Shulchan Aruch* of the Admur HaZaken*, Orach Chaim*, chapter 608, speaks of 'milk-based and butter-based foods' and refers to the Magen Avraham*, which says: 'warm milk-based foods'[7], based on the Rambam*, Laws of the Yom Kippur* Service 1:6. You ask me whether the Shulchan Aruch* of the Admur HaZaken* should not be corrected accordingly.
Indeed, who speaks of butter in the Talmud* or among the Decisors*? Your remark therefore appears entirely well-founded. Another proof: why speak here of butter? Is it not also a milk-based food? And it is for precisely this reason that cheese is not mentioned in this text, whereas it is cited in tractate Yoma* 18a. Nevertheless, in all the editions of the Shulchan Aruch* of the Admur HaZaken* I have seen butter is indeed mentioned. This is also the version of the Netiv HaChaim*.
Why does the Admur HaZaken* specifically prohibit butter? Because it is particular among milk-based foods, in that it is never consumed on its own. Furthermore, if it also refers to cream, it can be defined as a liquid.
Moreover, one may ask why the Admur HaZaken* speaks here of milk without specifying that it is warm. One may cite in this connection tractate Nazir* 23b[14]: the story of Yael* and Sisera* — she gave him milk and butter. The commentators explain that milk induces sleep. And one may ask, as tractate Yoma* 18a does, why she also gave him butter.
D) The Admur HaZaken* writes in his Shulchan Aruch* Orach Chaim*, chapter 639, paragraph 13, that one who leaves the Sukkah* and does not return immediately, but 'an hour or two later,' must recite the blessing[17] again. In paragraphs 25 and 29, it is stated regarding Tefillin*, 'after a long interval, for example two or three hours[18]', and you ask me why a distinction was made between Tefillin* and the Sukkah*.
The Ketzot HaShulchan* of Rav H.A. Na'eh raises this question in his laws of Tefillin*, chapter 163 of the Badei HaShulchan*. He cites the commentary of Rashi* on tractate Yoma* 30a, according to which, after an hour or two, one no longer thinks about one's meal[21].
I will offer my own explanation. One may indeed distinguish four cases:
1) The Sukkah*, for which the interruption is assessed at one or two hours.
2) Tefillin*, for which it is two or three hours.
3) Tzitzit*, for which many hours are required, according to the Shulchan Aruch* of the Admur HaZaken*, chapter 8, paragraph 23.
4) Fragrance, for which the blessing is recited once per day according to the Turei Zahav*.
It seems to me that the following explanation may be offered. A lapse of time is always assessed in its context. The Sukkah* is essentially the place where meals must be taken. The time for wearing Tefillin* is the duration of prayer. The Tzitzit* of the large Tallit* have no fixed time, but in any case their duration is longer than that of Tefillin*.
Generally speaking, the duration of a meal is one hour, as evidenced by the comparison our Sages draw in tractate Berachot* 55a. The time of prayer generally exceeds an hour and a half, as the first chapter of Iggeret HaKodesh* states.
Tractate Berachot* 32b reports that the early Chassidim* prayed for three hours. And the Pri Etz Chaim*, Gate of Prayer, chapter 7, adds that the trace of this prayer in the intellect must be maintained throughout the day.
