Greetings and blessings,

I am responding to your letter of the conclusion of Shabbos*, describing the situation in your building. The institution that is housed there is unable to cover its expenses (see note 1) and there is now a solvent buyer who has come forward.

You do not indicate in your letter for what purpose the buyer intends to use this building once he has acquired it. You say, indeed, that it is designed to house an institution, but not for private residence. He himself will therefore also be subject to this limitation.

Of course, if he intends to install an educational institution that goes against the Torah, this raises the problem of aiding... (see note 2). But another aspect makes this question even thornier. Until today, there has been a good school in this building. The parents have noted the address and do not necessarily have the time to verify whether or not there has been a change of institution. Even if the name is changed, this will not necessarily be sufficient.

If this risk is excluded and if — the essential point — it is absolutely impossible for this institution to sustain itself (see note 3), all the more so since it provides a good education which, in our era, literally saves lives, then you may indeed consider this transaction.

I am surprised that in your letter you say nothing of your activities aimed at disseminating the wellsprings* (see note 4) to the outside and at using the abilities that Hashem has granted you in this regard. Our Sages say, indeed, that "the Holy One, blessed be He, made nothing in vain in His world." However, those who do not have free will necessarily act in the appropriate manner (see note 5), whereas this is not the case for a Jew, of whom it is said: "Man will be like Us," as explained in the Likkutei Torah* Emor*, page 38b. Days, months, or more can therefore pass during which these words of our Sages do not apply (see note 6). This is self-evident.

במענה על מכתבו ממוצש"ק, ותוכנו המצב בענין הבית שלהם שב... שהמוסד אשר בו אינה מכסה הוצאותיו וכו' ועתה מזדמן קונה מתאים.

והנה אינו מזכיר במכתבו מהי תכנית הקונה לשמושו בבית זה לשיקנה אותו, שכיון שכותב שהבנין מתאים רק למוסד ולא לדיור פרטי, הרי הגבלה זו חלה גם על הקונה, ומובן שבאם דעתו שיהי' שם מוסד חינוך נגד התורה הרי, מלבד שיש בזה שאלה דמסייע ידי כו', מתוסף פרט המחמיר שאלה זו, שבבנין זה עצמו נמצא עד עתה מוסד חינוך כדבעי והכתבת והבית ימשיכו ההורים שאין זמנם פנוי להתבונן אם חל שינוי בהחינוך בבית זה עצמו או לא. ואפילו אם ישנה השם - לא תמיד מספיק זה.

באם איןמקום לחשש האמור ועוד הוא העיקר שאין בשו"א היכולת לעשות המוסד חי נושא את עצמו, ומה טוב בשטח החינוך הכשר, שבתקופתנו זהו הצלת נפשות ממש, אז יש להתענין בענין מכירתו הנ"ל.

לפלא שבמכתבו אינו מזכיר כלל אודות פעולותיו בהפצת המעינות חוצה וניצול כשרונותיו אשר חננו השי"ת בהם בשטח זה. ואף שאמרו רז"ל שלא ברא הקב"ה בעולמו דבר אחד לבטלה, מובן שבהנוגע לאלו שאין בחירתם חפשית, בטוחים שמנוצלים הם מתאים לתפקידם, משא"כ באיש הישראלי שעליו נאמר הן האדם הי' כאחד ממנו (עיין לקו"ת אמור לח, ב) אפשר שיעברו ימים חדשים ועוד יותר - שלא בהתאם למרז"ל הנ"ל בהנוגע לבע"ח. וד"ל.
