To the great Rav*, the distinguished Chassid* who fears Hashem and devotes himself to communal needs, of multiple accomplishments, Rav* Sh. Y. (see note 1),

Greetings and blessings*,

Here is the essential subject of this letter. Yesterday, I had a visit from Rav* Hollander (see note 2). He told me, among other things, that while in Kiev, he went with his companions to the home of the rabbi of the city, Rav* Panitch. Someone was present there who introduced himself as the husband of the sister of the wife, in her first marriage, of Rav* Zevin shlita*. I have no other details. It seems to be an elderly man, who must be about eighty years old. He added discreetly that during the night, he turns off the light and listens to radio broadcasts from the Holy Land (see note 3).

I understood that Rav* Hollander had not yet informed you of all this. He is very busy and I even wonder whether he will do so. That is the reason I am writing you these few lines.

You have surely received my telegrams. I will add to them what Rav* Valgelernter told me. He himself will address, perhaps even by telegram, the chief rabbis regarding the question of the ships (see note 4), in general, and of the one that is to travel on 22/8, in particular.

At the conclusion of a lengthy discussion we had on this subject, he (see note 5) was not able to give me a single reason, even the weakest, in this matter. I did, however, cite in our discussion what the newspapers of the Holy Land say about the alleged "force majeure situation." Indeed, "if expenses increase, there will be fewer and fewer travelers and, ultimately, these voyages will disappear completely."

Likewise, someone cited to me yesterday a curious explanation: "If the ship stops for a day or two in the middle of its voyage, the resulting security costs will be very high. Prices will increase and there will be fewer travelers." It is, of course, laughable to consider that this would be the case.

In this regard, one can verify how accurate it is to say that "by wanting to deepen your understanding (see note 6)..." Indeed, the will distorts understanding, sometimes even in a frightful manner. Someone here wants to grant permission (see note 7) and finds no logical reason to do so. He therefore justifies his position by advancing the following typical reasoning, known to those who attend the Yeshivah* and formulated with profound seriousness:

"If one claims that this voyage is forbidden because the ship might stop in a port, why do the later Sages* discuss the possibility of traveling when the sailors are Jewish? One must therefore conclude that this voyage is permitted."

Naturally, he immediately added that according to this "reasoning," the ship owners have the right to make them travel during Shabbos*. Indeed, the earlier and later Sages* who discuss this question of a ship belonging to Jews do not specify that these owners deviate from Jewish practice.

In fact, I would not even have mentioned all this if I did not fear that in the Holy Land, all these arguments would be used — indeed, that the force majeure situation, the possible disappearance of these ships in a few years, as has been said, would be put forward.

I will also explain the content of the telegram. According to the description of the situation, based on information I obtained unofficially, it is quite clear that if there were no pressure exerted by the rabbinate and the travelers, the management of Zim would not accept the prohibition (see note 8). Moreover, a new argument has recently been introduced, according to which "these voyages have been a fait accompli for years already."

Conversely, if the rabbinate and groups of travelers firmly demand, saying that if they do not obtain satisfaction they will no longer use these ships, it is certain that the management of Zim will seek an arrangement, at least for some ships.

That is why I emphasized in my telegram that even if it were possible to find a dispensation for the travelers — on condition that they not drink the fresh water on board, not use it for washing, and forgo comfort, conditions that most would naturally not observe — such a dispensation would in fact be nullified by the prohibition on the ship owners (see note 9).

Furthermore, I learned, to my great surprise, from Rav* Valgelernter, that someone is being sought, perhaps possessing some knowledge of mechanics, who would inspect the ship while it is in motion in order to see how it is steered and how the machines function. Naturally, difficulties arise, and I am deeply surprised. But, for the moment, no one has requested the ship's log from recent weeks, which records the actions and operations carried out on the ship in a clear and detailed manner. I pointed out that this was the easiest verification to make, and he was unable to respond.

On this matter, the young emissaries (see note 10), may Hashem grant them long life, reported here that Rav* Franck had complained in their presence about not knowing the content of my letters. Nevertheless, from what he had heard about them, he would share the same opinion. This led me to request by telegram that my letters be shown to him.

For the time being, I am keeping here the analysis prepared for the newspapers on the problem of the ships. Only what was written in the Holy Land has been printed here. Nevertheless, if this situation persists, I fear that the entire matter will be publicized to the general public. This is an additional reason establishing the necessity of resolving this situation as quickly as possible.

One must also learn a lesson from all this. The verse says: "Ah, they draw sin with cords of vanity." At the beginning, the ships departed from here several days before Shabbos*. Then, one apparently saw that everything went well and all was calm. So they began to have them depart also on the eve of Shabbos*.

Naturally, they do not depart exactly at daybreak, which is in any case impossible, because several administrative procedures are necessary before a ship leaves port. And the offices maintain their closing hours, except in very exceptional cases. They do not work overtime and do not begin their day earlier. Generally, the ships therefore depart around noon and sometimes even later.

This also went well, without any reaction. A new development has therefore been introduced this year. According to the schedule, a ship departs from here on the eve of Yom Kippur*. And, parenthetically, based on what has just been said, all the sailors know that in addition to the administrative procedures, it is also necessary, in order to leave major ports with heavy traffic, for the ocean liners to be towed out to open sea. Only then do the actual maneuvers begin on the ship, its engines start, while the tugboat returns to port. This too takes a great deal of time and sometimes even several hours.

In addition, when passengers board, several hours are also needed, particularly to update the lists, the records, the receipts for everything that has been deposited, the changes from one cabin to another compared to what is recorded in the ship's logs. Generally, these operations last many hours. Naturally, if the voyage begins in the afternoon on the eve of Shabbos*, they are completed long after sunset and the appearance of the stars.

But for my part, I think all these details are unnecessary, since there is a far graver point here (see note 11). My purpose (see note 12) is solely to show you how much the ship owners and all those who have traveled on the eve of Shabbos* mislead public opinion. Indeed, it is impossible that they do not know all this, since they have experienced it themselves. Despite this, they loudly proclaim that no work is performed, that there is not the slightest risk of prohibition in this matter. Yet it is precisely their words that are heard.

Rav* Hanzin (see note 13) asked me, also in your name, whether my letters should be reproduced or photocopied and sent to various Rabbanim* in the Holy Land. Intrinsically, it is very wise that they themselves (see note 14) know how these ships operate. It seems, indeed, that nothing is known about all this. Nevertheless, should they be sent by mail? For various reasons, negative reactions may be feared.

In my opinion, it would therefore be easier to find a Chassid* in each place where members of the chief rabbinate are located, who would take the initiative of making a personal visit to them and, during this visit, show them my letters or leave them a copy. This Chassid* will be told what answers to give to questions that may be asked.

If it is accurate, as I deduced from Rav* Valgelernter's remarks, that all members of the rabbinate must be convinced, one must first see how all this can be put into concrete practice. It is clear that if expenses result from this, for example for photocopies, I would be happy to cover them. Naturally, you may, in my name, urge to action all the Chassidim* who can act in this matter. Nevertheless, one must consider whether it is good to make a great deal of publicity about all this.

I hope that you have spoken, in the appropriate manner, with Mr. Shazar (see note 15) about the expenses occasioned by the journey of the emissaries, may Hashem grant them long life. Naturally, it is not good for this to become an outstanding debt. For him, it is surely easier to grant a subsidy from his fund shortly after their visit, rather than many weeks after it.

I do not yet know precisely the cost of this trip and the expenses in the Holy Land. It seems, nevertheless, that the amount is higher than what I expected. May Hashem grant that the contribution of their visit justifies this expense, even taking into account the limit of financial possibilities — indeed, that it far exceeds it.

I have just learned of a curious rumor, according to which a Rav* expelled two young men from his Yeshivah* because they studied Chassidus*. Is this report true?

I have just learned that in the coming months, starting from Tishrei*, and although the days are getting shorter, it has been decided that all Israeli ships will depart from here on the eve of Shabbos*.

על של עיקר באתי, אשר אמש בקרני הרב האלענדער שי', ובתוך הדברים סיפר שבהיותו בקיוב ביקר עם חבריו אצל הרב דשם פאניטש, והי' נוכח אחד שאמר לו שהוא בעל אחות אשתו (בזווג ראשון) של הרב זוין שליט"א (יותר פרטים אודותו איננו יודע).

ומראהו כזקן בן שמונים לערך. ובסוד הוסיף שבלילה מכבה את הנרות ושומע ע"י הרדיו לשידורים מאה"ק ת"ו. וכיון שהבנתי מדברי הרב הולונדר שי' שעדיין לא הודיע לכת"ר עד"ז, ומטרדותיו - מסופקני מתי יודיע, לכן באתי בשורותי אלו.

בודאי נתקבלו שני המברקים שלי, ועליהם להוסיף, אשר הרב וולגלרנטר שי' אמר לי, שגם מצדו יפנה - ואפשר גם במברק - להרבנים הראשים בקשר עם המצב בהבעיא דאניות בכלל, וביחוד בקשר עם האני' שתכניתה להפליג /8;22amp&. ולאחרי אריכות השיחה עמדי... לא הי' בידו לאמר לי אף טעם אחד בזה, אפילו טעם קלוש אף כשצטטתי בשיחתנו מה שהי' כתוב במכ"ע דאה"ק ת"ו "הטענה" דפקוח נפש "כיון שבאם יהיו הוצאות יתירות ילכו הנוסעים הלוך ופחות, ובמשך הזמן אפשר שתתבטל הנסיעה בכלל וכו'", כן הביאו אלי אתמול עוד טעם משונה, שע"י "העגון בדרכה יום או יומים יותר - דמי הבטחון עולים ביוקר יותר, ויתייקרו המחירים וילכו הנוסעים הלוך ופחות וכו'". ומובן כמה חוכא וטלולא בזה אפילו בתור קס"ד.

דא"ג - גם בזה יש לראות עד כמה צודק הענין דאגב חורפא וכו' ושהרצון מטעה את השכל, ולפעמים גם באופן מבהיל, שאחד כאן הרוצה להתיר ולא מצא כל טעם בשכל, מנמק הקס"ד שלו בסברא (טפוסית - אפשרית בבני ישיבה), אף שמדבר אודותה ברציניות עמוקה, והיא: את"ל שהנוסעים בכגון דא אסורים לנסוע כיון שאפשר לעגן האני' וכו' הרי על מה קאי השקו"ט באחרונים באופן היתר הנסיעה כשהמלחים הם יהודים, וע"כ שזה גופא מוכיח שגם אז מותר. ומובן שתומ"י הוסיף "שראי" זו מוכיחה שגם לבעלי האני' מותר להסיע אניתם בשבת, שהרי לא כתבו בראשונים ובאחרונים המביאים השאלה באני' שבעלי' בנ"י, ולא הדגישו בפירוש שאין בעלי האני' צייתי לדין ישראל.

באמת לא הייתי מצטט אפילו את זה, אלא שחוששני שגם באה"ק ת"ו ישתמשו בנימוקים אלו, ובמכש"כ וק"ו שמנמקים שפקוח נפש בדבר כיון שלאחר כמה שנים אפשר שיבוטלו האניות וכו'. וכנ"ל.

בביאור להכתוב במברק - כפי שמתארים המצב עפ"י הידיעות מאחורי הפרגוד, הנה ברור הדבר שבלא לחץ מצד הרבנות והנוסעים לא תציית הנהלת צים לאיסור, ובטענה חדשה שנתחדשה זה עתה בבית מדרשם "שכבר חזקת כמה שנים לנסיעות הנ"ל". ומאידך גיסא, אם הרבנות וכתות נוסעים ידרשו בתוקף המתאים, זאת אומרת שבאם לא ימלאו דרישתם לא יסעו באניות, ברור שתשתדל הנהלת צים לסדר הענין (עכ"פ באיזה אניות), ולכן הדגשתי בהמברק, שאפילו אם הי' מקום לאמר שאפשר למצוא צד היתר לנוסעים (באם לא ישתו וירחצו בהמים מתוקים באני', לא ישתמשו בהנוחיות וכו'. כמובן, תנאים - שרובא דרובא לא יקיימו אותם כלל וכלל) - הנה היתר זה יבטל - במציאות - את האיסור לבעלי האניות.

עוד יותר נודעתי - בתמי' גדולה - מהרב וולגלרנטר שי' שמחפשים עצות שמי שהוא (מבין במכונות?) יבקר באני' בעת שהיא פועלת, בכדי לבחון אופן הנהלתה ופעולתן של המכונות, וכמובן נתקלים בקישוים בזה (ולגודל תמיהתי), ושעד עתה לא דרש מי שהוא את היומן של האני' - בעבר במשך השבועות האחרונים - שבו נרשמות כל הפעולות ומלאכות שבאני' ברור ומפורט, וכששאלתיו - הרי זה בירור היותר פשוט, לא הי' בידו מה לענות לי.

דא"ג השלוחים האברכים שליט"א מסרו בכאן שהרב פרנק שי' התאונן לפניהם שאינו יודע תוכן מכתבי, אף שכפי ששמע אודותם גם דעתו נוטה כן. וזה הביאני לבקש במברק שיראו להנ"ל את מכתבי.

מעכב הנני לע"ע את השקו"ט במכ"ע כאן אודות בעיות האניות, ונדפס כאן רק מה שכתבו מאה"ק ת"ו. אבל אם יתארך המצב יותר, מסופקני אם לא יתפרסם הדבר ברשות הרבים ממש... וזהו טעם נוסף על נחיצות בירור המצב ככל האפשרי בהקדם.

מוסר השכל יש ללמוד גם מענין האמור, ע"ד מ"ש הוי מושכי העון בחבלי השוא וגו' - שבתחלה היתה האני' מכאן מפליגה איזה ימים לפני השבת, וכנראה לאחרי שראו שהכל שלום ושלוה, התחילו להפליג גם בעש"ק. וכמובן לא תמיד דוקא "בעלות השחר" (דא"ג אי אפשרי הוא, כיון שיציאת אני' מהנמל קשורה בכמה פעולות של משרדי הנמל, ופרט למקרים יוצאים מן הכלל בתכלית אין הם - המשרדים - מוותרים על מנוחתם, ואין הם מוסיפין ומקדימים שעות עבודה. שלכן, עפ"י הרוב, התחלת היציאה מן הנמל - קרוב לחצות היום, ואולי עוד מאוחר). וכשגם זה עבר בשלום ולבלי תגובה, חדשו בשנה זו שע"פ התכנית תפליג אני' מכאן בערב יום הכפורים (ובהתאם להנ"ל במוסגר, הנה מלבד הפעולות המשרדיות ביציאת האני' מהנמל, הסדר, כידוע לכל ימאים, שבנמלים בעלי תנועה גדולה ורבה, האני' מוצאת מן הנמל ע"י אנית עזר המובילה אותה מרחק גדול מן החוף והנמל, ורק אח"כ מגבירים פעולות האניה והאנית עזר חוזרת לנמל, והאני' מפליגה במכונות עצמה, שגם זה מתארך כמה זמן, וע"פ הרוב כמה שעות. נוסף על האמור, הרי לאחרי כניסת הנוסעים לאני' מתארך כו"כ שעות עד שמסדרים כל הרשימות, הפנקסים, כתיבת קבלות על הדברים המופקדים, שינוים מחדר אחד לשני הנרשמים בספרי האני' ועוד ועוד, שברובא דרובא זהו נמשך שעות מרובות ביותר. ומובן - כשהפלגת האני' מתחלת לאחרי הצהרים בעש"ק מסתיים כל הנ"ל כמה זמן לאחר השקיעה וצאת הכוכבים).

והנה לדידי - אין צריך לכל הנ"ל, כיון דקם לי בדרבה מני', ולא באתי בזה אלא להוכיח גניבת דעת הקהל ע"י אנשי האני' וע"י כל אלו שנסעו באניות המפליגות בעש"ק, שאי אפשר שאינם יודעים ע"ד הנ"ל, שהרי בדידהו הוה עובדא, ובכל זה הם הצועקים בקול גדול שאין כל מלאכה ואין כל חשש איסור כו' וכו' (ודוקא דבריהם מתקבלים).

שאלני הרב חנזין שי' וגם בשם כת"ר שי' - אם לעשות העתקה או צלום ממכתבי ולשלחם לכמה רבנים באה"ק ת"ו - והנה אף שמצד עצמו נכון הדבר במאד שידעו גם אלו מאופן הנהלת האני' וכו', וכנראה שאין ידוע כלל עד"ז, אבל באם לשלוח הנ"ל ע"י דואר וכיו"ב, מכמה טעמים יש לחשוש לתגובות בלתי רצויות. ולדעתי בנקל יש למצוא אחד מאנ"ש בכל אתר ואתר דמושב חברי הרבנות הראשית וכיו"ב - שיבקרם על דעת עצמו, ובהזדמנות זו יראה לו או גם יתן העתק מכתבי. וישימו דבר בפיו - של הא' דאנ"ש - מה לענות בבירור השאלות שישאלוהו בזה.

באם נכון כמו שהבנתי מהרב וולגלרנטר שי' שצריך לגייס דעת כל חברי הרבנות, יש להתענין ביותר בהבאת הנ"ל לפועל . ומובן שאם קשורות בזה הוצאות - צילום וכו' - יסלקו אותן בת"ח. ופשוט שברשותו לגייס בשמי את המתאימים לזה מבין אנ"ש, אלא שפרסום יתר בזה - צ"ע אם רצוי הוא.

תקותי שהתדבר כפי הדרוש עם מר שזר שי' בענין דהוצאות נסיעות השלוחים שליט"א. שמובן שאין כדאי שיעשה הדבר חוב ישן. וגם בשביל הנ"ל נקל בטח יותר לתת מהקופה בקירוב זמן לביקורם, מאשר כמה שבועות לאחרי זה... עדיין איני יודע בדיוק הוצאות הנסיעה והאש"ל באה"ק ת"ו, אבל כנראה שהוא יותר ממה ששיערתי. ויה"ר שתועלת שתבוא ע"י ביקורם - תצדיק את כל ההוצאות, אפילו בהתחשב עם המצב הדחוק בהקופה, ולא עוד אלא שתעלה עליהם כו"כ.

מוסג"פ מה שהו"ל בזמן האחרון, ובטח יזכה בתוכנו את הרבים וזכות הרבים תלוי בו.
