To the great Rav, distinguished Chassid* who fears Hashem and devotes himself to communal needs, of manifold knowledge, Rav Sh. Y. (see note 1),

I greet you and bless you.

I have duly received the seventh volume of the Talmudic Encyclopedia. As with the previous volumes, this one does not "conclude the Hallel*" (see note 2), given the numerous points mentioned in each article and their harmonious arrangement. Another point, equally essential — one can find in practically every article new ideas, even for those who devote themselves to these subjects. The only problem is the long period that elapses between the publication of each volume.

It is certain that expenses should not be taken into account and that one can arrange for you yourself to devote yourself exclusively to what no one else can do — that is, for you to be freed from all the technical aspects.

One counsels diligence to those who naturally possess this quality, and it is therefore important that these volumes appear more frequently, as I told Rav Hutner when he visited me. Indeed, books arranged in alphabetical order have a particular characteristic: as long as the volume for Tav has not been published, the volume for Aleph is considered incomplete.

A note from Rav Hutner is enclosed with this volume, and no doubt it conveys what you yourself wrote, and this is what was sent.

I am led to return once again to what is painful and distressing — the problem of the ships (see note 3) — to mention two points, one encouraging, the other running counter to that sentiment.

A) The Bnei Akiva* class that was to travel to Eretz Yisroel* has announced that it would not use, for this purpose, an Israeli ship that travels on Shabbos*.

And this class officially made known the reason for its position. It wrote, unambiguously, that such a voyage constitutes a desecration of Shabbos according to the Torah*, based on the practices in force on these ships.

Furthermore, the class asked for an official response telling them whether there was a way to organize this voyage without that (see note 4).

B) I have just received a clipping from Yediot Acharonot (see note 5), apparently from 2 Menachem Av. It is an article by Yirmiyahu Halpern, whose title is: "The representatives of Shoam (see note 6) negotiate with the Chief Rabbis." The account of this negotiation is appalling, and I will not reproduce its terms, for you will read the article yourself. I would only like to add one point that Halpern apparently omitted, and it is difficult to know why he did so, since in any event it will become known. But perhaps the account does not correspond to reality and this negotiation actually took place in an entirely different manner.

The point I wish to add is the following. It is clear that the discussion does not concern the commercial fleet, for, to our shame and before all the nations, the commercial ships do not even raise the question (see note 7), and among ourselves, one can genuinely wonder whether they would even follow an instruction given to them in this matter. It is therefore precisely passenger ships that are at issue, which transport merchandise only incidentally. Moreover, a large portion of these goods are, in fact, the luggage of the travelers, for it is clear that one cannot charge as much for merchandise as for passengers. One therefore avoids the former and accepts them only at a certain price. This is well known.

A surprising argument is therefore advanced: one should now permit a desecration of Shabbos according to the Torah because, in time, these ocean liners might become warships. This would be laughable, if the subject were not so painful.

Similarly, it is proposed that merchandise no longer be sent on these ships. In practice, this is not so, for most of the passengers on Israeli ocean liners — for example, those of the Zim company — and the commercial goods they carry could travel on other ships, which are more comfortable. It is only out of love for Yisroel that these are preferred, even at the cost of lesser comfort and greater expense.

Naturally, every assertion must be demonstrated, proved, supported. Therefore, if one enters a ticket office for these ships and asks about the conditions that exist on these ships compared to others, one will be able to verify what has just been said — provided, of course, that the office gives information that corresponds to reality.

You refer, in your report, to automation. In my two letters, I have already written to you what I knew about this. And I explained that, despite this, someone does not hesitate to say that the navigation (see note 8) can be automatic. This can be likened to deception, for even if it is true that the ship is navigated automatically, one must nevertheless, from time to time, make adjustments and, very often, modify them several times during the twenty-four hours (see note 9).

Moreover, there is an international practice whereby, at the changing of the shifts responsible for the operation of the machines — every four hours, that is, six times in twenty-four hours — the mechanic of the new shift must verify all the machines in operation, particularly those that direct the ship and those that control them. To perform this verification, one must operate the wheels and levers to confirm that everything is in working order. The same applies to the inspection of the water, oil, or fuel tanks, the boilers, and the air supply to these boilers. This verification has the effect of increasing or decreasing the heat, the oil, or the fuel — that is, of extinguishing or igniting fire.

I will add another point. I was asked here why this question is being raised precisely now, when these ships have existed for several years already. I replied that this question was not addressed to me, but to the Chief Rabbinate or to the rabbis who, here, devote themselves to these matters. In any event, this objection changes nothing about the question being asked and the decision that must be made. Whatever the reason why the question was raised only now, the Torah and the mitzvos* are no less eternal, and they have, at the present time, the same validity as a few years ago.

Similarly, I was asked why I intervened in this matter precisely now. I replied by describing the reality. A few weeks ago, someone approached me and asked for a blessing on the occasion of a departure to settle in Eretz Yisroel. I was also asked about how to make this voyage. Naturally, my response conformed to the Shulchan Aruch*, according to which there is a definitive prohibition against traveling on these ships, and an even clearer prohibition, based on the Torah, against operating them on Shabbos. It is clear that the first prohibition concerns the travelers and the second, the owners of the ship, as I specified at length in my two letters to the Chief Rabbis.

This response was disseminated to several groups of travelers, and I was asked why I had not communicated my opinion to the Chief Rabbinate, since the latter permits such voyages. I therefore addressed the Chief Rabbinate in order to clarify all of this.

Based on what I now observe — and you will excuse me for saying so — the position adopted to date (see note 10) is explained by a lack of knowledge of the technical aspect of the situation.

Another point, equally essential, must be added. My purpose is not to predict the future, but given the situation that prevails here, if the Chief Rabbis issue a definitive prohibition, one could organize the voyage of these ships from here so that at least some of them travel in a manner permitted by the Shulchan Aruch — that is, by making a stop in a port for Shabbos. If I had the ability, I would even say that this is a one hundred percent certainty, on condition that this position is not presented as an action intended to defeat the left-wing parties in the Holy Land.

The halachic* decision of the Chief Rabbis must leave no room for any alleged permission, such as the one appearing in the account of the aforementioned article, according to which one may permit this voyage on condition that Shoam provides a written commitment that a non-Jew will relight the boilers if they go out on Shabbos. One can imagine that no one would be troubled by making such a commitment. Naturally, nothing would be resolved even if this commitment were kept, as I have shown at length in my previous correspondence. Indeed, even if the boilers do not go out, there are dozens of labors forbidden by the Torah that are performed on a ship, for which a specialist is necessary.

You refer, at the end, to the response that can be given to another question I was asked. Do I genuinely have hope that such a prohibition will be pronounced? In general, I am not truly optimistic, particularly regarding the areas of intervention of the parties in the Holy Land, especially the religious parties. Despite this, I am convinced that in this case, one will succeed without difficulty. One will obtain that at least some ships travel in a permitted manner.

Here, the proponents of the left-wing parties themselves say that if the Chief Rabbinate had issued a prohibition in this matter, a different organization would have been adopted. Certainly, one can suspect them of not keeping their word. Nevertheless, all of this was said under the pressure of Orthodox public opinion here. It could therefore be so, at least for some ships.

I did not write all of this directly to the Chief Rabbinate, because the account in that newspaper is so appalling that, for the time being, I do not wish to believe that it (see note 11) could have considered granting such permission under the conditions stated therein.

If, however, this is true, Heaven forbid, it will certainly be difficult for me to trouble you once again (see note 12), on a subject that is not very "popular." Nevertheless, based on what is observed here, it is clear that if a clear prohibition is issued and the voyage of at least one ship is arranged accordingly, the result will be an immense sanctification of the Name of Hashem. And one can, of course, deduce the reverse in the opposite case.

Without exaggeration, one will thereby save numerous Jews from a public desecration of Shabbos. All that is required is to issue a prohibition in conformity with the Shulchan Aruch. I therefore send you this letter by express mail, and you will surely find an opportunity to advance matters while there is still time. The merit of all depends on you.

In this regard, the following point should be noted. The cunning is so great in this domain that a new question has been raised here (see note 13): Is there a port along the route from here to Europe in which a ship could be moored for the day?

As I have already written, there are several. I will cite only two, specifying that between New York and Portugal going east, there are approximately three thousand two hundred miles. By deviating slightly from the usual route of these ships, one passes the Bermuda Islands, whose principal port is Hamilton, at seven hundred miles from New York. Similarly, at eight hundred miles west of Portugal, there are the Azores Islands, where there is the port of Ponta Delgada. Between these two ports, the distance is approximately half that separating New York from Portugal. All agree that such a distance can be covered in less than six days.

נתקבל כרך השביעי של האנציקלופדיא התלמודית, וכמו בראשונים אין גומרין עליו את ההלל על ריבוי הענינים המובאים בכל ערך וערך וסידורם הטוב, ונוסף על זה, וגם זה עיקר, שכמעט בכל ערך וערך יש למצוא פרטים שאפילו העוסק באותו ענין חידוש הם בשבילו, ואך דא עקא על אריכות הזמן בין כרך לכרך. ובכגון דא בודאי אין להתחשב בהוצאות ולסדר שכת"ר מתעסק רק בענינים שא"א לעשותם ע"י אחרים, משא"כ בדברים הטכנים וכו', ואין מזרזין אלא למזורזין, ובענין כזה נוגעת ההופעה דהכרכים ביותר, וכמו שאמרתי להרב הוטנר שי' בעת בקורו, שקו מיוחד בספרים המסודרים ע"ס א"ב, שכל זמן שלא הופיע כרך התי"ו, חסר בשלימות אפילו זה דאות אל"ף.

מוסגר בכרך פתקא שנשלח ע"י הרב הוטנר שי'. ובטח היינו הך שכתב כת"ר מאז - שנשלח.

ועוה"פ מוכרחני לחזור להענין המכאיב ומצער, הוא ענין האניות. ובקשר עם שני פרטים, משמח והפכו.

א) הכתה דבני עקיבא שהבריקו לכת"ר אודותה, כבר נקבע סופית שאין מסכימים לנסוע באני' ישראל ההולכת גם בש"ק, והודיעו רשמית על סיבת המנעם, וכתבו ג"כ בפירוש הנקודות ברור שקשורים בחילול שבת דאורייתא והם מהנוהג בכל אניות.

ובקשו מענה רשמית - באם אפשר יהי' לסדר מהלך האני' בלא זה.

ב) ז"ע הגיעני קטע מעתון ידיעות אחרונות - כנראה מיום ב' מנ"א - כתוב מאת ירמי' הלפרין, בכותרת נציגי שוהם בדיון אצל הרבנים הראשים. ותוכן דו"ח זה מהדיון - מבהיל, ולא אחזור על נקודות פרטיות שבהם, כיון שגם כת"ר יראה הקטע.

ואבוא רק באיזה הוספות, שכנראה גם הלפרין העלים, אף שאין מובן מאיזה טעם כי הוי' מילתא דעבידא לאגלוי' [אפשר שאין הדו"ח מתאים להמציאות? היינו שבפועל היתה השקו"ט באופן אחר לגמרי ?]

ומה שרוצה אני להוסיף, שמובן שאין הדיון ע"ד הצי המסחרי - כיון, שלבשתנו ובפני כל העמים, אין אניות המסחר פונות כלל בשאלה, ובינינו לדבר ספק גדול אם ישמעו להוראה, ודנים בשאלה שבמציאות אודות האניות בם נוסעים אנשים (ורק בתור טפל מובילים הם סחורה, וברובה הסחורה היא - חפצי הנוסעים, כי פשוט שאין מתרצים לשלם בעד סחורה אותו המחיר שמקבלים בעד אנשים. ולכן באניות הנ"ל משתמטים מלקחת סחורה, ורק במחיר מוגבל וכמפורסם). - ובעצם הטענה המוזרה - שיתירו חילול שבת מדאורייתא עתה כיון שבמשך הזמן ישנה אפשריות שאניות אלו ישתמשו בהן לצורך מלחמה, מגוחך (אם לא הי' מצער). כן הטענה שיחדלו לשלוח הסחורה ע"י אניות אלו, הנה המציאות אינה כן, כי רוב האנשים הנוסעים באניות ישראל והסחורות הנשלחות באניות - המסחר (אניות צים וכיו"ב) אפשר להם לנסוע באניות אחרות שהתנאים שם נוחים יותר, אלא שחיבת עניני ישראל עומדת לאניות אלו שמבכרים אותן ואפילו במקום שנוגע לנוחיות או אפילו להוצאות יתירות.

וכיון שעל כל דבר פשוט ג"כ צריך להראות מקום וראי' והוכחה, הנה - כשיכנסו למשרד מוכר כרטיסי אני' וישאלו לתנאים באניות אלו ובאניות אחרות יבררו את האמור - כמובן אם המשרד יתן הידיעות המתאימות להמציאות.

במ"ש בדו"ח זה בהנוגע לאוטאמטיזאציע, - כבר כתבתי הידוע לי בשני מכתבי.

וביארתי ג"כ שבכ"ז אין מפחד מי שהוא לומר שהנהגה באופן אוטומטי, כי זהו ע"ד דין מרומה, היינו שהאני' מתנהגת אוטומטית אבל צריך להתאים ולפעמים תכופות גם להעריכם כ " פ במשך המעל"ע. ולא עוד אלא שישנו נוהג בין-לאומי; כשמתחלפים המשמרות דהצוות המשרתים את המכונות, והיא אחת לארבע שעות, ז"א ששה פעמים במשך מעל"ע - צריך המכונאי הבא לבקר את כל המכונות הפועלות, ולכל לראש אם פועלים חלקי ההנהגה והקאנטראל של המכונות, והביקור נעשה עי"ז שמנסה את גלגלי הקאנטראל והידות וכו' (די הענטלעך און רעדלעך) אם הם פועלים פעולתם, וה"ה בהנוגע להקאנטראל של דוד המים או השמן דלק, הקאנטראל של תנור האש, הספקת האויר לתנור זה וכו', ז.א. שבניסוי זה מרבה או ממעט באש ובהשמן דלק וכו' - היינו מכבה ומבעיר.

ועוד להוסיף - שאלוני בכאן מפני מה התעוררה שאלה זו דוקא עתה, והרי אניות אלו מהלכות כמה שנים. - ועניתי ע"ז שבשאלה זו יש לפנות לא אלי אלא לרבנות הראשית או לרבנים שענינם בדברים כאלו לפס"ד הנמצאים כאן. והעיקר - שאין קושיא זו משנה גוף השאלה וההחלטה בזה, ואיזה סיבה שתהי' להתעוררות השאלה דוקא עתה, הרי התורה ומצותי' נצחים הם, וככחם לפני שנים אחדים כן כחם עתה.

כן נשאלתי מפני מה התערבתי עתה בזה, ועניתי מתאים להמציאות, שלפני איזה שבועות פנו אלי בבקשת ברכת פרידה לעלי' לאה"ק ת"ו, ובשאלה באיזה אופן לנסוע.

ומובן שעניתי מתאים להשו"ע - שאיסור ברור לנסוע באניות האלו, ואיסור ברור עוד יותר ומדאורייתא להסיע האניות בשבת (כוונתי בחלק הראשון - בהנוגע לאיש פרטי הנוסע ובחלק השני - בהנוגע לבעלי האני', כמו שכתבתי בארוכה בשני מכתבי להרבנים הראשים). מענה זה נתפרסם בכתות אחדות של הנוסעים, ובאו אלי בטענה מפני מה אינני מודיע דעתי להרבנות הראשית והרי הם התירו, ולכן פניתי להרבנות הראשית בבירור הענין.

וכפי שרואה אני עתה, כנראה, שבמחילת כת"ר, הנהגתם עד עתה בזה היתה בחסרון ידיעת המצב הטכני.

ועוד להוסיף והוא העיקר, אף שאין עניני להגיד עתידות, אבל כפי הנראה המצב כאן, באם יצא פס"ד הרבנים הראשים באיסור ודאי - יסדרו (מכאן) מהלך האניות באופן שלכה"פ אחדות מהם ועכ"פ אחת תסע באופן המותר ע"פ שו"ע, היינו שתעגן בנמל למשך יום השבת, ולולי דמסתפינא, הייתי אומר שזהו ברור במאה אחוז - ובלבד שלא יכנס הדבר בענין של נצחנות עם השמאלים באה"ק ת"ו, ושפס"ד הרבנות הראשית לא יניח מקום להיתרים מסולפים (ע"ד האמור בדו"ח שבמכ"ע הנ"ל - שיש מקום להתיר ההפלגה בתנאי ששוהם תתחייב בכתב שגוי-של-שבת יצית את האש בתנורים במקרה אם תכבה! [יש מקום לחשש שלא איכפת למי שהוא לתת התחייבות כזו, ומובן שלא יתתקן הדבר כלל - אפילו את"ל שיקיימו התחייבותם - וכמ"ש בארוכה במכתבי הקודמים, שאפילו אם לא תכבה האש בתנור ישנם מלאכות דאורייתא בעשיריות העשויות באניות ושדרושים מומחים לזה]).

ובמ"ש לאחרונה - ג"כ מענה על השאלה שנשאלתי, האומנם תקותי שיפעלו מה ע"ד הכרזת איסור. והוא - אף שבכלל איני בעל מרה לבנה, וביותר בענינים שהמפלגות באה"ק ת"ו מתערבות בהם, והעיקר ש"המפלגות דתיות" מתערבות בהם, הנה דוקא בנדון דידן בטוחני - שיצליחו ובלי קישוים, שכנ"ל, אחדות מהאניות תסענה באופן המותר. ואפילו השמאלים שבכאן אומרים כנ"ל - שלו הי' איסור מהרבנות הראשית, היו מסדרים הנסיעות באופן אחר. ואף שכבר חשודים הם לחזור בדבורם, הנה כיון שהדברים האמורים נאמרו במענה ללחץ הדעת הקהל החרדי כאן. יוכרחו לקיימם עכ"פ בהנוגע לאניות אחדות.

לא כתבתי כל הנ"ל ישר להרבנים הראשים, כיון שהדו"ח במכ"ע הוא מבהיל כ"כ, שלע"ע איני חפץ להאמין שהיתה אפילו קס"ד שלהם להתיר בתנאים האמורים בהדו"ח.

אבל באם, ח"ו, נכון הדבר, הנה אף שקשה עלי להטריח את כת"ר עוה"פ ובענין שאינו "פפולרי" כ"כ, אבל כפי שרואה אני את המצב כאן, הנה אם יתנו איסור ברור ועי"ז יסודר מסע אני' אחת לכה"פ, יהי' קידוש השם גדול [ומזה מובן הפכו - באם לא יעשה כזה], ומבלי גוזמא יצילו כו"כ מבנ"י מחילול שבת בפרהסיא - אם יוציאו האיסור מתאים להשו"ע, ושולח אני את המכתב במהיר דחוף, ובודאי ימצא הזדמנות לקדם פני הרעה בעוד מועד. וזכות הרבים תלוי בו.

הערה דא"ג: ועד כמה גדלה הערמומית (שווינדל) שבכל ענין זה, הוא שהכריזו כאן שאלה חדשה, האם נמצא נמל בכיוון זה בדרך מכאן לאירופא שאני' תוכל לעגן שם למשך יום. וכמו שכתבתי כבר - נמצאים כמה מהם, ולא אזכיר אלא שנים והם, בהקדמה שמהלך הדרך מנויארק לפארטוגאל הוא בערך 3200 מיל, במרחק מנויארק למזרח, ובנטי' קלה מן הדרך שבה רגילות האניות להפליג נמצאים איי בערמודא והנמל הראשי האמילטאן, והוא לערך 700 מיל מנויארק, וכן בערך 800כ מיל למערב מפארטוגאל נמצאים איי אזורען ובהם הנמל פאנטאדלאגאדא, ז.א. שבין שני הנמלים האמורים המרחק הוא בערך חצי המהלך שבין נויארק לפארטוגאל - שלכל הדיעות אפשר לעברן בזמן קצר יותר מששה מעל"ע.
