To the distinguished Rav, eminent Chassid* who fears Hashem and devotes himself to communal needs,

Rav Ephraim Eliezer (see note 2) HaKohen,

I greet you and bless you.

You have surely received, in its time, my letter concerning the questions you asked about the Rash* (see note 3).

I have just received your postcard asking me about the Chassidic farbrengen* of the celebration of the liberation (see note 4). I was referring to money derived from a transgression of Shabbos* — not to those who transgress it; to a loan at interest — not to those who lend at interest.

My point was the following. Those who claim that this money is useful to the one who transgresses Shabbos or lends at interest are mistaken. This cannot be compared to extinguishing a fire with dirty water (see note 5). Quite the contrary — it is said that "evil is kept for its owner," and one must therefore, more precisely, compare it to the desire to extinguish a fire with petroleum.

I was referring to those who claim that one can help the Holy Land:

A) By lending money to the "bonds," when they refuse to write on them, even in initials, "having obtained permission to conduct business" (see note 6) — in which case the profit would be paid in the form of a share in the profits and not as interest.

B) Through the profits of Israeli ships that also travel during Shabbos (see note 7).

I have been campaigning against both of these situations for a long time, although, for obvious reasons, I intervene in a voice that is not truly audible on the outside. Now, for the moment, I am particularly pained and surprised to observe that no one listens to me.

I have seen the "permission" of Rav Uziel (see note 8) and the discussion regarding this in the Pardes* (see note 9), concerning the consent given by the owner. This reasoning is flawed at its foundation, for on those that were sold in the Holy Land, it was indeed noted — at least several years ago — "having obtained permission to conduct business."

On the second point, I have consulted the Shvisas HaYam*, whose author will have to answer for his formulation that misleads the naive reader, implying that such travel was permitted — which, Heaven forbid — whereas anyone who has the slightest knowledge of ships and how they are operated in our era knows that this constitutes a clear prohibition, as established by a well-known chapter of the responsa of the Chasam Sofer*, volume 6 (see note 10), according to the opinion of the Ramban* and even according to the Torah itself. This point will not be elaborated upon here.

In this regard, you raise the definition of a mitzvah* derived from a transgression. You should consult, on this subject, the book HaMoadim BeHalachah*, in the article on the four species; the commentary of Rabbeinu Chananel* on tractate Sukkah 35a; and the commentary on the Mishnah (see note 11) according to which a lulav* from an entire city convicted of idolatry — an ir hanidachas* — is forbidden because its use would be a mitzvah derived from a transgression. Such is not the opinion of the Tosafos* on tractate Sukkah 30a.

- ראיתי "היתר" הרב עוזיאל בענין הבאנדס והשקו"ט בהפרדס בזה "ושארי לי' מארי'", ונתערער גם מעיקרו ע"י העובדא שבאלו הנמכרים באה"ק ת"ו הי' כן רשום (עכ"פ לפני איזה שנים) עפה"ע.

- כן ראיתי הס' שביתת הים בענין השני ועתיד המחבר ליתן את הדין על סגנונו המטעה את הקורא התמים כאילו הנסיעה מותרת ח"ו, אף שהקורא מד"ע עכ"פ ר"פ באניות ואופן הנהגתן בזמננו - מוכרח להחליט שהנסיעה איסור ברור (וע"פ שו"ת החת"ס ח"ו - הידוע - לדעת הרמב"ן גם דאורייתא. ואכ"מ).

דרך אגב במש"כ בגדרי מצוה הבאה בעבירה - יעוין במש"נ בס' המועדים בהלכה במאמרו ד' מינים. בר"ח (סוכה לה, א) ובפיה"מ שם דלולב של עיר הנידחת פסול מטעם מצהב"ע, ודלא כסברת התוס' (ל, א).
