I greet you and bless you,
I am responding to your letter, which posed the following questions:
A) Regarding the well-known discussion concerning sunset (see letter no. 3976), you ask what women who are required to perform a verification (in application of the laws of family purity) should do.
Recently, many have again raised questions about sunset. Books have been written on the subject, in addition to articles found in Torah* periodicals. Nevertheless, it is clear that Chassidim* base themselves solely on the ruling of the Alter Rebbe*, expressed in his Siddur*, which is later than his Shulchan Aruch*.
It is also known that the Gaon of Vilna* shares this opinion. You should consult Orach Chaim*, Chapter 261; Yoreh Deah*, Chapter 262; the Shnos Eliyahu on Tractate Berachos; and also the Gur Aryeh on "Shabbos Lachem."
B) You discuss the conjugal relations of Torah* scholars, which are set for every Friday evening. You say that the Reishis Chochmah*, in the "Gate of Holiness," adopts a very restrictive position in this domain, and you are surely alluding to Chapter 16. You ask whether a distinction should be made between the first year and subsequent years.
I have not seen any text making such a distinction. Admittedly, one cannot draw a proof from what one has not seen. In this case, however, it is inconceivable that books dealing with this subject would not allude to it. One can therefore consider this to be a proof.
In the revealed part of the Torah*, the commentators on the Shulchan Aruch* deal with this subject in Orach Chaim*, Chapter 240, and Even HaEzer*, Chapter 76. In Even HaEzer*, you should also consult the Pischei Teshuvah, citing the Kerem Shlomo.
The Reishis Chochmah* bases itself on various passages of the Zohar*, for example Volume 1, pages 14a and 50a. These references are cited in the Nitzutzei Zohar, Volume 3, page 49b.
In practice, we must adhere to the writings of the Arizal*. Admittedly, there are different versions, depending on whether one consults the Pri Eitz Chaim, the Mishnas Chassidim, or the Taamei HaMitzvos. In this case, one should follow the latter two works and not the first. Indeed, the Piskei Dinim of the Tzemach Tzedek*, on Yoreh Deah*, Chapter 116, state that: "The Mishnas Chassidim reports only the words of the Arizal*, and it is presumably there that he found this statement."
Likewise, one should follow the Taamei HaMitzvos of Rabbi Chaim Vital rather than his Pri Eitz Chaim, in which he also cites the opinion of his colleagues. The reference in the Mishnas Chassidim is Tractate Shechinah, Chapter 11, and in the Taamei HaMitzvos, at Parshas* Bereishis, in the paragraph "concerning the conjugal relation," page 16a of the Vilna edition.
Admittedly, the notes and commentaries on the "Gate of Mitzvos," at the beginning of Parshas* Bereishis, raise a question on this subject, based on the teaching of the Sages who require adherence to Friday evening. But it is known that one does not nullify a teaching that has been given because of a question raised about it.
It should be known that all of the above accords with both the revealed part of the Torah* and the writings of the Arizal* only insofar as such restraint will not have even more serious consequences. On the other hand, if there is reason to fear that it will, it is clear, in my opinion, that this restraint must be set aside. This can be deduced, a fortiori, from what is established in the name of the Sefer Chassidim, in the Beis Shmuel on Even HaEzer*, at the beginning of Chapter 23.
I have seen that this subject is also treated in the Biur Halachah on the Mishnah Berurah, Orach Chaim*, at that same reference.
C) You tell me that your wife observes the customs of Frankfurt, which seem surprising to you and which are not known in your family tradition.
It is clear that in this matter, one must adopt a conciliatory approach, going even beyond the statement of our Sages that "there are three (categories of people — one being the wife) whom one should draw near with the right hand." Indeed, it is quite obvious that your question concerns customs that are not forbidden.
And even in doing so, one can ask whether it is necessary to have her change her customs. Indeed, it is almost certain that if you yourself make concessions regarding the above, you will easily obtain that she do the same regarding customs that could lead to the violation of a prohibition, even if they concern only a means of better fulfilling the mitzvah*.
If some of her customs are genuinely surprising to your surroundings, it is certain that, little by little, she will abandon them on her own, due to those who observe her.
With my blessing for a kosher* and joyous Pesach*,
