To the great Rabbanim who devote themselves to communal needs, distinguished Chassidim* who fear Hashem,

Eliezer (Rav E. Karasik), Pinchas (Rav P. Althuis), and Chaim Shmaryahu (Rav H. S. Gourary),

may Hashem grant them long life,

Greetings and blessings,

I am responding to your letter of 21 Cheshvan, with its contents — the bylaws of the Tidchatz* association (acronym for Torah, Dat [religion], Chessed [kindness], Tzedakah) and the letter from its administration regarding the property in Tel Aviv (which this association shares with the Chabad* Chassidim*). You ask me my opinion.

A) Experience gained in matters concerning Eretz Yisrael* establishes that, whenever someone retains ownership (i.e., the property is not acquired in full ownership), one cannot exclude a disappointment in the long run. It therefore does not seem advisable to me that this property belong not only to the Chabad* association but also to Tidchatz*.

And indeed, it is not understandable that it should be so. For if you have no intention of intervening and have no share in the construction, what will you gain from the fact that this property also belongs to you? There is merely a possibility thereby offered to someone else to say that he too is the owner.

It is possible that such a risk does not come from any of the current board members. However, this building will need to be used for many long days and good years. One must therefore take into account the changes that may occur at the head of this association.

And above all, there is no logical reason justifying such a demand on their part. Needless to say, this is not about diminishing their merit. One must therefore publicize those who have performed a mitzvah* — in this case, those who have donated a property. This must be mentioned on all letterheads. However, this association cannot retain ownership.

The building will surely entail a significant cost. Now, if it is built on property belonging to others, difficulties may follow. You must understand what I mean.

B) It would be good not to limit oneself to a Yeshivah* on this property, especially since you emphasize many times in your letters how difficult — and even practically impossible — it is to find students in Tel Aviv. You have surely kept a copy of your letters. Of course, one can truly question the wisdom of investing tens of thousands of pounds in the construction of a building, only to then bring students from Lod solely for the purpose of filling it.

One can also consider evening classes for young people, professional studies under the aegis of the Chabad* association or the youth of the Chabad* association, a meeting hall for the Chabad* association, for the youth of Chabad*, and for the women and girls of Chabad*.

C) What has just been said applies only if one cannot do otherwise. However, it is of course preferable that the Tidchatz* association agree to sell this property. And the proceeds of the sale will be reinvested in the constructions at Kfar Chabad*, while preserving the privileges previously described — that is, systematically noting that this is their donation.

I await a detailed letter from you on all of this, and I thank you in advance.

במענה על מכתבם מכ"א חשון עם המוסגר בו - תקנון האגודה תדח"ץ ומכתב ההנהלה שלה, בו כותבים אודות המגרש בתל אביב וכו', ושואלים חוות דעתי.

א) ע"פ נסיון בעניני אה"ק ת"ו, שבאם ישנה איזה בעלות שתי' למי שהוא, אין היכולת להיות בטוח בענינים של עגמת נפש לאחר זמן, אין נראה לי השיור שהמגרש יהי' לא רק על שם אגו"ח אלא גם על שם דתדח"ץ. ובפרט שאינו מובן ג"כ, כי באם שאין רצונם להתעבר כלל ובאם שבהבנין לא יהי' להם כל חלק, הרי איזה תועלת יקבלו ממה שהמגרש יהי' גם על שמם, ואין בזה אלא אפשריות למי שהוא לומר שגם הוא בעה"ב וכו'. ואף אם כל חברי הנהלה בהווה אין לחשדם כלל בכגון דא, הרי הבנין והשימוש בו הוא לארך ימים ושנים טובות, ובמילא צריך להביא בחשבון גם השינוים האפשרים בהנהלת אגודה הנ"ל. והעיקר שאין כל מקום בשכל מפני מה יעמדו על דרישה זו, מובן שאין למעט כלל זכותם, ובמילא - לפרסם עושי מצוה שנתנו המגרש במתנה ושיהי' נדפס כזה על כל הטופסים, אבל לא להניח מקום לבעלות וכנ"ל. כיון שהבנין בטח יעלה לסכום חשוב, ואם יהי' בנוי על מגרש שגם לאחרים חלק בו, עלול לכמה חיכוכים וכו' וד"ל.

ב) מהנכון הי' שלא יגבילו עצמם דוקא לענין של ישיבה על מגרש זה. ובפרט ע"פ מכתביהם שכפלו ושלשו - שקשה להשיג תלמידים בתל אביב, וכמעט שאי אפשר וכו', ובטח נשמרו אצלם העתקת מכתביהם. ומובן שלהשקיע בבנין עשיריות אלפים לירות ואח"כ להביא תלמידים מלוד רק בכדי למלאת הבנין, דע"ג אם כדאי הוא. ???(חסר שורה)דאגו"ח, צעירי אגו"ח ונשי ובנות חב"ד כו' וכו'.

ג) הנה כל הנ"ל הוא בלית ברירה, אבל מובן שהיותר נכון הוא שאגודת תדח"ץ תסכים למכור המגרש, וכסף זה להשקיע בבנינים בכפר חב"ד ובכל הזכיות הנ"ל שיהי' כתבו שזה נעשה בכספם וכו' וכו'.
