To the great Rav and Tzaddik*, distinguished Chassid* who fears Hashem, of illustrious lineage, Rav Shalom Yechezkel Shraga (1) Shlita*,

Greetings and blessings,

I am responding to your letter and its contents — a discussion on the permissibility of using a safety pin (2) during Shabbos*.

I was horrified by the conclusion you envision. Not only do you consider this usage forbidden, but you even see in it a transgression of a Precept of the Torah*, Heaven forbid. How can someone from a family such as yours consider that many virtuous Jewish women, of this generation and of previous ones, have been in error in this matter?

Who is greater than the Korban Nesanel*, Tractate* Shabbos, chapter 7, paragraph 6, which you yourself cite in your responsa*, who refrained from clearly pronouncing such a prohibition and merely expressed his surprise at observing that this usage had spread? Now, just as the Mishnah* says that it is a mitzvah* to uphold the words of the Sages, it also states that it is a mitzvah to preserve the customs of pious Jewish women, which they have adopted for several generations without anyone seeking to prevent them.

Several reasons can be found to permit this practice, and they should be combined to understand this permission. These reasons are as follows:

A) One cannot sew with iron or wire. This cannot be clearly demonstrated, but one can find an allusion to it in the fact that all the labors forbidden during Shabbos are derived from the construction of the Sanctuary*. There, embroidery was also done with gold thread, but not with iron wire. If such a surprising practice had been adopted, the Torah would have had to state it clearly.

Tractate Menachos* 41a speaks of pegs, according to the interpretation of the Aruch*. In fact, these are merely a means of tying, and it does not matter how this tie is made — by sewing or in another way. Similarly, regarding the mixture of species*, the Torah does not speak of sewing but forbids their "being together." One therefore cannot deduce from this that it is forbidden to sew during Shabbos.

Sometimes, a tie is made in a normal manner, without sewing and without threads. Several texts establish that a forbidden labor is a violation of Shabbos if performed in the normal manner, but not with a modification or in a roundabout way. This is not the case for the mixture of species.

In your responsa, you draw an analogy between Shabbos and the mixture of species. In my view, one cannot make such a statement, and you know the proof drawn from Tractate Shabbos 48b, according to which "this is a tie and that is not a tie." Consult this text.

B) Rabbeinu Yoel*, whose Halachah* is accepted in the Shulchan Aruch*, Orach Chaim*, chapter 317, paragraph 3, specifies that the stitch must be permanent. Indeed, one finds, clearly defined regarding Shabbos, a concept of "permanent knot." Consult, on this subject, the Shulchan Aruch of the Alter Rebbe*, at the beginning of chapter 317.

This therefore refers to what is done once and for all, and here again one can simply explain that this was indeed the case in the Sanctuary. Everything that was sewn and attached was done permanently.

In this case, one can add that a pin, especially a safety pin, is obviously used in such a manner that the tie can never be permanent.

C) In general, a safety pin is used for the needs of the day. In such a case, the most recent Sages* permit this practice even a priori, as various texts establish.

In my opinion, based on all of this, one absolutely cannot forbid inserting a safety pin, and one can even think that it is permitted to do so two or three consecutive times (3). In any case, if there is a prohibition, it can only be of rabbinic origin.

I have not elaborated on this analysis as would have been necessary, for this has already been done by the Ginas Veradim* (4), in chapters 17 and 19; by the Tal Oros*, which adopts the view of the Meshiv*; by the new Orchos Chaim*, in chapter 340; by the Meassef LeChol HaMachanos*; and by the Ketzos HaShulchan* of Rav Avraham Chaim Naeh*, section Shemini, chapter 146, paragraph 12. Consult these texts, which provide all the necessary details.

On this subject, you cite a proof from Tractate Menachos. In this, you share the view of the great authorities, since the same explanation appears in the Kuntres Acharon* of the Shulchan Aruch of the Alter Rebbe, at the end of chapter 301, as the Ketzos HaShulchan also notes.

במענה על מכתבו עם המוסגר בו שקו"ט בנוגע להשתמשות במחט בטחון (כנראה כוונתו, זיכער נאדעל) בשבת.

מובן שנבהלתי מהקס"ד בסיום התשובה שלו, שלא רק אסור אלא שחושש גם לאיסור דאורייתא ח"ו, וחס לי' לזרעא דאבא לעשות כו"כ מבנות ישראל הכשרות בדורנו זה ובדורות שלפנינו לטועות בכגון דא, ומי לנו גדול מהקרבן נתנאל (שבת פ"ז סק"ו שמביאו כת"ר בהתשובה שלו) שנזהר אפילו מלאסור בפירוש, ורק שכותב שתמה מאין נוהגים העולם וכו', ומובן שע"ד שדבר משנה שמצוה לקיים דברי חכמים, הרי מצוה לקיים מנהג זקנות מישראל מכמה דורות מבלי מוחה בידם.

ובטעמי ההיתר הנה יש לומר כמה ענינים וכדאי צירופם יחד לבאר מנהג הנ"ל, והם:

א) במתכת ובחוט של מתכת אין תפירה, ואף שאין ראי' מפורשת לדבר הנה זכר לדבר ממה שכל מלאכות שבת למדין אנו ממשכן, ואף שהי' גם חוט של זהב בהאריג, אבל פשיטא שלא תפרו בחוטים אלו, דמילתא דתמיהא כזו צריך הי' להיות ציווי מפורש בזה, וממ"ש במנחות מא, א דנקטה בסיכי שלפירוש הערוך היינו יתדות, הנה מובן ששם צ"ל ענין של חיבור ואינו נוגע כלל באיזה אופן, אם של תפירה או באופן אחר, ופשוט ג"כ, שגם בכלאים לא נזכר בכתוב ענין של תפירה כ"א יחדיו, ובמילא אין מזה ראי' לחיוב על תפירה בשבת. ומה שנמצא באיזה דברים חיבור או תפירה שלא ע"י חוטים, היינו דוקא בענין שדרכו לחברו באופן כזה, ופשוט בכ"מ דחיוב מלאכה בשבת הוא דוקא כשהמלאכה נעשית כדרכה ולא בשינוי וכלאחר יד, משא"כ כלאים.

ומ"ש כת"ר בתשובה שלו, ששבת וכלאים שווים, הנה לדידי אי אפשר לומר כזה וכנ"ל וכבר ידועה הראי' משבת מ"ח ריש ע"ב, זה חיבור וזה אינו חיבור, עיי"ש.

ב) כבר ידוע דעת רבנו יואל אשר נפסקה הלכה כמותו (שו"ע או"ח סי' שי"ז ס"ג) אשר צ"ל תפירה של קיימא, וקיימא בעניני שבת מצינו במפורש בענין קשר של קיימא, ועיין שו"ע לרבנו הזקן סי' שי"ז בתחלתו, שהיינו דוקא בעומד להתקיים לעולם (גם בזה י"ל הסברא בפשיטות, כיון שכן הי' במשכן, שכל עניני תפירה וחיבור היו על מנת שישארו כך לעולם). ובנדון דידן יש להוסיף שמחט ובמחט בטחון ביחוד הנה רואים במוחש בכל ענינים שמשתמשים בהם לשם חיבור שאי אפשר שישארו כך לעולם.

ג) השימוש במחט בטחון הרי ע"פ רוב - השימוש הוא דוקא בענינים של צורך היום, שאז מתירים בתרי דרבנן אפילו לכתחלה וכמובא בכ"מ. וע"פ כל הנ"ל הנה לדעתי בתחיבה אחת דמחט בטחון אין מקום לערעור כלל וכלל, ויש מקום לומר שאפילו בב' וג' תחיבות מותר, ועכ"פ לא יותר מענין דרבנן.

לא הארכתי בכל הנ"ל כפי הדרוש כי כבר האריכו בזה בשקו"ט בגוו"ר סי' יז-יט בספר טל אורות שהחזיק בדעת המשיב, ובס' ארחות חיים החדש סי' ש"ם, ומאסף לכל הדיעות בזה בספר קצות השולחן להרב אברהם חיים נאה חלק שמיני סי' קמ"ו סעיף י"ב עיי"ש בארוכה בכל הנ"ל.

דא"ג במה שהעיר כת"ר הראי' ממנחות וכנ"ל, כיוון לדעת הגדולים הוא בקונטרס אחרון לשו"ע רבנו הזקן סי' ש"א בסופו, וכמו שהעיר ג"כ בקצות השולחן.
