To the distinguished Chassid* who fears Hashem, Rav Nathan David (1),

Greetings and blessings,

I have received your letter, which followed a long silence. You recall my statement (2), according to which I have not found another opinion besides the Or HaChaim* that counts the waste of seed among the mitzvos* (3). You are therefore surprised that I make no mention of what is clearly stated in Tractate* Niddah*, page 13, reporting the teaching that was given in the study hall of Rabbi Yishmael*.

It is quite obvious that I had not forgotten this teaching of our Sages*, which is precisely the one upon which the author of the Or HaChaim bases himself, and which he indeed references. I was not saying that his words are unfounded, but I was explaining that I had not found a second opinion that also considers the waste of seed as something to be included in the count of mitzvos. Indeed, the Rambam*, Rabbi Saadya Gaon*, and the Ramban* make no mention of it. Yet all of them knew this passage in Tractate Niddah.

Moreover, many among the early Sages consider that this prohibition is only of rabbinic origin. Consult also the Sefer HaMitzvos* of the Tzemach Tzedek*, in the mitzvah* of procreation, which cites only the author of the Or HaChaim among those who consider this prohibition a mitzvah.

I am surprised that you have not yet confirmed receiving my letter, which answered your question about the vocalization marks (4) and their count, according to the Zohar* and the Kabbalah*.

As you request, I will mention your name and those of the members of your family at the holy resting place of my father-in-law, the Rebbe*, whose merit protects us. Likewise, you and yours will be inscribed and sealed for a good and sweet year, materially and spiritually.

לאחרי שתיקתו הארוכה נתקבל מכתבו בו עורר על מה שכתבתי שלא מצאתי חבר לבעה"מ ספר אור השנים המונה הוצאת שז"ל במנין המצות, ותמה איך נעלם המפורש במס' נדה דף י"ג בשם תנא דבי רבי ישמעאל.

הנה פשיטא שלא יכול להתעלם מאמר רז"ל זה, כיון שהוא יסודו של בעל המחבר ספר אור השנים, ומציין אליו על אתר , ואני לא כתבתי שלא מצאתי יסוד לדבריו, אלא שלא מצאתי לו חבר שימנה הוצאת שז"ל במנין המצות, לא הרמב"ם ולא רס"ג ולא הרמב"ן וכו' - אף דפשיטא שכולם ידעו מהסוגיא דנדה הנ"ל, ולא עוד אלא שלדעת כמה ראשונים הוא דרבנן וכו', וראה ג"כ בס' המצות להצמח צדק מצות פו"ר שמזכיר רק בעל המחבר ס' אור השנים שימנה הנ"ל במנין המצות.

לפלא שלא אישר עד עתה קבלת מכתבי מענה על שאלתו בענין הנקודות וחשבונם ע"פ הזהר והקבלה.

כבקשתו אזכירו וב"ב שיחיו על הציון הק' של כ"ק מו"ח אדמו"ר זצוקללה"ה נבג"מ זי"ע והוא וכב"ב יכתבו ויחתמו לשנה טובה ומתוקה בגשמיות וברוחניות.
