To the distinguished young man, Chassid* who fears Hashem,
Rav C.[1],
A) This is not comparable[2]. For the value of a man falls exclusively within the jurisdiction of the human tribunal, whose judges rule based on what is established and not according to thoughts and hidden elements. The responsa establish this, emphasizing that Teshuvah* cannot be taken into account by the human tribunal when it pronounces a sentence. Our case, at the other extreme, falls exclusively within the jurisdiction of the heavenly tribunal, which, in condemning, can also rescind the sentence.
There is also an intermediate situation, when the Torah rules below that the condemnation must be pronounced above. In such a case, Teshuvah and hidden elements may be taken into account.
B) Several verses contest this claim[3]. And the Pesikta* indeed says: 'He called Michael and Gabriel to testify.'
C) There are many explanations regarding the fact that 'the Torah is not in Heaven'[4]. Consult the Chida*, the Sdei Chemed*, the responsa of the Chatam Sofer*, the Keset Sofer*, and other references. Also see the Biyurei HaZohar* on Parshat Vayishlach*.
D) The difference is quite evident[5]. According to the opinion that opposes Rashi*, a dying person is a potential dead man and his action therefore has value. Now, one condemned by the court is also a potential dead man. The first situation therefore has nothing more than the second. The opposite is true according to Rashi's conception.
In other words, the discussion between Rashi and those who oppose his view is as follows. Is the dying person a potential or actual dead man? One condemned by the heavenly tribunal, by contrast, is, according to all opinions, a potential dead man.
It is difficult to imagine that he would have to be in his death throes solely so that his body too would be in a state of potential death, since ultimately, that potential death is not sufficient. That of the body is therefore not sufficient either.
E) This means[6] that the man who would kill this condemned person would not be considered to have committed a crime.
F) I already told you, on the eve of Pesach*, that there are two questions here[7]:
1. How does the sentence of the tribunal make the one who undergoes it considered dead?
2. How does one justify this?
To answer the second question, one can simply say that we take the laws of the Torah as our reference. It matters not, therefore, that his body was not physically altered. The Torah effects such a modification, even if one does not see it.
G) What does this have to do with our subject[8]? Death sentences were very rare in the era of the Temple. Despite this, there was no desire to abolish them. How much more must the same be true of flogging.
What you are asking, in effect, is why it was not stated explicitly that flogging had not been abolished. This can be explained in various ways:
1. When the Sages taught that death sentences were maintained, they were still deliberating about flogging. Then, when flogging was also maintained, they did not state it explicitly, considering it to be self-evident.
2. It is quite clear that flogging as defined by the verse still exists, for we commonly encounter situations comparable to it, whereas we do not see the equivalent of the death sentences presented in tractate Sanhedrin*. That tractate therefore specifies that falling from a roof, for example, is comparable to stoning.
H) I would be surprised if such an explanation were acceptable[9], for one who stones a man condemned to strangulation is likewise not guilty of that crime. Yet in what way has the tribunal's sentence been carried out in such a case? And if one takes into account only the fact that in the end the condemned was killed, it is clear that the same can be said of flogging.

[5] Rav Rivkin asked: 'If one corrects the Torat Shalom*, saying that the Alter Rebbe* was alluding to Rashi, why make reference to the principle that a dying person is considered dead? He was dead anyway since he had been condemned by the heavenly tribunal!'
[6] Rav Rivkin asked: 'From the moment of condemnation by the tribunal, the man who undergoes it is considered dead. Yet this should be the effect of the execution of the sentence and not of the verdict.'

ולהעיר אשר ישנו ממוצע בין ב' סוגים הנ"ל והם הענינים שהפס"ד הוא בתורה הנגלית שעונשו עונש מיוחד בידי שמים , ובזה מועילים תשובה שבלב וענינים שבנסתר (מכות יג, ב. ועייג"כ תוס' כתובות ל, רע"ב במשנה סוטה פ"ג, ואכ"מ).
ב) צע"ק מדברים לא, כח (והוא ע"פ תוס' ע"ז י"ז סע"א) ומפסיקתא הובאה ביל"ש רמז קצא: וקרא למיכאל וגבריאל כו' ע"י זקן וע"י עדים .
ג) בענין לא בשמים שקו"ט וש " נ בשה"ג להחיד"א ח"א אות יו"ד רכ"ד. שד"ח כללים אות א ס"ק צד, קא, קיב. שו"ת חת"ס ח"ו סצ"ח. פי' חיד"א אבות רפ"ו. הקדמת קסת הסופר לשו"ת מן השמים. ובכ"מ. ולהעיר מביאוה"ז פ' וישלח.
ד) החילוק פשוט דלשיטת החולקים על רש"י גוסס אינו אלא מת בכח , כי הרי פעולתו פעולה, וגם נפסק דינו בב"ד מת בכח הוא, וא"כ אין במצב הגוסס הוספה על מצב מי שנפס"ד בב"ד, משא"כ לשיטת רש"י. במלים אחרות: הסבר פלוגתת רש"י והחולקים עליו בדין הגוסס, הוא אם הגוסס מת רק בכח או גם בפועל (עכ"פ לרוב הלכותיו), משא"כ נפס"ד בב"ד דלכ"ע אינו אלא מת בכח.
ודוחק לומר - דלשיטה הא' - צ"ל גוסס, כי מוסיף שנעשה מת בכח גם מצד הגוף.
דסו"ס כיון שמיתה בכח אינה מספקת, גם מיתת הגוף בכח אינה מספקת.
ה) י"ל כוונת האו"ש בלשונו (ולא ראיתי בפנים גופא) גברא שאין בנוגע לו הציווי דלא תרצח. ובזה מתורץ מה שמקשה על האו"ש.
ו) כבר א"ל בע"פ, דיש כאן שתי שאלות: 1) מנ"ל דע"י פס"ד הב"ד עצמו נעשה גברא קטילא, 2) איך אפשר להסביר את זה. ובמענה לשאלה הב' - הסברא פשוטה: אנו דנין אודות מי שנפס"ד אם נשתנו הלכותיו ודיניו אשר ע"פ התורה . ולכן אין נוגע מה שלא נעשה מעשה, כיון שנעשה שינוי (אף שאינו ניכר) ע"פ פסק התורה ובמילא זה משנה דינו אשר ע"פ תורה .
ז) כלפי לייא. אם ד"מ שגם בזה"ב לא אירע אלא לעתים רחוקות ביותר לא רצו לבטל, עאכו"כ שלא הי' מובן כלל אם היו מבטלים דין מלקות.
וקושייתו מפני [מה] לא נאמר בפי' דדין מלקות לא בטל י"ל בכמה אופנים, ומהם: א) כשנשנה מרז"ל דדין ד"מ לא בטל דנו עדיין ב"ד דין מלקות. ואח"כ לא צריכא להודיענו כי אתיא במכש"כ, כנ"ל. ב) עונש המלקות הוא הענין דונקלה אחיך (מכות כב, ב ושם), וא"כ אין חידוש להשמיענו שעונש המלקות לא בטל, כי מעשים בכל יום הוא דונקלה אחיך, משא"כ בד"מ דלא ראינו קיומם באופן המתואר במס' סנה', לכן משמיענו דהנופל מן הגג כו' הוא במקום סקילה וכו'.
ח) תמיהני אם אפ"ל טעם זה כי הרי לדיעה זו הסוקל את המחויב חנק ג"כ פטור ולהיפך. ואיך מקיים בזה דינו. ואם נחלק שמקיים עכ"פ פרט משותף שבכל ד"מ ושבזה הוא הציווי דלא תרצח, א"כ גם במלקות י"ל כן.

ד) מעה לשאלה: גם אם נגי' (כמ"ש במכתב הנ"ל) שכוונת אדה"ז היא לשיטת רש"י, למה הי' צריך אדה"ז לדין גוסס חשיב כמת, הרי בלא"ה חשיב כמת מכיון שנפסק דינו בב"ד שלמעלה.
ה) הל' רוצח פ"ב ה"ט - דרציחה לא חשיבה "הותרה מכללה" כי "ב"ד ממיתה גברא דכל ההורגו פטור ולא הותרה רציחה להרוג מי שאינו מחוייב מיתה, רק ב"ד פוסקין דינו..
ואח"ז גברא קטילא הוא". והקשה השואל, דלכאו' פסק ב"ד מצ"ע אינו עושה הנידון לגברא קטילא, כ"א מפני שאח"כ יהרגוהו.
ו) מענה לשאלה: איך יעשה גברא קטילא ע"י פסק ב"ד, הרי בגופו לא נעשה שום מעשה.
ז) עמ"ש הנ"ל דרק דין ד' מיתות לא בטל אבל דין מלקות בטל.
ח) עמ"ש נ"ל דזה דמי שנגמר דינו למיתה ההורגו פטור איו מפני שנחשב כגברא קטילא, רק משום דכל ההורגו ה"ה מקיים בו דין ד"מ.
