To the great Rav, the distinguished Chassid* who fears Hashem, Rav Moshe DovBer (Rav M. D. Rivkin; see letter no. 2181),
Greetings and blessings,
On the occasion of the festival of Matzos*, which approaches for us and for all of Yisrael* in a positive manner, I send you my blessing that it be joyous, that it truly liberate you from all concerns, material and spiritual, from all impediments and barriers, from everything that hinders serving Hashem with joy and enthusiasm.
And may you preserve this freedom and joy throughout all the days of the year.
I have duly received your two pamphlets, concerning borrowing and regarding chatzitzah* (interposition between the body and the water during ritual immersion). I thank you for them. It appears that one of the two is the one you had given me in the form of photocopies. For the pleasure of commenting on Torah* and as is customary, I will pose here four questions, raised upon a quick examination of these two pamphlets, in the hope that they are not erroneous, which Heaven forbid.
A) Regarding chatzitzah*, I am surprised that you do not address the most essential point. When there is such an interposition, must one consider that no ritual immersion took place at all, since Tractate Eruvin* 4b states: "And he shall rinse" (his body in the water, which is not the case here, due to the interposition)? Obviously, this cannot be equated with the act of clenching one's teeth (which also prevents the "rinsing" of the mouth, though no foreign body is present).
Or should one say that the immersion did indeed take place, but is disqualified? In the latter case, one must ask whether the interposition covers the majority of the body or only a small portion of it. The ruling is not the same for ritual immersion, even though one may question the rationale for this distinction, since in any event it is necessary to "rinse."
B) I am surprised by what you state at the beginning of page 5. If the interposition covers only a small portion of the body, but one does not wish to retain it, it is not considered an interposition, and only a Rabbinic enactment requires that it be treated as such.
C) Likewise, I am astonished that you do not mention the responsa of the Tzemach Tzedek*, Yoreh De'ah*, chapter 158, from which several important points can be deduced regarding this subject.
D) In a note on pages 17 (the Rebbe writes "tov" — "good" — whose numerical value is seventeen) and 18 (the Rebbe writes "chai" — "alive" — whose numerical value is eighteen), you discuss the interposition by air between the Tefillin* and the head (The Rosh*, in chapter 18 of the laws of Tefillin*, states that an interposition prevents the fulfillment of the mitzvah* of Tefillin*, as is the case for the garments of the Kohen*. For the latter, air also constitutes an interposition according to the Rambam*, Laws of Temple Vessels, chapter 7, paragraph 10. Similarly, air separates the Tefillin* from the head, raising the question of how this mitzvah* is to be fulfilled). You say that the Torah* does not take this into account, because this is indeed how they are meant to be worn. Nevertheless, you add, this interposition must be minimized as much as possible.
In my humble opinion, one cannot make such a claim. On the contrary, the Torah* requires that the box of the Tefillin* be straight, as stated in Tractate Menachos* 35a and in the Rambam's* introduction to his Commentary on the Mishnah*, citing, in particular, the example of Yehoshua*. Consequently, the point of contact between the box and the head must be very small. In fact, were it not for the weight of the Tefillin* pressing on the head, the contact between a plane and a sphere would be but a single point.
With my blessing on the occasion of the festival,
M. Schneerson
