Greetings and blessings,

I am responding to your letter of the 25th of Adar*. You cite the responsa* of the Tzemach Tzedek*, section Yoreh De'ah*, chapter 204, discussing the case of one who was born before or after sunset (when it is impossible to determine the precise moment). The Tzemach Tzedek considers that this moment still belongs to the day, insofar as no stars are visible in the sky at the time of birth.

However, you question this conclusion, for according to the Siddur* of the Alter Rebbe*, the twilight period (bein hashmashos*) begins at sunset and, after three-quarters of a Mil* (the time required to traverse that distance), it is night. According to this conception, it would not matter whether one observes the stars or not.

In truth, there are several interpretations of the Beraisa* (in Tractate Shabbos 35b) according to which, if there is one star, it is day; if there are two, it is twilight. According to some, this is solely the view of Rabbi Yossi, while according to others, it is also that of Rabbi Yehudah. Various works discuss this question and we will not revisit it here. But in any event, if one does not observe any stars at all in the sky — not even the largest ones — it is still day and the sun has therefore not yet set.

This is why the Decisors* are not more explicit on this matter, as evidenced by the uncertain situation described in these responsa. All of this is entirely independent of the dispute between Rabbi Yehudah and Rabbi Yossi. In such a case, indeed, the fact of seeing no stars enables one to resolve the doubt regarding sunset when a mountain or a cloud conceals the west (the direction in which the sun sets).

במענה על מכתב מכ"ח אדר..במה שהעיר בשו"ת הצ"צ חיו"ד סיר"ד, שפוסק בספק' נולד קודם שקה"ח או לאחר שקה"ח שכיון שלא נראו שום כוכבים ברקיע בעת שנולד עדיין יום הוא, ומקשה כ' - דלדעת רבינו הזקן בסידורו דביה, ש מתחיל משתשקע כל החמה ולאחר ג' רבעי מיל הוי לילה, א"כ אין נפק"מ בראיית כוכבים לדעה זו.

אבל איך שלא נפשר הברייתא דכוכב א' יום ב' בה"ש כו' - אם הוא רק לרי"ו" אם גם לריה"ו (וכבר שקו"ט בזה בכמה ספרים, ואכ"מ) הנה באם אין נראים שום כוכבים ברקיע היינו גם לא אחד ואפילו מהגדולים - עדיין יום הוא (ולא שקה"ח עדיין). ולכן סתמו הפסוקים בזה וכדאיתה ה[ס'] שמביא בשו"ת הנ"ל, ואי"ז שייך לפלוגתת ריה"ו ורי"ו, כי ע"י אי ראיית שום כוכבים - מבררים הס' אם שקה"ח אם לאו (כשהר מסתיר במערב, או ענן).
