I greet you and bless you,

I respond to your letter of this Tuesday, in which you ask me about what the Tanya* explains — and, at greater length, the introduction to the Shefa Tal — regarding Jewish souls, which are "a portion of the Divine Above, truly." Indeed, the Nishmas Chaim, Second Discourse, Chapter 9, questions this assertion, and he raises objections that are, in your view, self-evident.

First of all, you know that the Halachah* follows the opinion that was expressed later in time. For the one who authored it necessarily had knowledge of everything that had been said previously in various books, and he thus proposes another interpretation.

Moreover, the source of the soul and its nature are secrets of the Torah, belonging to Kabbalah*. In such a case, one must therefore apply the principle that the opinion of the one who is most versed and most accustomed to this wisdom must be retained.

Thus, the Rosh*, commenting on Tractate Bava Kama, Chapter 4, paragraph 4, states that the Halachah* follows the opinion of Rav regarding prohibitions, and that of Shmuel for legal judgments. Indeed, the latter was accustomed to rendering judgment. He therefore did so with precision, conducting a profound analysis, and in this way arrived at the truth.

Now, if this is so for Shmuel, who was in dispute with Rav, how much more so is it the case for the author of the Nishmas Chaim. Admittedly, he was a well-known communal leader and philosopher. But in his era, the Kabbalah* had not yet been widely disseminated. Moreover, it had not been clearly explained — even if some of its concepts are indeed cited in the Nishmas Chaim.

You ask me whether it is discussed in the books about washing one's hands in a Mikveh*. This possibility is considered only for the Mikveh* that enhances purity, but not for the one whose purpose is to remove impurity.

You have surely heard about the three daily studies that pertain to each person, instituted by my father-in-law, the Rebbe, whose merit protects us. They are: Tehillim*, according to the monthly division, each day after the morning prayer; the Parshah* of the Chumash* with Rashi's* commentary on the Sidra* of the week — on Sunday from the beginning to Sheini, on Monday from Sheini to Shlishi, and so on; and the Tanya*, each day as well, according to its annual division.

You will add your own studies to all of this, and Hashem will grant you success.

במענה על מכתבו מיום ג' בו מקשה על מ"ש בתניא ובארוכה בהקדמת ס' שפע טל בהנוגע לנשמות ישראל שהם חלק אלקה ממעל ממש, ממה שמצא בספר נשמת חיים מאמר שני פרק ט' שמקשה על הנחה זו ובקושיות פשוטות ביותר, לפי דעתו.

והנה נוסף על הידוע שהלכה כבתראי בזמן, מפני שהם ראו הכתוב לפניהם בספרים שונים ותירצו אותם, הנה בענינים הנ"ל - שהענין דמקור הנשמה וענינה הוא בסוג דסודות התורה וחכמת הקבלה, הנה על כגון דא - יש ללמוד מהכלל, דהלכה כזה שמדקדק ורגיל בענינים אלו. ועל דרך מ"ש הרא"ש (ב"ק פ"ד סי' ד') דהלכה כרב באיסורי וכשמואל בדינא לפי ששמואל הי' רגיל תמיד לפסוק דינים ולכך הי' מדקדק בהם ויורד לעומקן ומשכיל על כל דבר אמת. ואם הנ"ל אמור בהנוגע לשמואל בפלוגתתו עם רב - הרי עאכו"כ בהנ"ל אשר בעל המחבר נשמת חיים הי' עסקן ידוע וגם חוקר, אבל בימיו לא נתפרסמה חכמת הקבלה, ועאכו"כ שלא נתבארה כדי צרכה, אף שבספרו נשמת חיים מביא כמה ענינים השייכים לזה.

בשאלתו ע"ד הנמצא באיזה ספרים עניני נטילת ידים במקום מקוה, זהו אמור בהנוגע למקוה דתוספת טהרה, אבל לא בטבילה מטומאה לטהרה.

בטח שמע משלשת השיעורים השוים לכל נפש מתקנת כ"ק מו"ח אדמו"ר

זצוקללה"ה נבג"מ זי"ע, והם א) אמירת שיעור תהלים - כפי שנחלק התהלים לימי החדש בכל יום אחר תפלת שחרית. ב) לימוד פרשה חומש עם פירוש רש"י מהסדרה של השבוע - ביום א' מהתחלת הסדרה עד פרשת שני, ביום שני מפרשת שני עד שלישי וכו' - ג) לימוד שיעור תניא בכל יום - כפי שנחלק התניא לימות השנה, ויוסיף על זה מדילי' והשי"ת יצליחו.
