By the grace of Hashem, Eve of Sukkot* 5708, To the great Rav, Chassid* of many accomplishments, Rav E.E. HaCohen[1], I greet and bless you,
I reply to your letter of the day after Yom Kippur.* The moment does not allow for lengthy developments and I will therefore be brief:
A) You tell me, in your letter, that the strict judgment of the first day of Rosh Hashana* does not involve the Attributes of emotion, which are associated with the seven days of creation. I am surprised by such an assertion, whereas the Talmud,* the Zohar,* the Peri Etz Chaim* and the books of Ethics continually repeat that on Rosh Hashana and, generally, during the ten days of Teshuvah,* Hashem sits on the throne of judgment and the world is judged. The Peri Etz Chaim establishes a connection between the first day of Rosh Hashana and the Attributes of feeling. It explains why a strict judgment results from this. The same assertion is found in other texts.
B) You draw proof from the fact that the Attribute of Heavenly Royalty is rebuilt on Rosh Hashana. Yet the contrary idea results from it, for it is known that Royalty is built by the Attribute of severity, emanating from a particularly elevated source.
C) You say that strict judgment implies an ascent, whereas clement judgment remains superficial. You seem to conclude from this that, if severity manifests itself in all its force, the contrary should be true[2].
The Peri Etz Chaim establishes, however, that the first day reproduces only the deep dimension of the worlds. It is then that the judgment is strict. Then, the totality of the worlds is formed on the second day. There is therefore indeed the deep dimension first, the superficial part afterward.
D) You say that the Attribute of Royalty is rebuilt on Rosh Hashana from its highest source. Then a new light is revealed, which has never yet illuminated the world.
This is indeed so, but it is not for this reason that Rosh Hashana is linked to strict judgment. On the contrary, this is the effect of the blowing of the Shofar,* which softens the severity. Moreover, this severity emanates, in this case, from the divine Name Elokim,* as the Likkutei Torah* explains, and a judgment is necessary in this regard, as it is said: 'A judgment for the Hashem of Jacob.' This is, nevertheless, merciful, for, thanks to the blowing of the Shofar, Hashem takes His place on the throne of clemency.
E) You also object to my words by the fact that the first Rosh Hashana, the day of the creation of Adam, was a Friday. Yet, even setting aside what I wrote, an explanation must be given in this regard. For there is doubtless an esoteric reason, as is the case for all other principles of the Torah, justifying the impossibility of Rosh Hashana falling on a Sunday, a Wednesday, or a Friday. How then could the first Rosh Hashana have been a Friday?
One may propose, in this regard, the following explanation. The first Rosh Hashana was also the occasion of a strict judgment. For all that, it was not comparable to that of subsequent Rosh Hashanas, for:
1. When man was created, that is, before the sin, the worlds and the Sefirot* were much more elevated than at present, as the Likkutei Torah of the Ari Zal* explains. The judgment could therefore not be truly strict.
2. At that time, Hashem acted solely through goodness[3], which confirms that the judgment could not be too strict. At present, by contrast, every revelation is obtained at the conclusion of a judgment, which follows the effort of men. It is for this reason that Rosh Hashana is only the 'remembrance' of the first day, as the Likkutei Torah explains.
However, the first Rosh Hashana was also a day of severity. It is for this reason that it could not be a Sunday or a Wednesday, which belong to the domain of goodness[4]. But, to emphasize that this judgment was not strict, and perhaps also to distinguish itself from subsequent Rosh Hashanas, the first was a Friday, which is not directly linked to the domain of goodness, but is very close to it.
3. Furthermore, I stressed, in my previous letter, that Rosh Hashana today can no longer be a Friday, for Monday, the second day of creation, was reintroduced into it when Hashem found that this creation was 'very good.' But this was so only after the creation of man and through his intermediary, as the plain meaning of the verse indicates. No indication results from this for the first Rosh Hashana.
F) You explain the assertion of the Rambam*[4] according to the explanation of the Tashbetz* justifying the necessity of fixing days during which festivals cannot occur.
I did not raise this point at all in my letter, for the Rambam does not repeat the terms of the Talmud. I do not have the Tashbetz, but this same explanation is given by Rabbenu Chananel,* commenting on tractate Rosh Hashana, by the commentary of the Mishneh Torah* at that reference, and by the Binah Le'Ittim of Rav Ginsburg, who, however, does not cite the Tashbetz.
In fact, I simply reproduced the objection of the Raavad,* according to which the Rambam does not justify the reason why Sunday, Wednesday, and Friday cannot be Rosh Hashana. And he cannot consider that this reason, stated in the Talmud, is known to all. This is not his custom and, on the contrary, he is accustomed to repeating in his work what the Talmud says.
The Raavad notes that the Rambam 'did not adopt the manner of proceeding of the Sages. He posed a question and left it at that.' By contrast, one can understand him if one explains that the Rambam did not wish to mention, even allusively, what appears in the Kabbalah.*
This allows us to answer a question that the Raavad raises concerning the laws of Teshuvah of the Rambam, regarding a point he does not explain. One can indeed explain his silence in the same way.
And, since I am raising the fact that Rosh Hashana cannot be a Sunday, a Wednesday, or a Friday, I will recall that, according to the opinion of Rabbi, mentioned by Rabbenu Chananel in his commentary on tractates Shabbat 115a and Sukkah 43b, this impossibility derives from a principle transmitted to Moshe* on Mount Sinai. This principle is, nevertheless, explained according to the Kabbalah in the Hagahot* of Rabbi Moshe Zakuto.*
G) You say that the expression 'great is the Teshuvah'[5] is found ten times in the Talmud, eight in an evident manner and two in a hidden manner.
I wonder what you mean by this, for in tractate Yoma 86a, this expression is mentioned ten times and not nine, according to the version of the Ein Yaakov.*
One may, moreover, raise a question in this regard, for the Reshit Chochmah* also establishes the count and finds, in the entire Talmud, only four. The same assertion is found in the Midrash Talpiyyot,* which also cites an assertion not found in the Talmud, 'great is the Teshuvah which brings near those who are distant.'
H) The expression 'the ten days that are between[6]' includes these days as well[7]. I have noted that Rav Naeh,* in the second edition of his Shiurei Torah,* a remarkable book that deserves to be studied with attention, based on tractate Rosh Hashana 6b, indicates that only one deadline must enter into the count[8].

במענה על מכתבו ממחרת יוהכ"פ, וכיון שאין הזמן גרמא להאריך אבוא בקצרה:
א) מ"ש במכתבו דהא דיום א' דר"ה הוא דינא קשיא אינו בגדר מדות, שדוגמתן ז' ימי הבנין, תמהתי איך אפ"ל כך בשעה שהש"ס, הזהר, פע"ח, ספרי מוסר וכו' מלאים מזה שר"ה ובכלל עשי"ת הם ימי המשפט ויושב על כסא דין והעולם נידון וכו' וכו'.
ובפע"ח שער ר"ה פ"א-ב: וביום א' דר"ה ננסר מרישא דז " א עד הת"ת שלו ועד בכלל ולהיות נוטלת ביום זה כל הנסירות הללו לכן הוי דינא קשיא.. כוונת הנסירה.. לתת דינין שבז"א אלי'.. דינין דדוכרא תקיפין ברישא ולכן יום א' נקרא דינא קשיא. ועוד בכ"מ בסגנון זה.
ב) מה שהביא ראי' לדבריו מהא שבר"ה הוא בנין המלכות, אדרבה מכאן ראי' להיפך, וכידוע דבנין המלכות הוא מהגבו', אלא ששרשם מלמע' מעלה.
ג) הביא ראי' ממה שביום דינא קשיא הוא העלי' בפנימיות וביום דינא רפיא בבחי' חיצוניות. וכנראה ראיתו הוא דא"ת דדינא הוא כפשוטו גבו', הרי איפכא מסתברא.
אבל ז"ל הפע"ח שר"ה פ"ד: והענין כי ביום א' עדיין העולמות אין יכולים להכלל רק הפני' לבד ולכן הוא דינא קשיא, אך ביום ב' אז מתבסמין כל העולמות .. תחלה צריך לכלול פנימיות ואח"כ ביום ב' אז נכללים גם העולמות .
ד) מביא ראי' ממה שבר"ה נמשכת המל' ממקורה למע' מע', ואז נמשך אור חדש שעדיין לא הי' מעולם כו'.
אמת כן הוא אבל לא מפני זה דר"ה הוא דינא קשיא. ואדרבה כהנ"ל נעשה ע"י התקיעות שהם ממתיקין הדינים. (וגם הנ"ל נעשה ע"י גבורות דשם אלקים דוקא. יעוין לקו"ת ד"ה שוש אשיש תוך פ"ד. ויש ע"ז משפט וכידוע בפי' משפט לאלקי יעקב, אלא דמשפט איהו רחמי דע"י התקיעות יושב על כסא רחמים).
ה) מקשה על דברי ממה שר"ה הראשון - יום ברוא אדה"ר - הי' ביום ואו. הנה גם לולא מה שכתבתי צריך לתרץ זה, כי הרי בודאי הכלל לא אד"ו ראש יש לו טעם בנסתר, וכמו שאר עניני התורה, וא"כ איך איקלע ר"ה הראשון ביום ואו.
ומה שנ"ל הוא, כי אף דגם בר"ה הראשון נאמר הל' דינא קשיא (פע"ח שם) בכ"ז אינו דומה לדינא קשיא דר"ה אשר משם ואילך: א) בברוא אדה"ר, היינו קודם החטא, הי' מצב העולמות והספי' למעלה מכמו שהם עתה (ל"ת להאריז"ל ס"פ בראשית ופע"ח ש' השבת פכ"ג) ובמילא אין הדינים קשים כ"כ. ב) עוד הוכחה דאז לא היו הדינים קשים כ"כ, מהא דאז נעשו כל הענינים מצד כי חפץ חסד הוא ועתה יש דין ומשפט ובאתדל"ת תליא מילתא (ולכן אומרים שהוא רק זכרון ליום ראשון. לקו"ת ד"ה והי' ביום ההוא יתקע ספ"א). וכיון שעכ"פ גם בר"ה הא' דינים הם לכן לא חל ר"ה הראשון ביום א"ד שהם מקו הימין. אבל בהיות שאינם קשים (ואולי כדי להורות על חילוק דר"ה זה משלאחריו) חל ביום וא"ו שאינו מקו הימין אבל נוטה אליו.
ועוד בה שלישי': הטעם שעתה אין חל ביום וא"ו, עפמ"ש במכתבי הא', הוא מפני שנכלל בו יום ב' בכי טוב מאד, אבל מה שנכלל יום ב' בכי טוב זה נעשה רק ע"י ואחרי בריאת האדם, מתאים לפשוטו של מקרא, ולכן אין טעם זה שייך בר"ה הראשון.
ו) כתב לתרץ דברי הרמב"ם בקדה"ח (פ"ז ה"ז) ע"פ מ"ש בתשב"ץ דמטעם ירקי ומתיא אין מספיק לדחות המועדים אבל די הוא לקבוע ימי הדחי' לאד"ו -
הנה אני לא עמדתי כלל במכתבי ע"ז שהרמב"ם לא נקט טעם הש"ס. כי אף שהתשב"ץ אינו תח"י אבל ע"ד הנ"ל מבואר בפי' הר"ח בר"ה ובפי' היד על אתר (וכן מתרץ דברי הרמב"ם בס' בינה לעתים להרב גינזבורג, אף שלא זכר את התשב"ץ). ומה שכתבתי הוא רק העתקת השגת הראב"ד, דהרמב"ם מתחיל "מפני מה אין קובעין..
באד"ו" וסו"ס לא פירש "מה חטא אד"ו.. ומה זכה בגה"ז" וע"ז אין לתרץ דסמך שיודעים הטעמים המפורשים בש"ס כי הוא היפך דרך הרמב"ם בכ"מ להביא דוקא המפורש בש"ס וכידוע בכללי הרמב"ם.
ועוד דא"כ "לא נהג זה המחבר מנהג חכמים.. החל בשאלות וקושיות והניח הדבר בקושיא" (ל' ההשגות תשובה פ"ה). משא"כ לפמ"ש שהטעם הוא שלא רצה הרמב"ם לגלות אפילו ברמיזא מחכמת הקבלה מתורץ הנ"ל.
ובזה יש לתרץ גם השגת הראב"ד בהל' תשובה הנ"ל. כי גם שם שתק הרמב"ם מטעם זה.
ומדי דברי מכלל לא אד"ו ראש, אעיר אשר לדעת רה"ג הובא בפי' ר"ח (שבת קט"ו, א; ועייג"כ סוכה מג, ב) הוא הללמ"מ! (ועיין בפי' היד שם בפי' הר"ח בר"ה בשאלתות פ' ויקהל) פי' כלל זה ע"ד הסוד - בהגהות הרמ"ז סו"ס מבו"ש - דפוס ירות"ו - ס' קע"ח.
ז) כתב להעיר דבש"ס נמצא י"פ "גדולה תשובה" ח' בגלוי וב' בסתר. וצ"ע בכוונתו כי ביומא (פו, א ושם) לבד, ע"פ גירסת הע"י נמצא יו"ד פעמים ולא ט ' .
ולהעיר מה שצע"ק דבסוף ס' ראשית חכמה מונח כל המאמרים גדולה "שבכל הגמרא" שבתשובה ואינו מביא אלא ארבעה - וכן העתיק במדרש תלפיות - (ומהם א' שאינו בש"ס "שמקרבת את הרחוקים").
ח) בל' עשרת ימים שבין שכולל גם הגבולים ראיתי להרב נאה בספרו "שעורי תורה" מהדב"ת (ספר מיוחד במינו, וראוי לתשומת לב), ע' ר"י (ממאמר רז"ל, ר"ה [ו, ב], אין בין עצרת לעצרת ואין בין ר"ה לר"ה אלא ד' ימים, דכולל אחד מהגבולים).
