Greetings and blessing,

I reply to your letter, in which you ask me about what the Likkutei Torah says, on Parashas Beshalach, page 42b: "A woman who is niddah* or zavah* is purified by living water." You ask me what is the origin of this affirmation, the Poskim of the early and later generations considering that the purification of a niddah does not require living water.

It is clear that the Likkutei Torah is not a book of halachah. Equally, it is possible to explain, according to the hidden part of Torah, not only the opinion that is retained by halachah, but also the other opinions, for "both these and these are the words of the living Elokim."

An example will illustrate this affirmation. In the Likkutei Torah, Nitzavim, page 48a: "the shofar of Rosh Hashanah is a simple horn of an ibex." It is evident that this does not contradict the Derech Mitzvosecha, at the end of "the Injunction to rule on a commercial transaction" (in which the Tzemach Tzedek explains that he bases his explanation on the opinion that has been retained by halachah).

The necessity to purify the niddah with living water is established by the Tikkunei Zohar, at the end of the fifth Tikkun, which says: "The niddah is purified by the water defined by the Torah, that is, the living water that never knows interruption."

In this connection, you cite, in your book Taharas Mayim, on page 46, the opinions according to which the zavah is purified in living water, and it is fitting to add to the list that of Rav Nachshon, in Otzar HaGeonim on Shabbos, page 64, and the Zohar, vol. 3, page 97b. This adds itself to the Tikkunei Zohar, previously cited, for what is valid for the niddah is, a fortiori, true for the zavah.

In the responsa Shem MiShimon, of Rav Sh. Polak, first edition, section Yoreh Deah, paragraph 19, the Tikkunei Zohar is cited and it is said that living water is necessary for the niddah and, a fortiori, for the zavah. But, it is surprising that vol. 3 of the Zohar is not mentioned.

Perhaps it is possible to explain, as Rav Moshe Cordovero says, cited by the Or HaChamah, that vol. 3 of the Zohar requires living water for a count of seven weeks and not seven days. One cannot say the same for the zavah. And, one cannot give the same interpretation to the Tikkunei Zohar.

במענה על מכתבו, בו מעורר עמ"ש בלקו"ת בפ' שלח (מב, ב) וז"ל: לנדה ולזבה טהרתן במים חיים. ושואל מקורו, שהרי דעת פוסקים ראשונים ואחרונים אשר נדה אינה טעונה מים חיים.

והנה מובן, אשר הלקו"ת אינו ספר פסקי דינים, ומובן ג"כ אשר ע"פ נסתר דתורה צריך לבאר לא רק הדיעה דהלכה כמותה, אלא גם שאר הדיעות, כי הרי אלו ואלו דא"ח.

- ראה לדוגמא: לקו"ת נצבים מה, סע"א: שופר של ר"ה של יעל פשוט. - ופשיטא שלא קשה מדרך מצותיך סוף מ"ע לדון במו"מ. -

ומה שנדה טהרתה במים חיים - הנה כן הוא שיטת הת"ז בסופו (סוף ת"ה): כנדה כו' לדכאה לה במיא דאורייתא מים חיים דלא פסקין.

דרך אגב: במה שציין בס' טהרת מים (ע' מו) דעות הסוברים דזבה טעונה מ"ח, יש להוסיף עליהם ר' נחשון (וראה אוצר הגאונים לשבת סד) ואת הזהר ח"ג צז, ב (נוסף על הת"ז, דאתי במכש"כ מנדה).

בשו"ת שם משמעון להר"ש פאלאק - מהדו"ק חיו"ד סי"ט - העיר מת"ז הנ"ל דס"ל דזבה צריכה מ"ח (במכש"כ מנדה), ולפלא שלא הביא גם מזח"ג הנ"ל. ואולי אפ"ל, דבזח"ג הרי פי' הרמ"ק (הובא באור החמה שם) דצריך מ"ח, מפני שסופרת ז' שבועות ולא ז' ימים, משא"כ זבה דעלמא. אבל בת"ז אי אפ"ל זה.
