Greetings and blessing,

I received your telegram concerning this Rav (in this case, afflicted with a serious illness). You evoke the permission that may be given to him to pray and to study Torah (despite the obstacle constituted by his incontinence). You conclude by saying that perhaps one may permit him to do it by thought.

The study of Torah suffices, indeed, with thought, which is its essential aspect (since it is a question of understanding it). It is not the same, by contrast, for prayer, and one would therefore have to find for him a permission to pronounce the words of it and place the instruments (intended to collect the urine) in the manner that befits, in his room.

(The Rebbe notes, at the bottom of the page: "To decide the halachah* is not my purpose. Nevertheless, I will emphasize a few points here. On the one hand, one can consider that it is not a question of urine, in the measure that it emanates directly from the bladder via the catheter, without borrowing the normal circuit. One can therefore ask oneself from when the urine must be defined as such. Moreover, the presence of urine, including at the very moment of its flow, as the Magen Avraham says, at the end of chapter 76, is forbidden uniquely by the Sages and it therefore does not push aside what is defined by the Torah, nor even prayer and tefillin*, as Mechi Zahav explains, at paragraph 80. Finally, it is clear that the impossibility of praying and studying Torah will arouse discouragement and will therefore weaken the health of the sick one. Now, various practices have been permitted on this account. You will consult the Choshen Mishpat at chapter 254.")

I enclose for you an extract from a sichah* that will surely interest you. You will adopt a generous attitude and you will also place it at the disposal of others.

מאשר הנני קבלת המברק אודות הרה"ח כו' מוה"ר... מ"ש אודות ההיתר להנ"ל להתפלל וללמוד וכו' ומסיים שאולי יש להתיר ע"י הרהור, הנה בנוגע ללימוד אפשר יש להסתפק בלימוד ע"י הרהור כיון שזהו העיקר, משא"כ בהנוגע לתפלה יש להשתדל למצוא לו היתר להתפלל גם בדבור ולסדר באופן המתאים את הכלים בחדרו וכו'*.

... בטח יעניין את כת"ר קטע שיחה המוסג"פ וינהג בה טוב עין גם בנוגע לאחרים.

*) אין מעניני לפס"ד. ובכ"ז אציין בזה איזה נקודות: א) יש לצדד שאין לזה דין מ"ר, כיון שבאים ישר מכיס השתן (ע"י קאטעטאר) ולא מהאבר, והספק אם תיכף ביצאם מן הכוליא דין מ"ר להם. ב) גם מ"ר (ואפילו שותת - מג"א סו"ס עו) הוי רק דרבנן ואין דוחה דאורייתא וגם לא תפלה ותפילין (מש"ז ס"פ). ג) המניעה מתפלה ות"ת וכו' ודאי תפעול חלישות הדעת ובמילא גם חלישות הבריאות של החולה וכמה ענינים התירו מטעם זה (עיין חו"מ סרנ"ד).
