Greetings and blessing,
I had your news, with pleasure, through the Rav, distinguished Chassid* who fears Hashem, Rav Leib Zalmanov, who delivered to me your gift, the second volume of your book Eshel Avraham, bearing on the order of Nashim (of the Mishnah). May Hashem accord you the merit to embellish and to grow the Torah.
In fact, it is remarkable that this expression (embellishing and growing the Torah) be employed regarding the study of children. The latter emanates from "a breath that has not committed transgression." In spite of this, it is limited, in a first stage, to a very low level, as the Rambam emphasizes in his laws of Torah study, ch. 2, par. 7, and the Yad Mal'achi, principles, ch. 4. At the other extreme, one employs the same expression for a study that does not modify the halachah*, but brings only beauty and harmony, as tractate Chullin 66b says — which is the most elevated form of this study.
One knows, indeed, that each Yid* possesses his own portion of the Torah. An ignorant person must therefore do likewise, and he discharges his obligation by reciting a single verse of it. Conversely, the verse expresses itself severely ("He has shamed the word of Hashem") concerning the greatest erudite who, during a brief moment, could have studied Torah and did not do so, as tractate Sanhedrin 99a says.
In fact, the Torah is indeed the Wisdom and the Will of HaKadosh Baruch Hu*, but, by an effect of His Goodness without counterpart, He has made a gift of it here below. Before this was the case, Moshe himself forgot it, although he had received it from the mouth of Hashem on Mount Sinai, while he was cut off from the coarseness and even from the materiality of this world. Indeed, "he ate no bread and drank no water."
From this point of view, the greatest and the humblest are indeed identical. Thus, various texts establish that, in relation to the infinite, one, one million, and one hundred million are strictly identical.
With my blessing of success in all that, and that you have long days and good years,
P.S.: As is my habit and as a mark of affection, I will formulate the following few remarks concerning your book.
At its beginning, then on its page 358, you comment on tractate Kiddushin 16a. Here are my remarks:
A) The Ittur, mentioned by the Otzar HaGeonim at this reference, cites the text of the Gemara* and does not say: "Another reply: that he go to the beis din*."
B) Regarding the conclusion of your commentary, it is fitting to cite tractate Nedarim 45a: "One acquires it and the other two testify" — which means, in this instance, that he speaks in the presence of two persons. You will also consult tractate Gittin 33a and 40b.
C) The Noda BiYehudah asks himself whether an act of divorce must be done before a beis din*. You will consult, on this subject, the responsa of the Tzemach Tzedek, ch. 162.
D) The Tosafos on tractate Sotah, p. 78a (of Rav Neymark's book, commenting on tractate Sotah 40b), cite the Tosafos Yeshanim, and one can distinguish, on this subject, two points concerning the reading of the Torah:
1. On the one hand, the community is bound to listen to it, and not the individual, as the Milchamos Megillah explains, in ch. 1. You will also consult the Tzofnas Pa'aneach of the Gaon of Rogatchov on the Rambam, laws of prayer, ch. 12, par. 5.
As an obligation incumbent on the community, the reading of the Torah is comparable to the revelation of Sinai, which was accorded to all Yisrael. This is the reason for which "you do not have the right to cite orally what was given to you in writing." One must conserve the reference of this giving (to study the Torah as it was given). You will consult, on this subject, the responsa of the Radbaz, vol. 4, ch. 1205.
2. On the other hand, the reading of the Torah is also a part of the prayer, of which it is said: "We shall complete (our impossibility of offering sacrifices) by the bulls of our lips," or an addition to the sacrifice that is offered. In this sense, say the Tosafos Yeshanim, the reading of the Torah is indeed "for the use of the service of Hashem (in the Beis HaMikdash, which is replaced by prayer)." This is what the Yerushalmi affirms.
This aspect, by contrast, is not compared to the giving of the Torah to all Yisrael. In this regard, one cannot therefore say, "you do not have the right to cite orally what was given to you in writing." It is the same for the reading of the Torah recounting the sacrifices, during the festivals, on Rosh Hashanah and Yom Kippur, which is different from the other readings.
You will consult, on this subject, the Tosafos at tractate Megillah 30b and the Rambam, laws of prayer, who defines two principles regarding the reading of the Torah. For someone like you, this brief exposition will be sufficient.
At the end of your book, you comment on the expression of our Sages: "At the present time, numerous are those who have adopted this practice." You ask, with reason, from when one can consider that numerous are those who have adopted this practice. You explain that it was when a (Roman) decree forbade circumcision. At that era, one could not wait for a luminous day to do it, for it was then easier to be caught. One therefore practiced it on a cloudy day, when it is unusual to fix a circumcision.
It is difficult to accept this explanation. How could one practice a circumcision at a moment when it is dangerous to do so? And the account reported here makes the proof of the contrary. Indeed, the generation of the desert learned that it would remain there for forty years, that it would have, during all this lapse of time, the columns of cloud, preventing the north wind from blowing. In spite of this, the children were not circumcised.
How much more is this so when it is a question of a decree, which can always be annulled. One should therefore not have circumcised the children, and, in this manner, put their lives in danger.
It seems to me that the explanation can be found in the Tosafos who express themselves on a similar case, or perhaps even more surprising. Indeed, tractate Megillah 2b says that one had forgotten the letters Mem, Nun, Tzaddi, Pe, and Kaf, after Amon had burnt the Torah. One can say the same here. Indeed, "numerous were those who had adopted this practice" in Bavel, which was a plain (an isolated place), from various points of view. Then came Rav and the other Sages of the Gemara*, who ratified this usage.
The same expression is used regarding a bloodletting practiced on Friday (which should be forbidden, for it is dangerous; nevertheless, it is permitted because "numerous are those who have adopted this practice"), according to tractate Shabbos 129b. You will also consult the letter of Rav Sherira Gaon, which describes the situation of Bavel before Rav arrived there.

ונפלא הדבר אשר מובא זה בנודע ללימוד תשב"ר שאף שהוא הבל שאין בו חטא הרי בכ"ז הוא תחלת הלימוד ממדריגות התחתונות שבלימוד (רמב"ם ת"ת ב, ז. יד מלאכי כללים ד') ולאידך גיסא בהנוגע ללימוד שאינו משנה בדין ורק מוסיף הידור ויופי בהלימוד (חולין סו, ב) היינו מדריגה עליונה שבלימוד. והוא מתאים ג"כ להידוע שלכאו"א מישראל יש חלק בתורה. ומובן מזה שאפי' עם הארץ מחויב במצות תלמוד תורה ולו יהא באמירת פסוק אחד שבזה יוצא ידי חובתו ולאידך גיסא אפי' הגדול שבגדולים אם היתה שעה קלה שאפשר לו לעסוק בתורה ולא עסק עליו הכתוב אומר וכדרז"ל בסנהדרין (צט, א). והנקודה פנימית שבזה כי באמת התורה היא חכמתו ורצונו של הקב"ה אלא שבחסד חנם נתנה במתנה למטה כי לולא זאת הרי גם משה רבנו הי' משכחה אף שלמדה מפי הקב"ה בהר שלא הי' שייך לחומריות ואפילו לגשמיות כי לחם לא אכל ומים לא שתה, ובמילא היותר גדול והיותר קטן שוים בזה. והוא ע"ד המבואר בכ"מ שלגבי בלי גבול הנה אחד ואלף אלפין וריבו רבבן בשוה ממש.

כדרכי ולחביבותא דמילתא אבוא עכ"פ באיזה הערות בספרו זה, והם:
בתחלת הספר ונשנה בע' שנח במה דשקיל וטרי בש"ס קדושין ט"ז ע"א יש להעיר:
א) בספר העיטור הועתק ג"כ באוצר הגאונים על אתר, דמביא לשון הש"ס משמע דלא גריס התיבות אי נמי באפי בי דינא זיל.
ב) במה דמסיים בהשקו"ט דילי'. יש להעיר מנדרים מ"ה ע"א, כדי שיהי' אחד זוכה ושניים מעידין, שבנדון דידן הוא אמירה באפי תרי, ומגיטין לג. מ' סע"ב.
ג) בהנוגע לדעת הנו"ב, אי גט בעי בי"ד, ראה שו"ת הצ"צ סי' קס"ב.
ד) שם בתוס' למס' סוטה דף ע"ח ע"א, ד"ה במתניתין ובעשור שבחומש הפקודים במש"כ דברי התוס' ישנים. הנה י"ל בהענין דקריאת התורה דשני סוגים בזה א) חובת הצבור ולא חובת היחיד וכסברת המלחמות מגילה פ"א ד"ה ועוד אמר, וראה ג"כ צפנת פענח להגאון הרגצובי על הרמב"ם הלכות תפלה פי"ב הלכה ה'. וכיון שזהו חובת הצבור ה"ה בדוגמא דנתינת התורה שניתנה לכלל ישראל, ולכן דברים שנתנו בכתב אי אתה רשאי לאומרם בע"פ וכו' כי צריך להיות כנתינתה, עיין שו"ת הרדב"ז חלק רביעי סי' א'רה. סוג ב) שזהו חלק מהתפלה וע"ד ונשלמה פרים שפתינו או הוספה להקרבת הקרבן, וזהו כוונת התוס' ישנים דצורך עבודתו הוא, והוא מהירושלמי ובמילא אין זה בדוגמת נתינת התורה לכלל ישראל ולכן לא חל ע"ז הדין דדברים שבכתב אי אתה רשאי לאומרם בע"פ, וה"ה בכל קריאת הקרבנות ביום טוב ר"ה ויוהכ"פ דמחולקים משאר קריאת התורה, וראה תוס' מגילה ל, ע"ב וכן ברמב"ם הל' תפלה דחילק ענין קריאת התורה בשני הלכות ולדכוותי' יספיק הקיצור.
בסוף הספר בפי' מרז"ל האידנא דדשו בה רבים ושואל בצדק באיזה אופן בא המצב דדשו בה רבים, ורוצה לבאר שהי' זה בזמן הגזירה על מצות מילה ולא הי' בידם להמתין ליום בהיר כי דוקא אז השגיחו עליהם יותר ולכן עשו זה דוקא ביומא דעיבא היינו בזמן שלא הורגלו לעשות ברית מילה. אבל קשה לקבל את זה דכיון שסכנה יש בדבר איך מלו את בניהם ומגופא דעובדא ג"כ ראי' להיפך שהרי בהענין דדור המדבר הרי לאחר שידעו מהגזירה דארבעים שנה יהיו במדבר ובמילא יהיו ענני הכבוד מ' שנה ולא תנשב רוח צפונית - ובכ"ז לא מלו את הבנים ועאכו"כ בגזירה דגזירה עבידא דבטלה שלא הי' להם למול את בניהם ולסכנם. ומה שנראה לי לומר בזה שהוא ע"ד פירוש התוספת שבזה מבוארת קושיא כעין זו ואולי עוד יותר אי מובנת דאותיות מנצפ"ך שכחום (מגילה ב"ב) שהי' זה לאחר ששרף אמון את התורה ועד"ז יש לפרש בנדון דידן אשר דשו בה רבים הי' זה בבבל אשר בקעה היתה בכמה ענינים וכשירד רב לשם וכן שאר האמוראים מצא המצב דדשו בה וה"ה בהנוגע להקזת דם ביום ששי (שבת קכט, ע"ב) ועיין ג"כ באגרת רב שרירא גאון בהמצב בבבל קודם ירידת רב לשם.
