By the grace of Hashem*, 1 Adar* 5707, To our distinguished relative, the honorable Dr. A. Hillman [1], I greet you and bless you,
I reply to your letter of 13 Cheshvan* [2].
I have read and reread it, but I cannot accept the classification you make, for it departs from our faith and from Halacha* in general. Moreover, it does not conform to the content of chapter 32 of the Tanya*.
Halacha* retains as the determining criterion the motivation of the sin and the manner in which it is committed: by inability to contain oneself, incidentally [3], in defiance of Hashem*, or systematically. The nature of the sin itself, by contrast, matters little.
Let us take an example from the present era. One who acknowledges the unity of Hashem* and fulfills the Torah* and Mitzvot* He commanded, yet claims that Hashem* is not primordial — that there exists a prior matter from which He created the world — is a heretic, comparable to an idolater. And one may question the Guide for the Perplexed*, which does not express this as sharply. Nevertheless, in common parlance, one would not call such a man an apostate.
All the more so: one who is considered an apostate, and thereby passes himself off as a non-Jew, Hashem forbid, because he cannot control himself, and who then, for the same reason, adopts an immoral way of life, with no one concerned with bringing him back to the right path, is, in practical terms, in a less grave situation than the former.
You will find the references for this statement in the Rambam*, Laws of Teshuvah*, chapter 3, in his commentators, and in other texts as well. This is what I set forth in my first letter.
I will cite another example as well. It is permitted to lend at interest to one who, setting aside permitted food, consumes what is forbidden. By contrast, it is forbidden to lend at interest to one who, as a child, was taken captive by non-Jews and educated without any knowledge of the Torah* of Israel [4]. And those who contest this principle do so for other reasons.
To return to the Tanya* and to situate it in light of the definitions appearing in your letter, one may adopt the following three-group classification:
A) There are, first of all, those whom it is a Mitzvah* to love, and whom it is forbidden to hate. These are men who fulfill the Torah* and Mitzvot*, or, if they do not, cannot be placed in the third category and are not at all close, so that one finds it impossible to fulfill the Mitzvah* of rebuking them.
B) There are, next, those whom one must simultaneously hate and love. These are close enough that one can rebuke them, yet they do not repent.
C) There are, finally, those whom one can only hate. These are the wicked and heretics, categories of which the Rambam* gives a precise definition.
How does one distinguish non-religious Jews from the first and third categories? The former cannot control themselves, whereas the latter rebel against Hashem*. All those who defy Hashem*, insofar as such a situation exists today, belong to the third category (...).
The Rambam* speaks of one who rejects the entirety of the Torah* during a period of religious persecution. But the Or Sameach* refers to Rashi*, who speaks of 'one whose heart is drawn to idols, having witnessed the weakening of Israel's situation.' And one must still ask what definition the Yoreh De'ah* applies when it speaks of 'the wicked who rebel against Hashem*.'
I will now analyze the proofs mentioned in your letter:
A) The Tanya* says of those who belong to the first group: 'They have no share in the Hashem of Israel.' From what has been said, it is clear that not all those commonly regarded as renegades fall into this category. The Rambam* says: 'Heretics deny the primordial existence of Hashem*. The wicked deny the prophecy of Moses*. Those who reject the Torah* say that it, or even a single one of its verses, does not emanate from Hashem*.' It is evident that these are not apostates.
B) The Tanya* refers to chapter 16 of tractate Shabbat*, which speaks of 'those who adopt the behavior of other nations.' Rabbi Tarfon* and Rabbi Yishmael* thereby allude to the early Christians [5], who lived in their era. The Arukh HaShalem* makes it possible to establish this, despite the modifications imposed by censorship.
At that time, these Christians did not wish to distance themselves from the people of Israel; on the contrary, they sang Israel's praises. Until the intervention of Paul of Tarsus, they did not even wish to speak to other Christians [5]. They considered themselves complete Jews and had all the behaviors of Jews. Most of them studied Torah*, observed Mitzvot*, and mocked the idols that prevailed at the time. All this is well known.
At the conclusion of this passage, tractate Shabbat* attributes to them these words: 'We have not come to diminish anything from the Torah* of Moses*.' Nevertheless, they adopted idolatrous practices, though one may still question this. They mocked the unity of Hashem*. Yet they were not apostates in the sense currently given to this word. They were non-religious Jews who committed sins, wicked men.
C) Tractate Shabbat*, in designating the wicked, alludes to the Christians — that is a fact. Nevertheless,
1. the Christians of that era are not the apostates of our era, as has been said,
2. if the Alter Rebbe* had interpreted tractate Shabbat* in this way, he would have written in the Tanya*: renegades, apostates, or adherents of the faith of Ishmael* — terms that were commonly used to designate them because of censorship — but not a word that, in rabbinic literature, has a precise meaning, as we have seen,
3. the Alter Rebbe* also speaks in the Tanya* of heretics, and therefore alludes to at least two categories of persons.
D) The Choshen Mishpat* says: 'Jewish heretics are apostates' — and not idolaters. I do not know what proof you derive from this statement and what follows from it for our discussion. The Choshen Mishpat* continues, in fact: 'The same applies to one who commits sins to defy Hashem*, eating non-kosher meat for this purpose, or wearing garments in which wool and linen are mixed.'
It is equally clear that, in the Talmud* and in the writings of the early Sages, an apostate, in the strict sense, is one who adopts idolatrous practices, even if he otherwise does not deviate from Jewish practices. However, the situation was later modified and it was established that it was not sufficient to serve idols — one also had to embrace the prevailing faith and integrate oneself among other nations. Thus the term 'apostate' took on a somewhat different meaning, or retained only its most visible aspect: the fact of separating oneself from the people of Israel, of living in a non-Jewish context, of no longer sharing in the sufferings of the Jews. But some also challenge this last point.
The Beer HaGolah*, commenting on the Choshen Mishpat*, says at paragraph 80 [6]: 'The Rambam's* reference is the Baraita* and the Gemara* of tractate Avodah Zarah*. But there exists another version, which I have cited elsewhere.'
E) The Shulchan Arukh* of the Alter Rebbe* says: 'Heretics reject the Torah*' and 'Wicked Jews reject the Torah*.' You seem to conclude from this that both terms are synonymous. In fact, there is a printing error there, and one should read 'heretics' in both cases. The context makes it possible to establish this, which reads: 'One who consumes a forbidden food is wicked, and the wicked remain Jews.' How is one to understand this repetition? By incorporating heretics within it as well. The Kuntras Acharon* makes the same deduction possible, when placed in its context.
F) Concerning the term 'apostate' cited in the Talmud* and the manner of interpreting it, you should consult the Arukh HaShalem*.
G) Concerning the English book on Bereishit* [7]: good things and errors are found in it. Some of the new explanations found there are surprising in their interest. Other passages are not correct, and the author did not agree to modify them.
Nevertheless, the positive part of this book is the most important. In the current situation and in the context of the struggle against the missionaries, who are a scourge in this country, this work is an effective tool, and it was therefore decided to publish it. In recent years, this book has led many people to love the Torah* and Judaism*, to deepen their desire to study the Torah*. It is distributed by its author, who sells it for seven dollars. קראתיו פעם ושתים, אבל איני יכול להסכים לחלוקת הסוגים שעושה, כי אינה מתאמת לנקודת מבט הדת וההלכה בכלל ולדברי התניא פל"ב בפרט.
בהלכה "אבן הבוחן" העיקרית היא טעם ואופן עשית העבירה, אם לתיאבון ובדרך עראי או להכעיס ובקביעות, ולא מהות העבירה עצמה.
דוגמא לדבר מזמננו זה: האמר אמת שיש אלוקה יחיד - (ובמילא מקיים האומר את התווהמ"צ) אבל אומר שאינו לבדו ראשון כי יש שם חומר ראשון קדום וממנו ברא העולם ה"ז מין, כעוע"ז (וצע"ק ממו"נ ח"ב פכ"ה דמשמע שאין זה שניות), אף שבלשון בנ"א אינו נקרא משומד, וקל ממנו, אף שקורין אותו משומד, מי שרשם עצמו לאינו יהודי ח"ו לתיאבון ואח"כ חי חיי הפקרות לתיאבון כי אין מי שיוכיחו לתקן עותתו, המקורים לזה יעויין ברמב"ם הל' תשובה פ"ג, בנ"כ שם ועוד, וכמש"נ במכתבי הראשון.
עוד דוגמא מאן דשבק היתרא ואכל איסורא מותר להלוותו ברבית. מי שנשבה כשהוא תינוק לבין העכו"ם ואינו יודע מתורת ישראל כלל אסור להלוותו ברבית (יו"ד סקנ"ט) . - (החולקים בזה הוא מטעמים צדדיים) -
ובנוגע למ"ש בתניא, הנה אם להשתמש במושגים שבמכתבו ולחלק לג' סוגים דוקא, תהי' החלוקה: א) אלו שמצוה לאוהבם ואין שם שנאה כלל (מקיימי תומ"צ, חפשים שאינם בסוג ג' ואינם מקורבים אליו כלל, עד שאין שם מקום למצות הוכח תוכיח).
ב) אלו שצ"ל להם שנאה וגם אהבה (המקורבים אליו והוכיחם ואינם שבים).
ג) רק שנאה (מינים ואפיקורסים וכמו שנתבאר מהותם ברמב"ם שם ועוד).
וכללות החילוק בין החפשים שבסוג א' וג' הוא: לתיאבון או להכעיס, זאת אומרת שכל הנכנסים בסוג ג' הם - להכעיס (אם יש עתה מומר להכעיס להעיר ב"ח יו"ד סו"ס שם. הרד"ק בית חדר. שו"ת מהר"ש הלוי יו"ד סי' כט).
(ומ"ש ברמב"ם שם ה"ט מומר לכל התורה כו' בשעה שגוזרין שמד כו' - כבר ציין באור שמח לרש"י ע"ז נד, א, וברש"י שם מסיים: אחרי שרואה את ישראל ידם מטה נוטה לבו לע"א, וצע"ק ממ"ש בלח"מ שם, כן מ"ש ביו"ד סו"ס קנ"ח בהג"ה: מומרים כו' ה"ה כמו מומרים להכעיס, מדבר במומרים סתם שצריך עדיין לברר מהותם יעוין תוד"ה אני ע"ז כו, ב).
ואבוא עתה לראיותיו במכתבו.
א) בנוגע לסוג הג' אומר בתניא אין להם חלק באלקי ישראל - ע"פ הנ"ל מובן דלא כל הנק' משומדים, בלשון העולם , נכנסים בכלל זה, ולא כל הנכנסים בכלל זה נק' עתה משומדים, וראה ברמב"ם שם: והמינים כו' האומר שאינו לבדו ראשון כו' אפיקורסין כו' המכחיש נבואתו של משה רבנו כו' הכופרים בתורה האומר שאין התורה מעם ה' אפילו פסוק אחד. - שכל אלו לא יקראו עתה משומדים.
ב) בתניא מצטט לר"פ ט"ז בשבת ושם מדבר במתנכרים, - הנה ר' טרפון ור' ישמעאל מדברים שם בנוצרים שבימיהם היינו הנוצרים הראשונים (יעויין בערוך השלם מע' און, בי אבידן שהובא שם מה שנשמט ע"י הצענזור ומוכח כנ"ל), והנה כת זו בעת ההיא לא חפצו להבדל מעם ישראל ואדרבה דברו בשבחו (ועד שבא שאול מתרשיש הרי גם לא רצו לדבר עם הנכרים) חשבו עצמם מבני ישראל בכל הענינים נהגו במנהגיהם לרבות למוד התורה וקיום המצות ברובם המכריע והיו מבזים את אמונת הפסילים היינו הדת השלטת אשר בעת ההיא, וכידוע, וראה בשבת בסיום הסוגיא שם: אנא לא למיפחת מן אורייתא דמשה אתיתי כו', אלא שהי' בהם ענין של ע"ז (וצ"ע איזה) והיו מלעיגים על אחדות מדרז"ל (ראה בהשמטת הש"ס הובאו גם באוצר ישראל מע' ישו) - זאת אומרת אשר לא היו משומדים, כמו שמפרשים עתה מלה זו, אלא ישראלים חפשים, עוברי עבירה, מינים.
ג) המינים שבש"ס שבת שם קאי על הנוצרים - אמת כן הוא וכנ"ל, אבל א) אין הנוצרים שבעת ההיא מתאימים למושג משומדים אשר בזמננו, וכנ"ל, ב) רבנו אם הי' מפרש בש"ס (שבת שם) מינים - משומדים, הי' כותב בתניא "משומדים" או "מומרים" או מי שנהפכו לדת הישמעאלים וכיוצא בזה כנוים הרגילים במקרים אלו מפני הצענזור, ולא הי' משתמש במלה שנתפרשה בכ"מ בספרות ההלכה באופן מדויק אי מתאים לכוונה הנ"ל, ג) רבנו בתניא מוסיף גם את האפיקורסים, ועכצ"ל שהוא מדבר, עכ"פ, בשני סוגים.
ד) בחו"מ סתכ"ה כ': אפיקורסים מישראל והם משומדים - ולא עוע"ז - איני יודע מה ראי' היא זו ומאי נפ"מ לעניננו כיון דממשיך שם: או העושה עבירות להכעיס אפילו אכל נבילה או לבש שעטנז להכעיס - גם פשוט אשר בש"ס וראשונים משומד במובנו הפרטי היינו העובד ע"ז אף ש בכל שאר הענינים אינו נבדל ככל וכלל מבנ"י (אלא שכשהתחילו להכריח ולגזור לא על ע"ז בפני עצמה אלא על הכניסה לדת השלטת ולהיות לאחד מעם הארץ, נשתנה מעט מעט תוכן תיבת "משומד", עד שנשאר בה החלק הבולט ביותר, היינו שהוא פורש מבנ"י, חי רק בסביבת עם הארץ, אינו מציר וסובל בצרות ישראל וכו'), - ואפילו בזה יש מפקפקין יעויין בערוך השלם מע' מד ג' ומע' משמד,
- באר הגולה בחו"מ סתכ"ה אות פ' ז"ל: ל' הרמב"ם שם פ"ד ה"י מברייתא פ"ב דע"ז דכ"ו ע"ב וסוגיא דגמרא שם ויש נ"א בב"י והעתקתי' בי"ד סקנ"ח וע"ש, עכ"ל.
ה) בשו"ע רבנו הזקן הל' מציאה ופקדון סל"ט כ': ה אפיקורסים הם הכופרים בתורה, ובהל' נזקי גוף ונפש סי' י': וה מינים מישראל הם שכופרים בתורה - וכנראה כוונתו שא"כ ראי' [ש]אין להבדיל בין מין ואפיקורוס, - והנה פשוט אשר בהל' נזקי גו"נ טה"ד הוא וצ"ל: והאפיקורסים, וכמוש"כ בהל' מציאה ופקדון ובכל המקומות שצויינו בתור מקורים להדין בהל' נזקי גו"נ, ומוכרח גם מסגנון הסעיף גופא "ואכל האיסור להכעיס ה"ז מין וה מינים מישראל הם כו'" כפל לשון אי מובן, אבל פשוט אם צ"ל כנ"ל "ה"ז מין והאפיקורסים מישראל", גם מוכרח מקונטרס אחרון שבסעיף זה שכותב דל"ד ל אפיקורוס דהכא".
ו) בענין "משמד" שבש"ס וקלקולי הצענזאר בזה יעוין בעה"ש מע' משמד וכנ"ל.
ז) ע"ד הספר (באנגלית) על בראשית, הנה הוא תערובות טוב וטעיות, יש בו כמה ביאורים ורעיונות מפתיעים בחידושם, אבל גם ענינים שאינם אמתיים, המחבר לא הסכים לשינויים, וכיון שהטוב הוא מרובה והעיקר אשר במצב ההוה פה במקצוע תעמולת המיסיונרים (מכת מדינה כאן) יכול לשמש כלי זיין טוב נגדם נחלט להו"ל, ובמשך השנים שעברו מאז השפיע הספר בחוגים שונים לקרבם לאהבת התורה והיהדות ולעורר בהם חשק להעמיק בלימוד התורה, הספר נמצא למכירה אצל מחברו ומחירו שבע דולר אם רוצה לקנותו יודיעני ואצווה לשלחו לו.

בימים הקרובים לכתיבת האגרת שלפנינו נסע כ"ק אדמו"ר שליט"א לפריז, לפגוש את אמו הרבנים ע"ה שהגיעה לשם, לאחר שניצלה מרוסי', בדרכה לארה"ב.
כ"ק אדמו"ר שליט"א שהה שם עד שלהי סיון, שאז חזר, עם אמו הרבנית ע"ה, לארה"ב.
על שהותו שם ראה מבוא לאג"ק ח"ט ע' 14-15. כפר חב"ד י"א ניסן תשמ"ז ע' 61. ממשך שהותו שם, יותר משלשה חדשים, הגיעה לידינו רק האגרת שלאח"ז.
