Greetings and blessing,

I received the proofs of the collection of commentaries on the Torah of the Ramban, to which were attached your notes. I thank you for having kindly addressed them to me. In leafing through these pages, I had pleasure in observing the work and the wisdom invested in these notes. As is the custom, I enclose a few remarks that I formulated, which concern the beginning of the introduction of the Ramban.

I also address to you a few remarks on your fascicle entitled "Proposal for the Establishment of an Eruv*." You know the explanation that our Sages give of the verse: "And Vahev at the end" (they explain that the discussion of the law by the Sages can be very lively, without calling into question the cordial relations they maintain and which they recover naturally as soon as this discussion ends).

On this occasion, I address to you once again my wishes of good travel. May you advantageously use the influence that you will exercise, during your stay in the Holy Land, in order to reinforce the image of the Tradition of Israel, with pride and dignity.

Remarks on the collection of commentaries on the Torah of the Ramban

In the Mishneh Torah, the future is also used: "I will divide the laws... I will divide it." In a general manner, it is a little curious to imagine that the book was drafted before its introduction. As for the contradiction noted between two of his texts — the laws of Shemittah and Yovel*, chapter 10, paragraph 6, on the one hand, which states as date one thousand one hundred seven years after the destruction of the Beis HaMikdash*, and the introduction, on the other hand, which says one thousand one hundred eight years after it — a clarification remains necessary even if one sets it aside, since in the laws of the sanctification of the new month, chapter 11, paragraph 16, it is a question of one thousand one hundred nine years after this destruction.

One can add that, in the laws of the sanctification of the new month themselves, in chapter 9, it seems that these were drafted one thousand one hundred years after the destruction of the Beis HaMikdash*.

In fact, one can explain all this (see the Rebbe's discourse delivered Shabbos Parshas Chukas 5744) by recalling that, after having drafted the Mishneh Torah, the Rambam reworked it on several occasions. You will see, on this subject, the Shulsinger edition of the Rambam, at the end of the fifth volume. Obviously, in the second edition, the Rambam modified only the laws that needed to be, but not the entirety of his manuscript, all the more that copies of the first version were already widespread, as the letters of the Rambam and his son attest.

It is therefore possible that the ninth chapter of the laws of the sanctification of the new month was drafted, for its first version, in the year one thousand one hundred, and was not modified in subsequent versions. The eleventh chapter, by contrast, was modified and rectified subsequently. It was therefore only completed in the year one thousand one hundred nine.

As for the introduction, it was drafted when the Rambam had determined not only the number of volumes, but also the laws that would be treated in each of these volumes, according to the detail given at the end of this introduction. It was then that the Rambam disposed of all the necessary material. For all that, the introduction was indeed drafted before the book, and besides, the Rambam concludes it with: "I will now begin to explain the laws of each mitzvah*."

From what has just been said, one can understand that it is possible to fix, according to all opinions, the year during which the Rambam began the drafting of his Mishneh Torah. The Seder HaDoros and other texts treat of this subject. As we have seen, the first year cited is indeed the one thousand one hundredth.

Same page, "with fear and... sweat":

One can note, on this subject, the formulation of the Gemara, in tractate Berachos 22a. The Ramban also speaks of "worry," and one can question this word, for, according to the esoteric teaching of the Torah, the four terms employed here ("fear and dread, trembling and sweat" — what Bnei Yisrael felt when they received the Torah, and what each one can still feel today, at the moment of study) are precise, and they correspond to the four letters of the Tetragrammaton, according to the Likkutei HaShas of the Arizal*, on tractate Mo'ed Katan.

In this connection, there is, in all the editions I have been able to consult, an evident omission concerning the explanation of this term "sweat," which affects the external members of the body and is linked, in its esoteric dimension, to the heh of the Tetragrammaton, to the "outer garment." Indeed, the copyist forgot the third "of the Name" and went directly to the fourth (he omitted the third "letter of the Name," so that he passed directly from the second to the fourth). Now, for the moment, I have not seen anyone make the remark!

In this case, the rhyme — here a kamatz — could have been respected if one had put in parallel eimah (fear) and ze'ah (sweat). Perhaps it is conceivable that the term "worry" alludes to the point that is above the yud (and that is added to the four letters of the Tetragrammaton, thus constituting an independent level). From different points of view, this is considered an independent stage, detached from the yud.

Thus, our Sages say, in the Midrash Bereishis Rabbah, ch. 14, par. 9: "It bears five names" (the Jewish soul has five parts, corresponding to the four letters of the Name of Hashem and to the point of the yud; the latter is therefore indeed an independent stage), whereas the Zohar*, vol. 1, page 79b, cites only four. Tractate Berachos, like the Zohar*, mentions only four levels. In such a case, "worry" is part of "fear," but this subject will not be developed here.

For the moment, I have found the equivalent in no other text. Perhaps the copyists made an error. One should therefore read: "an egg of a louse," which is the smallest animal, according to tractate Shabbos 107b, and corresponds nonetheless to the highest constellation, which is the most important creature.

You will consult the Rambam, Hilchos Yesodei HaTorah, chapter 2, paragraph 9, and the Sha'ar HaYichud VeHa'emunah of the Alter Rebbe, chapter 7, page 83a.

Remarks on the collection "Proposal for the Establishment of an Eruv":

Page 1, paragraph 2, "the conception of Rashi":

This is what the Alter Rebbe explains, in his Shulchan Aruch*, chapter 345, paragraph 11, and several other texts. The responsa Beis Av, second part, paragraph 5, and the indices mention thirty of the early Decisors who adopt the position of Rashi.

Same page, 1.1.:

The number of six hundred thousand also includes non-Jews, and one can justify this in the following manner. It is, indeed, at Marah that Bnei Yisrael* received the mitzvah* of Shabbos, according to Tosafos, in tractate Shabbos 87b, while they were still considered as Bnei Noach* (and not as Yidden*, since the Torah had not yet been given). One knows, on this subject, the opinion of several of the early Sages. Subsequently, when the Torah was given, Shabbos was instituted "as it was commanded to you" at Marah.

Page 2, paragraph 3, "according to all opinions, the public domain is defined by the Torah":

One can question this. It seems to me that, in the end, all the streets terminate in bridges or tunnels, closed by a gate, a barrier, or a tollbooth permitting the collection of a toll right. You will consult the Aderes Eliyahu of Rav A. of Butchatch, at chapter 345.

Page 3, definition of the sea and a river:

This definition has an incidence, for example, on the drafting of a get* (in which it is necessary to specify where it was drafted; the contours of a place must therefore be precisely defined). One can take as criterion (for defining a river or a sea contributing to enclose a certain place) the fact that the waters gather in one place and remain there, even if there is a wave, or rather that they flow, in accordance with tractates Mikva'os, ch. 5, Mishnah 4, Makkos 4a, Yevamos 141a. You will see the responsa Tzofnas Pa'aneach, of the Rogatchover Gaon, at chapters 58 and 59. But, in reality, it seems to me that one must consider each place according to its particularities.

In the laws of Eruv*, everything depends on what one effectively sees, on the fact that a sandbank forms and freezes, at least from time to time, or rather that this never happens.

This permits understanding why the early and the latter Sages detail numerous laws in the matter and specify the various risks, the forms of rivers, of pits, although the Talmud does not speak of them.

In consequence, it is necessary to specify the contours of Manhattan, such as they are cited here. One will consult, in addition, the references cited on this subject by the new Orchos Chaim, at chapter 343.

Page 3, "the fear, according to one opinion, that the sea form a sandbank":

One can question this, for the Rema rules in this sense. You will see, on this subject, the Yad Mal'achi, rules of the Rema, chapter 18. The Alter Rebbe also retains this opinion for halachah*, at chapter 363, paragraph 38.

According to the opinion of the Alter Rebbe, at the same reference, it is good to take account of the words of the one who forbids.

Page 4, paragraph 8, "one sees first the highest houses":

In my humble opinion, it is totally excluded that, by constructing a tower, particularly elevated, in the middle of a large enclosed terrain, the latter, although defined as a public domain by the Torah, be considered as a private domain. One cannot say either that, since from a building one can see the totality of a surface, that surface is, according to the Torah, a private domain. This would pose anew the question of the Talmud, in tractate Eruvin 22b: "All recognize that one could enclose the ocean," according to the interpretation that Rashi gives of this enclosure, and as is recounted by the Shlomo on the Yerushalmi*, cited by Tosafos, in tractate Avodah Zarah 41a.

According to this, one would have to say that one has this vision while standing on the ground. Tractate Bechoros 54a speaks of sixteen mil. But perhaps the distance is greater in this case. Indeed, one must be able to observe in order to guard and to count, which is not the case when there is an enclosure.

One can cite, on this subject, tractate Pesachim 94a, according to which one can bring in horses and mules. You will also consult the definition of "a place close by," such as is given by tractate Mo'ed Katan, page 22a. Now, in our days, one travels by train or by airplane. The discussion of our holy books on this subject is presented in the Kol Bo of Rav Greenwald, vol. 1, page 330.

קבלתי הגליונות של הספר פירושי התורה להרמב"ן בצירוף הערות כת"ר שי', ות"ת על טרחתו לשלחם אלי. ונהניתי בעברי על הדפים ובראותי כמה מלאכה וחכמה השקיע בהערות אלו, ועל פי המנהג, הנני מצרף בזה איזו הערות משלי בהנוגע להתחלת פתיחת הרמב"ן.

כן מוסג"פ איזה הערות על קונטרסו "הצעה לתיקון עירובין". וכבר ידוע פירוש רז"ל על הפסוק ואת והב בסופה.

ובהזדמנות זו עה"פ אביע את איחולי לכת"ר שי' לנסיעה כשורה ובהצלחה ולנצל את השפעתו בהיותו באה"ק ת"ו להרמת קרן ישראל סבא בגאון וביד רמה.

הערות לקונטרס פי' התורה להרמב"ן וכו '.

שורה ג. הא' - והנורא. יש להעיר: מלה"כ דברים י, יז. וראה יומא סט, ב.

שם. אתחיל וההערה ע"ז. גם בהקדמת הי"ד משתמש בל' עתיד ואחלק ההלכות ... אחלק אותו . ובכלל תמוה קצת לומר שנכתב הספר קודם לההקדמה. - והסתירה שבין השנים, בהל' שמיטה ויובל (פ"י ה"ו) אלף ק"ז לחורבן ובהקדמה - אלף ק"ח - הרי כבר העיר שבלאה"כ צריך בירור, מה שבהל' קדה"ח (פי"א הט"ז) נמצא אלף ק"ט (כצ"ל) לחורבן.

ויש להוסיף ע"ז מה שבהל' קדה"ח עצמן משמע קצת, שנכתבו בשנת אלף ק' לחורבן (פ"ט ה"ה).

ולכן אפשר, אשר פ"ט מהל' קדה"ח נכתב במהד"ק בשנת אלף ק' ונכנס הפרק כמו שהוא במהדורות שאחריו. ופי"א חלו בו שינוים או תיקונים לאחר זמן, ועריכתו הסופית הייתה בשנת אלף ק"ט.

וההקדמה הרי נכתבה לאחר שכבר יכול הי' הרמב"ם לקבוע לא רק מספר הספרים, אלא גם ההלכות והמצות שנת' בכל ספר וספר, וכמו שמפרטן בסוף ההקדמה - היינו שכבר הי' כל ה"חומר" מוכן אצלו, אבל - קודם לכתיבת הספר, וכמו שמסיימה: ועתה אתחיל לבאר משפטי כל מצוה וכו'.

וע"פ כהנ"ל מובן ג"כ, שיש מקום לכל הדעות ע"ד שנת התחלת עסק הרמב"ם בספרו משנה תורה (הובאו בסה"ד ובכ"מ. והמוקדמת שבהם - שנת אלף ק'. וכנ"ל).
