Greetings and blessings,
I received your two seforim*, Machaneh Ephraim and Binyan Halachah. Thank you very much for this gift. Surely you will continue in the future to send what you publish to the library. Thank you in advance.
By way of friendship, I formulate at the foot of this letter a few remarks inspired by my hasty examination of these seforim.
May Hashem grant that each one of us contribute to building the mikdash* of HaKadosh-Baruch-Hu* and the Shechinah*, and accede with profit to Torah, tefillah*, and teshuvah*, as Chazal* explain in Shabbos 114a, the beginning of Tikkunei Zohar*, in the section beginning 'building a mikdash for HaKadosh-Baruch-Hu,' Bechoros 44b, Midrash Devarim Rabbah ch. 3 § 6, Kiddushin 40a, and Zohar Bereishis 26b — explaining how one may grow and produce fruit.

P.S. At the beginning of Binyan Halachah, page 1: It is stated that 'devarim shebe'al peh, ee atah rashai lekosvan*'[2] — that which was given orally one may not write down.
On this you will see Shulchan Aruch Orach Chaim siman 49, and one may ask why the Ein Mishpat on the Talmud does not cite this reference. You will also see what the Sdei Chemed says and cites — Klalim ch. 4 § 34 — and the Pe'as HaSadeh ch. 4 §§ 4 and 22, and the Orchos Chaim on siman 49.
At page 2: You cite as a reference a passage from Taanis*[3].
Now, one may question its meaning, for it seems to indicate that those pesukim* may be recited by the tzibbur*[4]. It says: 'Yachid mahu she'omran? Tzibbur omran. Hakol miskansim lekorosan' — 'Can an individual recite them? The tzibbur recites them. All gather to read them.' One must conclude that the prohibition applies when one reads to discharge the others' obligation and they merely listen[5].
This is what the Sefer Mitzvos Gadol* indicates, which you cite afterwards. The Alter Rebbe* paskens this way in his Shulchan Aruch siman 49. You will also see the Magen Avraham* and the Machatzis HaShekel* at that reference.
At page 3: The reason for the prohibition is given. They must be said as they were given[6].
You will see on this the responsa of the Radbaz*, vol. 4, siman 1205. You will also examine the bearing this may have on krias haTorah*. See Zohar vol. 2, page 206a.

You explain in the Binyan Halachah that, regarding these prohibitions, no distinction can be drawn between krias haTorah and public learning[7]. Now, one may further ask:
A) Why does the Rambam* not cite these laws when speaking of public learning? It is clear he cannot rely on what he says in the introduction to his sefer or in the Moreh Nevuchim*. Indeed, that introduction is a sippur, without halachic weight.
B) How could the prohibition[8] have been lifted, according to the Rambam in Hilchos Tefillah ch. 12 § 8, when the Kohen Gadol* on Yom Kippur* reads 'Ach be'asor*'[9]?
C) How can it be explained, on this view, that one is permitted to read the Megillah* sitting, whereas during public study one stands, as the Yerushalmi* says regarding that mitzvah*? The Megillah cannot be inferior to a text of Torah she'be'al peh*, which one must recite with deference. Moreover — and this is essential — on what basis do you assert that the Rambam applies the same prohibitions to public learning?
In my view, one must interpret the Rambam in the sense he himself clearly specifies. It is therefore prohibited to read the Torah without a written text. Likewise, it cannot be translated[10] from a written text, as the Yerushalmi says.
The Rambam holds that in this matter the Yerushalmi merely makes the Bavli* explicit. The Binyan Halachah says the same. You will see the Tosafos* on Yoma 87b, the Tosafos Yeshanim on Yoma 79a, and what the Sdei Chemed says — Klalei HaPoskim ch. 2 § 1.
One may also entertain that the Yerushalmi disputes the Bavli, but that the halachah is nevertheless paskened like the Yerushalmi, since the stam Mishnah of Yoma 68b — that the verse 'Ach be'asor…' is read by heart — contradicts what the Bavli says in Gittin 60b.
One can justify in various ways the superiority of krias haTorah[11]. One of them: it is a chovas tzibbur, not a chovas yachid, as the Milchamos on Megillah ch. 1 says. You will also see the Tzafnas Pa'aneach on Hilchos Tefillah ch. 12 § 5.
The same is not so for krias haMegillah, which is therefore permitted in a sitting position. A particular derivation is moreover required to establish that it cannot be read by heart[12]. And if it is not so for the Kohen Gadol's krias haTorah, that is because of his avodah*[13], as Yoma at the previously cited reference specifies.
If I may take the liberty, I would say that the reading of the parshas hakorbanos on Yamim Tovim, on Rosh Hashanah*, and on Yom Kippur is different from all other readings. You will see Tosafos on Megillah 30b and Riva's commentary on Tosafos Yeshanim Yoma 70a. Nevertheless, where it is feasible and frequent, the laws have not been changed, in order not to introduce distinctions[14] — which is not the case for the Kohen Gadol's reading.

But one may further ask: if so, why did Chazal not themselves write down Torah she'be'al peh? Yet 'sha'arei beiurim lo nin'alu*'[15].
One can therefore think that it would not have been forbidden to do so. Yet Chazal did not write it down because:
A) one must take into account the view of the Bavli, if one holds it contradicts the Yerushalmi;
B) it is also said 've'echtov lo rubei Torasi*,' as the Gemara* in Gittin at the same reference says;
C) one must also refer to the reason given in the Moreh Nevuchim, vol. 1, ch. 71. You will also see Zohar vol. 1 page 253a; the Alter Rebbe's Likkutei Torah, biurim of Sukkos*, page 80b.

In your remarks under the title 'Hearos Chaim,' page 14a, you cite the Alter Rebbe's Shulchan Aruch regarding the property of that from which one may not derive benefit.
I had at hand the responsa Chesed Yehoshua published in New York in 5713[16]. There is a discussion on this subject there in siman 23. One could raise an objection considering what is said there, but the time at my disposal does not permit me to do so.

בישראל להתבונן בחלק החשוב שהי׳ לאשה היהודי׳ בחגים אלו ,ומה
צריך להסיק מכך.
חג הפורים ,כמו גם חג הפסח ,מחייבים את האשה היהודי׳ לשמור
את המצוות המיוחדות הקשורות בחגים אלו)כמו מגילה ,הגדה וכו׳{,
משום שלאשה היהודי׳ הי׳ זכות וחלק מיוחדים בניסים שהתרחשו
בימים ההם בזמן הזה.
המגילה )מגילת אסתר( מספרת לנו במפורש כיצד אסתר סייעה
להביא את הנס הגדול לכלל ישראל ,ועל שמה נקראים התענית שלפני
פורים והמגילה.
אודות הזכויות הגדולות של הנשים היהודיות בקשר לפסח ,זמן
חירותנו ,מסופר בפרוטרוט במדרש .באותם זמנים קשים של גלות
מצרים היו נשי ישראל אלו ששמרו על עוז הרוח והבטחון של הגברים

וגידלו דורות של יהודים מסורים ,אשר זכו לקבל את התורה על הר סיני
ואת הנחלה הנצחית ,ארצנו הקדושה תבנה ותכונן על ידי משיח צדקנו
במהרה בימינו.
אופן תרומת נשי ובנות ישראל לנסים הגדולים של החגים הנזכרים
לא היתה זהה:
בפסח -השפעת הנשים היתה מופנית בעיקר כלפי הבית ,כל כבודה
בת מלך פנימה ,ע״י צניעות וחיי משפחה.
בפורים -נדרש שהאשה היהודי׳ תנצל לפי דרישת והוראות
המדויקות של גדולי התורה והיראה את מצבה ואת השפעתה במלוא
המידה ,לגמרי לטובת עמה ,והיא עשתה זאת במסירות נפש בפועל ,תוך
סיכון חיי׳ לטובת קיום עמנו.
שני החגים -פורים ופסח ״ הם שתי עדויות נצחיות ,שהאשה
היהודי׳ מסורה בלב ונפש ,הן בבית הן בחוץ כאשר התנאים דרשו זאת,
לתורה ומצוות ,טהרת המשפחה ,וחינוך הכשר של הילדים -היסודות
העיקריים של קיום וגאולת עמנו.
נשי ובנות ישראלי .העתיקו את הדוגמה של הנשים הצדקניות בכל
הדורות ,משום שעליכן ובידיכן מונח ,במידה רבה ,גורל עמנו.
וכאשר מתמסרים באמת למילוי החובות האלקיות ,עוזר השי״ת,
כפי שעזר לאסתר ,וכל הקשיים נעלמים והוא שולח ברכותיו האלקיות
בבני חיי ומזוני רויחא ,ובכל טוב גשמי ורוחני.

קבלתי מכתבה מט׳ אדר שני .הייתי מרוצה מחציו הראשון של
מכתבה בו הנני רואה שהבינה נכון את תוכן מכתבי לנשי חב״ד ב . . .
והעיקר שהגשימה זאת במעשה בפועל להתנהג כפי שצריכה להתנהג בת
ישראל בכלל ואשה חסידית בפרט ,והשי״ת ודאי יקיים את הבטחתו
שזה יוסיף ברכה והצלחה במה שנחוץ.

ובקשר לזה מפליא אותי במיוחד החצי האחר של מכתבה בו
כותבת שהיא מודאגת ממצבה כעת ,שהיא בהריון כו׳.
בכלל ,כל אחד מדורנו שזכו שהשי״ת הציל אותם ,ובפרט אלו
שראו נסים בפועל ממש שהשי״ת הוביל אותם מהמדינה הקודמת
והנהיג אותם דרך מדינות וגבולות שונים ,וסוף כל סוף הביא אותם
בשלמות למדינה רגועה ,הרי זו ההוכחה הטובה ביותר שהשי״ת רוצה
לשמור אותם ,וכאשר רק יעשו כלים מתאימים בודאי יתן להם השי״ת
את המצטרך להם ובפרט ילדים בריאים ,שזוהי אחת המצוות
הראשונות והעיקריות של התורה הק׳ והאושר העיקרי בפרט שיהודים
מייחלים לו.
והנני מקוה שכאשר תקבל מכתבי זה תפסיק לגמרי לדאוג אודות
האמור ותהי׳ בטוחה באמונה בהשי״ת ,שהוא בעל הבית היחידי של כל
העולם ועל כל מה שנמצא בעולם ,שהוא ברוך הוא יתן לה הריון קל
ובעתו תלד ולד חייא וקיימא ויחד עם בעלה שי׳ תגדל את הילד לתורה
ולחופה ולמעשים טובים.
ראוי הי׳ לבדוק את כל המזוזות בדירתם שתהיינה כולן כשרות,
ושתתן בכל יום שני וחמישי בבוקר --מהכסף שמקבלת להוצאות ״ סנט
או שניים לצדקה ,וכך יעשה גם בעלה שי׳ .ולא חשוב כאן הסכום אלא
העיקר שזה יהי׳ בקביעות .ברור מאליו שזה צריך להיות בלי נדר.
הנני חוזר שוב על הנקודה הנ״ל ,שחייבים להיות תקיפים בהחלטה
לנהל בית יהודי חסידי ,ולהיות חזקים בבטחון בהשם יתברך שהוא יתן
ילדים בריאים וחיים ,וכל מה שנצרך בגשמיות וברוחניות.
