Greetings and blessings,
I reply to your letter of 21 Adar Rishon. I hasten to do so, going beyond the waiting list, because it is a matter of preventing confusion.
You cite the end of the Piskei Dinim*[1], page 69b, and you find a change there. In earlier editions, the wording was different. In the new one, the words 'this is not an answer' have been added.
You surely know — and even more, you have been able to observe — what the relationship of chassidim to their Rebbe is. This rules out the possibility of a fundamental change of this kind. In fact, it was already written in the first version: 'This is not an answer.' I possess that book, and it is that first version that was photographed by Kehos for producing the most recent edition, as the foreword states.
In practice, here is what happened. Vilna[2], at the time of the appearance of the Piskei Dinim, was a stronghold of the misnagdim*. Moreover, it was in 5644[3], that is, shortly after the histalkus* of the Rebbe Maharash* and therefore in the confusion of the transition from one nasi* to another[4]. My father-in-law the Rebbe, may his merit protect us, told me that the printers in Vilna, or the proofreader, or his superiors — I do not know exactly — took advantage of this to falsify the text. They thus replaced the words 'this is not an answer' with the formulation you cite[5].
When the first copies[6] reached Lubavitch, all necessary measures were taken and the last pages were reprinted in conformity with the text of the Tzemach Tzedek*. Of course, my father-in-law the Rebbe, may his merit protect us, had no way of destroying all the falsified copies. That is what he told me.
But these falsifiers, like most of those who act in this way, also have their weakness. First of all, their style is not that of the Tzemach Tzedek. Moreover, in the surrounding context, before and after that passage, the Tzemach Tzedek cites the rishonim* with much greater assurance, in no way comparable[7]. It is clear that such a change would have been inconceivable.
You will also see the beginning of the Piskei Dinim, pages 1 and 2, and likewise in the addenda found in the Responsa Tzemach Tzedek, Sha'ar HaHosafos*, published by Kehos from manuscripts. There the Tzemach Tzedek cites the Vilna Gaon*, and you will see the formulation he uses regarding him.

במענה על מכתבו מכ"א אד"ר (שממהר הנני לענות עליו שלא בהתור) כדי למנוע הוצאת לעז וכו'.
העיר במ"ש בפסקי דינים בסופו דף ס"ט ע"ב ורואה בזה שינוי, אשר בהוצאות הקודמות הי' כתוב באופן אחר ובהוצאה החדשה, באו התיבות - ואינה תשובה.
הנה בודאי ידוע לו ושמע עוד יותר יחס חסידים לרבם האדמו"ר שבמילא שולל זה את החשד לשינוי עיקרי בזה. והעובדא היא שגם בהוצאה הראשונה הי' כתוב ואינה תשובה ונמצא ת"י וממנו עשו פוטו, דתוצאה חדשה של קה"ת וכמ"ש בהקדמה.
ומעשה שהי' כך הי'. וכמו ששמעתי מכ"ק מו"ח אדמו"ר זצוקללה"ה נבג"מ זי"ע אשר המדפיסים בווילנא (ולא שמעתי ברור אם הבחור הזעצער והמפקחים עליו אם גם המו"ל) שכידוע היתה אז בעת ההיא דהדפסת הפסקי דינים עיר מבצר של המתנגדים, וכנראה שנתוסף לזה גם מה ששנת תרמ"ד היתה בסמיכות לאחר הסתלקות אדמו"ר מוהר"ש נ"ע ובמילא שעת חירום בין גברא לגברא, הנה השתמשו בהזדמנות זו לזייף, ובמקום ואינה תשובה הדפיסו הנוסח שמעתיק כת"ר וכשהגיעו הטופסים הראשונים לליובאוויטש, הנה אחזו בכל האמצעים הנחוצים וחזרו והדפיסו את העמודים האחרונים בהנוסח של הצ"צ, ומובן אשר לא היתה בידי לבער את כל הטופסים עם הנוסח המזוייף. עד כאן סיפור של כ"ק מו"ח אדמו"ר זצוקללה"ה נבג"מ זי"ע.
כדרכם של רוב המ[כר]יע של המזייפים הנה שוברו בצדו אשר מלבד שאינו כתוב בסגנונו של הצ"צ כלל, הנה בהמשך הדברים הן לפניו והן לאחריו כשמביא הצ"צ ראשונים כותב מיט א ברייטקייט שלא בערך ופשיטא אשר בחדא מחתא לא הי' עושה שינוי כזה, ויעויין ג"כ בפסקי דינים בתחלתו דף א' ודף ב' והמילואים לזה שנדפסו בשו"ת צ"צ שער המילואים הוצאת קה"ת שנעתק מהביכלעך שם מביא הצ"צ דברי הגר"א ויראה שם סגנונו בזה.
