Rav Sholom Yechezkel Shraga[1] shlita*,

Greetings and blessings,

I have duly received your letter of Wednesday of Parshas Bo, in which you raise the question of medications taken to dye white hair black or blond. You ask whether such a practice does not transgress the precept that "a man shall not wear a woman's garment"[2].

Time does not permit me to answer this question at length, and furthermore you yourself draw a parallel with the ingestion of a medication that has the effect of causing sterility, in the case discussed in Shabbos 110b — a practice which, according to most poskim*, constitutes a transgression of a Torah prohibition. The opinions on this matter are mentioned in Otzar HaPoskim on Even HaEzer ch.5 §70.

Furthermore, regarding sterilization, the verse says "you shall not do this," and Chazal* interpret: "this shall not be done"[3], according to the same passage of Shabbos, or in the commentary given on the expression "by you." You will consult on this matter the Emek She'eilah, end of ch.105. It is not the same for the prohibition of wearing a woman's garment, for which such an interpretation is not given and which we therefore cannot introduce on our own initiative — since in this case it does not concern the hair.

The Meiri and other commentators on that same passage of Shabbos hold that this interpretation only finds an asmachta* in the verse[4]. Nevertheless, Chazal* do indeed prohibit the ingestion of a medication that causes sterility. The same therefore applies to the matter under our discussion[5].

No objection can be raised from Nazir 59a, according to which any action that does not directly touch the hair is permitted. For this principle applies under the armpits or in the area of nakedness — which is more easily understood, since these parts of the body are not visible. You will consult Responsa Tzemach Tzedek*, Yoreh Deah section, ch.93.

Or perhaps it should be considered that the practice under our analysis[5] is entirely permitted, since the Talmud raises no prohibition on this matter — not even on the basis of a mere asmachta* in the verse. It is therefore not for us to take the initiative of introducing one.

Nevertheless, what has just been said is based on Rashi's commentary on Nazir at that same passage, according to which this practice is permitted as long as one does not touch the hair. The Rosh*, by contrast, justifies this permission by the fact that, thanks to the garments, one cannot speak of feminine practice[6]. Now, in the matter at hand, this is precisely what is involved, since one takes a medication causing sterility in order to beautify oneself. There is therefore here a transgression of the principle that "a man shall not wear a woman's garment."

Such reasoning is logical. If it is forbidden to look at oneself in a mirror, according to Yoreh Deah ch.156, how much more so should such a practice be proscribed. A few further remarks may be made:

1. Some draw a distinction depending on whether the hair is black or red, as later sages specify, cited by the Sdei Chemed, klalim ch.30 §15.

2. Is it forbidden by the Torah or by Chazal* to dye white hair black? The early Responsa Sho'el U'Meishiv vol.1 say that the prohibition is rabbinic, but most later sages disagree with him on this point. You will consult Responsa Minchas Elazar vol.4 and the books mentioned in Rav Baruch's notes on the Kitzur Shulchan Aruch ch.171.

3. The medications to which you allude are used for the purpose of making the hair more beautiful. The discussion found regarding the intention of one who adopts such a practice does not therefore apply here. The Emek She'eilah, cited above, considers this question in detail. The effect of this treatment is inevitable[7], according to the opinions cited by the Sdei Chemed at the previous reference. Hence, even if the result is not entirely certain, it is not permitted to use these medications.

I enclose a copy of a chassidic* maamar* that has just been published. It was said on the day of the hilula*[8] last year. It will surely interest you.

מאשר הנני קבלת מכתבו מד' פ' בא, בו כותב ע"ד השאלה דבר סממני רפואה אשר לוקחים אותם בכדי ששערות לבנות יתחלפו לצבע שחור או צהוב אם יש בזה משום דלא ילבש גבר שמלת אשה.

והנה אין הזמן גרמא להאריך וכבר העיר כת"ר במכתבו שזהו דין דשתיית כוס עיקרין 0שבת קי, סע"ב) אשר לדעת רוב הפוסקים אסור מה"ת (הדעות בזה הובאו באוצר הפוסקים לאהע"ז ס"ה סק"ע).

וי"ל דאדרבה, בסירוס הרי דרז"ל לא תעשו קרי בי' לא תיעשו (שבת שם. או דרשו בכם. ועיין העמק שאלה סו"ס ק"ה) משא"כ בלא ילבש דלא מצינו דרשה זו, ואין לנו לדרוש מעצמנו ולאסור אם לא נגע בשערות.

וא"כ להמאירי (שבת שם), ועוד, דס"ל דדרשא הנ"ל אסמכתא היא ובכ"ז שתיית כוס עיקרית אסור מדרבנן, גם בנדו"ד אסור מדרבנן.

ואין להקשות מהא דנזיר (נט, א) דכיון שאינו נוגע בשערות מותר לכתחילה, דשאני שער בית השחי ובית הערוה דקיל דלא מינכרא מילתא (ראה שו"ת הצ"צ חיו"ד סצ"ג).

או י"ל דגם בנדו"ד שרי לגמרי כיון דלא מצינו בש"ס דאסור דגם אסמכתא אין לנו לומר מעצמנו.

מיהו כ"ז הוא לפירש"י בנזיר שם דמותר הואיל ואין נוגע בשער, אבל לפי' הרא"ש שם דההיתר הוא משום דע"י בגדו לא הוי תיקון אשה, א"כ בנדו"ד דתיקון אשה, הרי לוקח סממני הנ"ל להתנאות, ה"ז בכלל לא ילבש.

וכיון דסברא הוא וגם כ"ש וק"ו מאסור הסתכלות במראה (יו"ד סקנ"ו) יל"פ גם לשון רש"י כן אף כי הוא דוחק קצת.

ולהעיר: א) יש מחלקים בין שערות שחורות ואדום וכמבואר באחרונים הובאו בשדי חמד כללים למ"ד סקט"ו. ב) צביעת שערות לבנות לשחור אם זהו דאורייתא או דרבנן - בשו"ת שואל ומשיב קמא חלק א, שהוא דרבנן, אבל רוב האחרונים חולקים עליו, עי' שו"ת מנחת אלעזר חלק ד' ובספרים שנזכרו בהגהות הרב ברון שי' לקצשו"ע סקע"א.

ג) כיון שסממנים הנ"ל משתמשים בהם בכוונה ליפות השערות, אין שייך בזה כל השקו"ט בדין שלא במתכוון (אריכות בזה בהעמק שאלה שם). ופסיק רישא (הדעות בשד"ח שם).

ובמילא, גם אם פעולתם אינה ודאית לגמרי אסור להשתמש בהם.
