By the grace of Hashem,* Thursday 5 Tammuz 5706, I greet you and bless you,
You posed me the following question. The Nagid UMetzaveh,* commenting on the Shacharit* prayer, says that "night is not a propitious time for the giving of Tzedakah.*" For during it the Attribute of Severity* is revealed. Multiplying one's participation in Tzedakah could therefore have softened it.
Here is my response. In fact, your question can be strengthened. How are we to interpret the qualifications found in the writings of the Ari Zal,* regarding not giving Tzedakah during the night, which I will cite further on?
To understand all of this, we will introduce a preliminary notion. One can, in fact, distinguish two dimensions of the Mitzvot* and the manner of fulfilling them:
A) There is, first of all, the situation in which the Mitzvah itself and the time of fulfilling it correspond. One can cite the following example in this regard. When one studies Torah during the night, the Holy One Blessed Be He converses with the Righteous in Gan Eden,* according to the Zohar* and the references that are mentioned in the Siddur* regarding Tikkun Chatzot.*
Likewise, it is said that "you shall not kindle fire on the day of Shabbat"* and the Zohar explains that "all severe fires are then hidden." The Sefer HaMitzvot of the Tzemach Tzedek* also comments on this verse.
B) One can also conceive that the nature of the Mitzvah is opposite to the time of its fulfillment and that it aims to transform it. One can cite the example of the Shofar* that is sounded on Rosh Hashanah.* The Zohar notes that "the Jews, on the day of judgment, sound the shofar and not the horn, for they do not wish to bind themselves to the Attribute of Severity."
If we consider the first case, regarding the subject of our discussion, it is known that the Attribute of Kindness* awakens in the morning and one must then give Tzedakah before prayer, as it is said "I will behold Your face in righteousness[1]." Conversely, it is less necessary to give at Minchah,* when the Attribute of Severity in turn awakens. Then it becomes entirely unnecessary before Arvit,* when the harshest severity is revealed.
If we adopt the second conception, one can say that at Minchah, one must soften the severity that awakens, which is essentially accomplished through Tzedakah, and one therefore gives three coins before that prayer. At Arvit, on the other hand, one does not do so, because the severity is particularly harsh and it is said that "one must not muzzle the ox that plows"[2]. That is the moment when it dominates and it is not fitting to struggle against it.
The Ramaz,* commenting on the Raya Mehemna* and cited in a chassidic discourse delivered in 5695, says: "The forces of evil were also created by Hashem and they must therefore receive the vitality that enables them to exist. In fact, they possess two sources of vitality, that which Hashem granted them and that which is added to them by men committing transgressions."
In tractate Shekalim* 5:4, our Sages* say that Rabbi Chanina bar Papa* emphasized the great importance of Tzedakah. One night, he encountered the master of spirits, who said to him: "Has the master not taught us that unfair competition is forbidden?" This can be understood based on what has just been said, and there is no need to explain, as the Korban HaEida* does, that he brought an accusation against him because he had had to leave his domain.
In the Siddur of the Rav of Rashkov,* one finds an additional precision not found in that of the Maharik:* "One does not give Tzedakah at Arvit, for it is then night and severity manifests in its full harshness. One can therefore fear the grip of the forces of evil."

In general, here is how this question should be framed. Tzedakah is a Mitzvah whose fulfillment is not assigned a specific time. How then can one be exempt from it during the night?
One might explain that the writings of the Ari Zal allude to the specific Tzedakah one gives before prayer, specifying that this practice does not apply to Arvit. But this interpretation is not exact, for the reason invoked here — the connection between night and severity — applies throughout the entire duration of the night[3].
Perhaps it is possible to conceive of two ways of defining the Mitzvah of Tzedakah:
1. When one sees a poor person holding out his hand, one must put into practice the verse "do not harden your heart" and the Shulchan Aruch,* relying on the story of Nachum Ish Gam Zo,* affirms that one must give to him immediately.
2. Furthermore, a man must never miss an opportunity to give Tzedakah, even if no poor person presents himself before him, according to tractate Bava Batra* 9a, which the Shulchan Aruch adopts as Halachah.*
The writings of the Ari Zal adopt the latter definition and, according to the Sha'ar HaKollel,* the Ari Zal himself gave Tzedakah to a collector and not to a poor person. According to the first definition, on the other hand, no distinction can be made between day and night, in accordance with the verse "do not harden your heart."
Certainly, night is a time of severity and the domain of strictness must be respected. What difference then does it make whether one adopts the first or the second definition? In fact, this question does not arise and there is truly a difference. For if divine Providence causes a poor person to present himself without one having had to seek him out, this means that one must give him Tzedakah. That is entirely obvious.

Nevertheless, one can still question this by considering what the Admur HaZaken* says at the beginning of the Siddur* and in Iggeret HaKodesh* 8. He explains, in fact, that one gives Tzedakah to a poor person before prayer so that the blessing obtained during prayer also takes on a material form. Now, this is equally necessary for Arvit.
One can, however, explain that Arvit is particular since all the blessings dependent on man have already been received at Shacharit and Minchah. It is in this sense that Arvit is not an obligation. Conversely, one can also say that during Shacharit and Minchah, times of great spiritual elevation, a specific act is necessary to bring about a material manifestation, whereas Arvit is from the outset closer to the physical world and takes stock of what is accomplished during the day. This would require deeper study, but this is not the place to do so.
With my blessing of immediate Teshuvah,* immediate redemption,
The Haggadah BeChipazon* Pesach,* citing the Maasseh Tzedakah,* says that one must give a coin to Tzedakah each night, after the counting of the Omer,* in order to repair the great benevolences of the world that have been squandered.
I do not know the author of the Maasseh Tzedakah. It appears to be a Sephardic* Kabbalistic* master. If he is trustworthy and relies on the teaching of the Ari Zal, one must take into account his view, which calls for giving Tzedakah at night. Nevertheless, this can be understood based on what was explained previously. He speaks, in fact, of repairing what has been squandered[4] and not of what was decreed by Hashem.

... שאלה: בנגיד ומצוה (בתפלת שחרית) איתא, אשר "בלילה אינו זמן ראוי לצדקה" ולכאורה, אדרבה, כיון שבלילה הוא ענין הגבורות הי' ראוי להרבות בצדקה כדי להמתיקן.

תשובה : יש להוסיף עוד שאלה לשאלתו, והיא: מהו נימוק השינוים שיש בענין זה בכתהאריז"ל, בטעם מה שאין ליתן צדקה בערבית, וכמו שנעתק לקמן.

ולהבין כ"ז, יש להקדים, דהנה במצות וזמן עשייתם ישנם שני אופנים: א) מהות המצוה ומהות זמן עשייתה מתאימים זל"ז, דוגמא לדבר ת"ת בחצות לילה שאז אתי קוב"ה לאשתעשעא עם צדיקייא בג"ע (זח"א עב, א, ועוד במאמרים שהובאו בסידור בתקון חצות), לא תבערו אש ביום השבת משום דאז כל אשין דאשא קשיא אתטמרו (זח"ב רג, ב, ונתבאר בס' המצות להצ"צ מצות לא תבערו אש) ועוד. ב) מהות המצוה הפכית ממהות זמן עשייתה ובאה לתקנו, דוגמא לדבר תקיעת שופר בר"ה, וכמ"ש בזח"ג (צט, א) דישראל בעיין ביומא דדינא שופר ולא קרן בגין כו' ולאתדבקא דינא לא בעינא.

והנה בעניננו ומצד אופן הא', הרי בבוקר מתעורר החסד (פע"ח ש' התפלה פ"ב ועוד) ולכן "צריך ליתן צדקה בכל בוקר בסוד אני בצדק אחזה פניך קודם שיתפלל י"ח" (שער הכוונות תפלת שחרית ד"א) ו"בזמן המנחה הוא זמן הדינים ואינו כ"כ מוכרח" (שם תפלת המנחה סוף ד"ב) אבל "אין צורך לתת קודם תפלת ערבית כמו בשחרית יען שעתה הוא זמן דינים קשים (שם תפלת ערבית ד"א)".

ומצד אופן הב', הנה תפלת המנחה היא "בסוד הגבורה וצריך להמתיק הדינים, ועיקר המיתוק הוא ע"י הצדקה כנודע, ולכן צריך ליתן קודם תפלת מנחה ג"פ לצדקה (סי' קול יעקב, מנחה)", אבל "בערבית אין ליתן צדקה כי אז הוא שליטת דינין גמורין וכתיב לא תחסום שור בדישו, עתה הוא זמן שליטתן ואין זמן ביעורם" (שם ערבית).

ומובן זה ע"פ מ"ש הרמ"ז על הרע"מ (זח"ב מ, ב) ונתבאר בד"ה זה היום תרצ"ה וז"ל: הקליפות וסט"א גם הם נבראו וא"כ הרי בהכרח שיומשך להם איזה חיות, והענין שב' מיני חיות יש לקליפה: הא' מה שנקצב לה בגזירת עליון והב' שמוסיפים החוטאים.

- ולהעיר ממרז"ל (שקלים פ"ה ה"ד): ר"ח בר פפא הוה מפליג מצוה (צדקה) בלילה חד זמן פגע בי' רבן דרוחייא א"ל לא כן אלפן ר' לא תשיג גבול רעך. וע"פ הנ"ל מובן בפשיטות, ואין צורך לפי' קה"ע שהטענה היא מפני שיצא -

ובסי' הר"ש מרשקוב עוד הוסיף על סי' מהרי"ק כי "אין ליתן צדקה בערבית כי אז היא לילה והדינין גוברין ויש פחד מאחיזת החיצונים".

ומה שיש להקשות בכללות ענין זה הוא שהרי צדקה היא מ"ע שאין הזמן גרמא, ואיך אפ"ל שאינה בלילה.

ולכאורה אפשר הי' לתרץ דבכתהאריז"ל הנ"ל מדבר בחיוב נתינת הצדקה שלפני התפלה, וע"ז דוקא אומר שלפני תפלת ערבית אין ליתן, אבל אינו - כי הרי הטעם שמפרש, כי בלילה הוא זמן הדינין כו', טעם זה בתקפו עומד כל הלילה.

ואולי אפ"ל, דהנה שני אופנים במצות צדקה: א) הרואה עני מבקש, שעליו נאמר לא תאמץ את לבבך גו' וצריך ליתן מיד וכמ"ש בשו"ע (יו"ד ר"ס רמז) ממעשה דנחום איש גם זו, ב) לא ימנע אדם עצמו ממצות צדקה, אף שאין עני בא לבקש מלפניו (ב"ב ט, א, ונפסק בשו"ע שם) - והנה בכתהאריז"ל מדבר באופן האחרון (וראה בשעה"כ שם שהי' נותנה לגבאי צדקה, ולא לעני ) משא"כ באופן הא' אין נפ"מ בין לילה ליום, וכמש"נ לא תאמץ גו'.

ואין להקשות דסוף סוף מפני טעם דלילה זמן הדינין וכו' כנ"ל ולא תשיג גבול רעך, מאי שנא בין אופן הא' והב' - דשאני טובא, כי כיוון שמן השמים נזדמן לו עני מבקש, ולא שהוא יצא לבקשו, ה"ז הוראה שאין זה נוגע במה שנקצב להם בגזרת עליון , וק"ל.

ועדיין צ"ע ע"פ מ"ש רבנו הזקן בהקדמת הסי' ובאגה"ק ס"ח ביאור הענין דיהיב פרוטה לעני והדר מצלי שהוא כדי שתהי' ההמשכה גם בגשמיות, הרי גם בתפילת ערבית צ"ל כן. ואולי אפ"ל דשאני תפלת ערבית שכל ההמשכות התלויות בנו כבר נעשו בשחרית ומנחה וכידוע בענין ת"ע רשות, או אפ"ל דדוקא בשחרית ומנחה שאז המלכות עולה אליו צריך השתדלות מיוחדת להמשיך גם בגשמיות, משא"כ בערבית שאז מל' בבי"ע, ובפרט שבלילה הרי אז זמן שותתן טרף לביתה. ועדיין צ"ע ואכמ"ל.

בברכת לאלתר לתשובה לאלתר לגאולה

בהגדת בחפזון פסח (אות ע' ס"ג דין א') הביא מספר מעשה הצדקה שבכל לילה אחר הספירה צ"ל פרוטה לצדקה לתקן מה שפגם בעולם חסדים העליונים.

והנה איני יודע מיהו בעהמ"ח מעשה צדקה (כנראה מהמקובלים הספרדים), אבל אם בר סמכא הוא וע"פ קבלת האריז"ל, הנה לכאורה צ"ע ממ"ש שיתן צדקה בלילה , ברם ע"פ מ"ש בפנים מתורץ גם זה, כי הוא מדבר ע"ד תקון מה שפגם , וא"כ אינו נוגע במה שהוקצב בגזרת עליון.
