Greetings and blessings,

I am responding to your letter of 19 Adar, which I received with some delay. You ask me whether you may fill the mikveh* with artificial ice [2]. You know that one finds, on this subject, various opinions among the later poskim*. For the most part, they permit it. Thus you will see the Sifsei Kohen* on the Shulchan Aruch at paragraph 31, the Tiferes Yisrael*, the Divrei Malkiel*, the Achiezer*, vol. 3, the Poras Yosef, the Le'umas Yad David, Rav M. M. Epstein and the Darkei Teshuvah at paragraph 147.

Nevertheless, it is difficult for me to fix the halachah in this direction, especially since this concerns a mikveh, for which one strives to be in agreement with the greatest possible number of opinions expressed. You also specify that the Sephardic Rav has prohibited this practice. If you permit it, you will therefore arouse astonishment.

For the moment, the other mikveh of your city is surely functioning. It must therefore be repaired to the extent possible and continue to be used. In the meantime, Hashem will have mercy, the rain will fall from heaven and fertilize the earth.

On the occasion of the yom tov of Pesach which is approaching, for us and for all Yisrael, for the good, I would like to wish you, as well as all the members of your family, to celebrate it in a kosher and freilichen* manner, with true cheirus*.

I enclose for you what I wrote to someone on this subject [3]. A letter addressed to all follows [4].

I wonder whether something is not lacking in your mikveh. Perhaps that is why it is not raining. It would be good to verify once again everything that constitutes it.

במענה על מכתבו מי"ט אדר - שנתקבל באיחור זמן מעט - מ"ש בענין המקוה אם להכשירה בקרח מלאכותי. הנה ידוע ששקו"ט בזה באחרונים ורבו המכשירים (ש"ך לשו"ע סעיף ל"א, תפארת ישראל, דברי מלכיאל, אחי עזר ח"ג, פורת יוסף. לעומת יד דוד, הרמ"מ עפשטיין, דרכי תשובה ס"ק קמ"ז) אבל בכ"ז קשה עלי לתקוע עצמי לדבר הלכה ובפרט בענין מקוה שמשתדלים לצאת ידי כו"כ דיעות, ונוסף בשאלתו שהרב הספרדי אמר בפשיטות שזהו אסור, וא"כ יעורר תמי' אם יכשיר, וכיון שבטח עדיין קיימת המקוה האחרת במחנם הנה יש לתקנה עד כמה שאפשר ולהשתמש בה, ובטח ירחם השי"ת וירד הגשם מן השמים והרווה את הארץ.

ולקראת חג הפסח הבא עלינו ועל כל ישראל לטובה הנני בזה לאחל לכת"ר ולכל ב"ב שיחיו שיחוגו אותו בכשרות ובשמחה מתוך חירות אמיתי, ומצו"פ מ"ש לאחד בזה, ובא במכ' כללי.

עלה ברעיוני שאולי עדיין חסר מה בהמקוה שלהם, וזה מעכב הגשמים. וכדאי לבדוק כל עניני' עוה"פ.
