By the grace of Hashem,* Tuesday, 12 Elul* 5705,
To the great Rav,* of illustrious lineage, chassid* who fears Hashem,* Rav Y. Leiner*[1],
I greet you and bless you.
In reply to your letter, I will address first your essential question, which is the following:
A) The Admour Hazaken* writes in his Siddur:* "After the reading of Hallel,* on Rosh Chodesh,* one recites here the Song of the Day, the Psalm Barechi Nafshi,* and the orphan's Kaddish.* Four people are called up for the reading of the Torah.* One recites Kaddish* following the Torah* reading, then Ashrei* and Uva Letzion.* The Sefer Torah* is placed in the holy ark and the prayer leader recites the half Kaddish.* On Rosh Chodesh,* one removes the Tefillin* before this Kaddish.*"
Now, one may raise a question about this, for the Peri Etz Chaim,* at the gate of Rosh Chodesh,* beginning of chapter 3, reports: "The Rav would never remove his Tefillin* before the final Kaddish,* which is recited after the Sefer Torah* has been placed in the holy ark, before the Musaf* prayer. Only after this would he remove his Tefillin* and recite the Musaf* prayer. This is what is stated in the Shulchan Aruch* of the Ari Zal.*"
And one cannot consider that this practice was specific to the Ari Zal* and does not concern anyone else, for the Mishnat Chassidim* writes: "One removes the Tefillin* after the Kaddish* following Uva Letzion.*" The same statement is found in the Siddur* of the Rav of Rashkov.* However, I have not seen it in the Nagid Umetzaveh,* which you cite as a reference.
This question may be further strengthened, for several other sources likewise state that one removes the Tefillin* only after the Kaddish.* I refer in particular to the Shaar Hakavanot,* which says in the chapter on Rosh Chodesh:* "It is customary to remove the Tefillin* before the Musaf* prayer, at the conclusion of the Kaddish* recited after placing the Sefer Torah* in the holy ark"; to the Siddur Kol Yaakov,* which says: "After the Kaddish* and before Musaf,* one must remove the Tefillin"*; and to other texts as well.
The Meassef Lechol Hamachanot,* Orach Chaim* 25, 131, refers to the responsa of the Radbaz,* those of the Dvar Shmuel,* the Machzik Beracha,* Kesher Gadol,* Shalmei Tzibbur,* Zecher LeAvraham,* Siddur Beit Oved,* Chesed LeAlafim,* Ben Ish Chai,* and Kaf Hachaim.* All these authorities say that one removes the Tefillin* before Musaf.* But one must verify whether they say before or after the Kaddish,* which I cannot do, not having their books.
To explain the position of the Admour Hazaken,* which corresponds to the practice adopted in all Chabad* synagogues, one may first clarify the four moments for removing the Tefillin* as defined by the Shulchan Aruch.* Here are two of them: after the prayer Aleinu* or after the Kaddish* that follows it. This does not apply to Rosh Chodesh,* since one removes the Tefillin* before Musaf.*
We must therefore consider the other two, which are: the common custom of removing the Tefillin* after Uva Letzion,* and the custom based on Kabbalah* of waiting until the end of the Kaddish* following Uva Letzion.* This is the view of the Admour Hazaken* in his Shulchan Aruch,* and it is the one we adopt. Indeed, according to this view, three Kaddishim* must be recited before removing the Tefillin,* which in this case are: the one following Uva Letzion,* the one following the Amidah,* and the one preceding Barechu.*
Moreover, no distinction should be made between days when the Torah* is read and those when it is not. When it is read, there is also a Kaddish* after this reading, which thus constitutes the third, rendering unnecessary the one following Uva Letzion.* One therefore never counts that Kaddish* which, moreover, is not connected to the prayer but rather to the Torah* reading.
All this applies during the week. But on Rosh Chodesh,* the Admour Hazaken* requires, after Hallel,* the recitation of the Song of the Day, which is followed by a Kaddish.* Thus the count of three Kaddishim* is reached before Uva Letzion* has been recited. And, if it is not necessary to wear the Tefillin* during the Kaddish* preceding Musaf,* it is therefore preferable to remove them, for this Kaddish* introduces the Musaf* prayer, since one never begins an Amidah* without having first recited a Kaddish.* It is therefore preferable that there be the greatest possible proximity between the Kaddish* and the Amidah* that follows it. This is why, according to the Admour Hazaken,* one removes the Tefillin* before this Kaddish.*
Nevertheless, all this is valid only according to the view of the Admour Hazaken,* who requires the Song of the Day to be recited, followed by the orphan's Kaddish,* before Uva Letzion.* The Siddur Kol Yaakov,* by contrast, says: "After Hallel,* a Sefer Torah* is taken from the holy ark. After the Kaddish* following the reading, one recites Ashrei,* Uva Letzion,* and Kaddish.*" The same holds for all the other sources previously cited, which do not speak of the Song of the Day being read before Uva Letzion.*
One may, moreover, ask whether in those times it was not said at all, or was read after Musaf* or even after the prayer. The Sefardic* custom is to recite Barechi Nafshi* after Musaf.* According to the Sheerit Knesset Hagedolah,* it replaced the Song of the Day on Rosh Chodesh,* but this view is disputed. In any case, according to these customs, one removes the Tefillin* after the Kaddish* following Uva Letzion,* that is, in order to have the count of three Kaddishim.*
What has just been said permits us to justify the following formulation of the Admour Hazaken* in his Siddur:* "One recites here the Song of the Day." What does the word "here" mean? In fact, its purpose is to set aside other customs and to underscore the particularity of this one, upon which depends the moment of removing the Tefillin,* whether before or after the Kaddish.*
B) One might, however, consider that this explanation has not advanced us at all. We wished to show that the Admour Hazaken* is in agreement with the writings of the Ari Zal* regarding the moment of removing the Tefillin* on Rosh Chodesh.* But it is surprising to note that, according to this explanation, the Admour Hazaken* requires the Song of the Day to be inserted at a different moment than that indicated by the Ari Zal.*
The explanation is as follows. There are three views on the Song of the Day:
1. According to the first, it does not belong to the order of prayer. One may therefore not recite it at all. Indeed, it does not appear in the Siddur* of Rabbi Saadya Gaon,* is not mentioned in the customs of the Rav of Tirna.* And the Rambam* says: "Some people have the custom of reading the Song of the Day daily." One may also recite it after the prayer, according to the custom of the Ashkenazim,* since it is merely a commemoration[2].
2. One may also say that, insofar as it is recited, this Song of the Day must be said in its place, that is, as it was read in the Beit Hamikdash,* at the same time as the perpetual morning sacrifice. In this case, it must therefore be recited as close as possible to the Amidah.*
3. According to Kabbalah,* it must be inserted between Uva Letzion* and Ein Kelokeinu,* according to the order in which celestial influence is revealed, as defined by the writings of the Ari Zal* in the references previously cited. One should also consult the Siddur Tefillah LeMoshe* of Rabbi Moshe Cordovero.*
But all this is valid only during the week. On Rosh Chodesh,* by contrast, celestial influence is granted in a different manner.
According to the Mikdash Melech,* this influence on Rosh Chodesh* takes the form of a reflection of the spiritual world of Beriah.* By contrast, according to several chassidic* discourses, it emanates from Yetzirah.* The Tzemach Tzedek,* in his Or HaTorah,* explains these different views at length.
Perhaps, according to the third view, it is unnecessary to recite the Song of the Day on Rosh Chodesh.* It would then be a mere commemoration, according to the first view. Its place would therefore be after the prayer, as the Magen Avraham* says in particular.
But the Admour Hazaken* adopts the second view and therefore requires the Song of the Day to be recited near the morning Amidah,* including on Rosh Chodesh.* The controversy between the first and second views belongs entirely to the revealed part of the Torah.* It is therefore not surprising that the Admour Hazaken* adopted the second, which does not conform to the practice in force in the place where the Ari Zal* lived. He therefore considers that one must remove the Tefillin* before the Kaddish.*
Conversely, the discussion concerning whether the Tefillin* must be removed before or after the Kaddish,* if extracted from all other context, belongs to Kabbalah,* as the Shulchan Aruch* establishes. In this matter, who could presume to challenge the view of the Ari Zal?*
You should also consult the Magen Avraham,* whose formulation makes clear that the view requiring removal of the Tefillin* after the Kaddish* does indeed take into account the count of these Kaddishim.*
You cite the Siddur* of the Yaabetz* according to which one removes the Tefillin* after the Kaddish,* and the view of Rabbi Menachem Azariah,* according to which the Song of the Day must appear in the Shacharit* prayer. But you can see, in light of what has just been said, that you are combining two divergent opinions.
The words of Rabbi Menachem Azariah* do not, in fact, contradict the Admour Hazaken.* If one reads the Yaabetz* hastily, one may indeed think that Rabbi Menachem Azariah* requires the Song of the Day but not Barechi Nafshi,* and that it be recited at Shacharit.* But in this regard, one must consult his responsa[3], which I do not have.
Rabbi Menachem Azariah* lived in the era of the Ari Zal.* Why, according to him, were the Tefillin* to be removed after the Kaddish?* In fact, this question does not even arise. For, according to Rabbi Menachem Azariah,* one removes the Tefillin* before the Torah* reading, as he states in his responsa.
One must determine what the custom of the Sefardim* was in the time of the Ari Zal.* How did they recite the Song of the Day on Rosh Chodesh?* I do not have the Sheerit Knesset Hagedolah* and I cannot therefore consult it. And the current custom of the Sefardim* proves nothing, for changes may have occurred since then.
C) Remarks: Based on what has been said, and in accordance with our custom, according to which the Song of the Day is recited during the week before Ein Kelokeinu* and Aleinu,* one must, according to all views, remove the Tefillin* before the orphan's Kaddish* that follows Aleinu.* And the Ramah* requires removing them after this, for he holds that the recitation of four Kaddishim* is necessary before doing so, since, according to his custom, the Song of the Day is recited after the prayer.
This is therefore not our practice, and I have seen a reference indicating that this point was discussed in the Artzot Hachaim.* The latter draws proof from the fact that it is written that the Ari Zal* removed them after Aleinu,* but not after the Kaddish.* And the Ot Chaim* is astonished by this claim, since, according to the custom of the Ari Zal,* there is no Kaddish* after Aleinu.* But I do not have the Artzot Chaim* and I cannot consult it.
Moreover, one may ask why the Kaddish* preceding Hodu* or Baruch Sheamar* is not counted among the three Kaddishim.* The Ot Chaim* explains this by noting that one may sometimes arrive late to the synagogue. This answer is difficult to accept.

You ask[4] why the modifications introduced relative to the verses of the Written Law[5] are indicated in the Siddur,* in particular those concerning the Name of Hashem.* This is because concentration during prayer is particularly important, especially when one pronounces the Name of Hashem.* You should consult in this regard the introduction of Rabbi Yehudah Leib of Yanovitch,* brother of the Admour Hazaken,* to the Siddur* of the Admour Hazaken,* in which he underscores its great precision.
You ask me in your letter about the obligation to honor one's grandparents or even more distant ancestors. I indicated to you in my previous reply the references of the commentators on Shulchan Aruch* Yoreh Deah,* chapter 240, discussing this point. I do not have the Birkei Yosef* and the Shvut Yaakov[6].

במענה על מכ', הנני מתחיל מן שאלתו העיקרית. והיא:
א) כתב רבינו הזקן בסידורו - אחר הלל: בר"ח... אומרים כאן שיר של יום... ברכי נפשי... קדיש יתום... קוראין ד' גברי קדיש על ס"ת ואח"כ אומרים אשרי ובל"ג ומכניסין ס"ת להיכל ואח"כ אומר הש"ץ ח"ק... ומסירין התפלין בר"ח קודם הקדיש. - וצע"ג שהרי כתב בפע"ח שער ר"ח רפ"ג: והרב ז"ל לא הי' מסיר התפלין עד שגמרו כל הקדיש שלאחר חזרת ס"ת בהיכל קודם מוסף ואח"כ חולץ תפלין והתפלל מוסף, וכ"ה בש"ע לאריז"ל - ואין לומר שזהו רק הנהגת האריז"ל אבל לא הלכה לרבים, שהרי כתב במ"ח (מסכת ר"ח פ"ג מ"ב) ואחר הקדיש של ובא לציון יסיר התפלין, וכ"כ בסידור הר"ש מראשקוב (בס' נגיד ומצוה שציין כת"ר לא מצאתי זה).
ולכאורה תוגדל הקושיא ביותר, כי מלבד הנ"ל הנה עוד בכמה מקומות מפורש הדבר שמסירין התפלין אחר הקדיש ולא לפניו, והיינו: בש' הכוונות (ענין ר"ח) "שנהגו להסיר התפלין קודם תפלת מוסף אחר קדיש שאומרים אחר חזרת ס"ת להיכל". בסי' קול יעקב לרי"ק "אחר קדיש קודם מוסף צריך לחלוץ התפלין". ועוד.
- בס' מאסף לכל המחנות או"ח סי' כה ס"ק קל"א ציין לשו"ת הרדב"ז ח"ד ס"פ, שו"ת דבר שמואל סי' קיב, מחזיק ברכה אות טו, קשר גודל סי' ג' אות ל', שלמי צבור דף מ"א ע"ג, זכור לאברהם ח"ג אות ת', סידור בית עובד אות א' אחר סדר הלל, חסד לאלפים אות יג, בן איש חי ויקרא אות יז, כף החיים אות צ"ד - שכל אלו כתבו שמסירין התפלין קודם מוסף. וצל"ע שם אם מפורש בדבריהם: קודם או לאחר קדיש, ואין ספרים אלו תח"י.
ולברר דעת רבינו הגדול - שכן נוהגין בכל ביהכ"נ חב"ד, י"ל, בהקדם מנהג זמן חליצת תפלין, עפמ"ש בשו"ע או"ח סכ"ה, שיש בזה ד' מנהגים. שנים מהם: אחר עלינו או אחר ק"י שאחר עלינו. ואין זה שייך בר"ח שחולצין התפלין קודם מוסף. ואין לנו לדון אלא ע"ד שנים הנשארים, והם: מנהג העולם לחלוץ תפלין אחר קדושת ובא לציון, ומנהג ע"ד הקבלה לחלוץ אחר שאמר בהם ג' קדישים - (בגירסא זו החזיק רבינו הגדול - בש"ע שלו סי' כה סל"ז - ואליבי' אנו דנין) - ולכן אין לחולצם עד לאחר קדיש שלאחר ובא לציון, שאז, ביחד עם הקדיש שלאחר שמ"ע ושקודם ברכו, ה"ז ג' קדישין, וע' לקמן בזה.
- ומדאין מחלקין בין אם הוא יום הקריאה, שאז יש גם הח"ק שאחר קרה"ת ונשלם מספר הקדישים מלבד הקדיש שלאחר ובא לציון גואל, עכצ"ל שאין קדיש זה במנין, כי אינו שייך להתפלה כ"א לקריאת התורה -
והנה כ"ז הוא בימות החול. אבל בר"ח, שכתב רבינו שאחר הלל יאמר שיר של יום וקדיש אחריו, הרי נשלם מספר ג' הקדישין מלבד הקדיש שלאחר ובל"ג, וא"כ תיכף אחר קדושה דובא לציון כבר יש בידו ג' קדישין וד' קדושות. וכיון שאין הכרח שיהיו תפליו עליו בשעת אמירת הקדיש שקודם מוסף, הרי, אדרבה, הכרח הוא שיחלוץ אותם קודם הקדיש, כי קדיש זה שייך לתפלת מוסף (שלעולם אין מתחילין תפלה בלי קדיש לפני'), ולכן צריך לסומכם בכל מה דאפשר, וכמו דמוכח בנ"כ השו"ע או"ח סי' רצ"ב.
וראה שו"ע רבינו שם. ולכן כותב רבינו שחולצין התפילין קודם הקדיש דוקא,
אבל כ"ז הוא לפי סדר רבינו שאומרים שש"י וק"י קודם ובל"ג, אבל לפי הסדר בסי' קול יעקב, שכתב: ואברהם זקן כו' ומוציאין ס"ת כו' קדיש אחר הקריאה כו' אשרי ובל"ג קדיש, - ועד"ז הוא בכל מקומות הנ"ל - שלא הזכירו אמירת שש"י קודם ובל"ג
- (וצריך בירור אם לא היו אומרים אותו כלל או שאמרוהו אחר מוסף או אחר התפלה. ובסי' תכ"ג איתא דמנהג ספרד לומר ברכי נפשי אחר מוסף, ועיין מ"ש בשם שכנה"ג שברכי נפשי נהגו לאומרו בר"ח במקום שש"י, אלא שהוא ערער ע"ז, ועיין לקמן בזה) - ולכן היו חולצין התפלין דוקא אחר קדיש דובא לציון, כדי שיהי' ג' קדישין.
וע"פ כהנ"ל יומתק ג"כ לשון רבינו בסידורו שם: אומרים כאן שיר של יום, דלכאורה תיבת "כאן" מיותרת, וע"פ הנ"ל מובן כי בא להוציא ממנהגים אחרים הנ"ל, ומדגיש זה ביחוד, כי בזה תלוי ג"כ זמן חליצת התפילין: לפני הקדיש או לאחריו.
ב) ואין להקשות דא"כ נפלנו מן הפח אל הפחת, דרצינו לתרץ שיסכימו דברי רבינו הזקן למ"ש בכתהאריז"ל בענין חליצת התפלין בר"ח, וע"פ התירוץ הנה יחלוק עליו רבינו בענין אמירת שיר של יום, אתמהה.
וי"ל דהנה שיר של יום ג' דעות באמירתו: א) אינו בסדר התפלה כלל, ולכן או שאין אומרים אותו כלל (בסידור רס"ג אינו, וכן לא הוזכר בס' המנהגים למהר"י טירנא.
ובנוסח התפלה להרמב"ם " שמקצת העם נהגו לקרוא בכ"י שש"י) או שאומרים אותו אחר התפלה (מנהג האשכנזים), כיון דרק לזכר בעלמא עביד (ראה מג"א סו"ס קל"ב ובנ"כ שם). ב) י"א: לאחר שנהגו לאומרו יש לאומרו במקומו; היינו כמו שאמרוהו בביהמ"ק בתמיד ש"ש, כמו כן גם עתה יאמרוהו סמוך לש"ע של שחרית. ג) ע"פ קבלה: מקומו אחרי ובל"ג וקודם אין כאלקינו, ע"פ סדר ירידת השפע, וכמשנ"ת בכתהאריז"ל (במקומות הנ"ל. ועייג"כ בסי' תפלה למשה להרמ"ק).
וכ"ז הוא בימות החול, אבל בר"ח, אשר אז שונה הוא סדר ירידת השפע,
- (ראה במק"מ זח"א עה, ב דבר"ח ההארה מבריאה, ובכמה מדרושי דא"ח כ' שהוא מיצירה, ובאור התורה להצ"צ בביאור הדרוש מחר חדש דף כב, ע"ב נתבארו דעות אלו בארוכה) -
אולי אפ"ל שמצד טעם הג ' אין צריך לאומרו כלל, ואומרים אותו רק לזכר בעלמא וכטעם הא' - (ויעויין במ"ש בשכנה"ג הובא בבאה"ט סו"ס קלב מנהג כל המקומות בזה) - וא"כ מקומו הוא לאחר התפלה וכנ"ל במג"א. אבל רבינו ס"ל כטעם השני, שלכן פוסק דשש"י אומרים אותו סמוך לתפלת שחרית גם בר"ח כנ"ל, וכיון שהפלוגתא בין טעם הא' והב' היא פלוגתא בנגלה אין חידוש בזה אם פסק אדה"ז כדיעה השני', ודלא כאותו המנהג שנהגו במקום האריז"ל, ובמילא בא הפס"ד שחולצין קודם הקדיש.
משא"כ חליצת התפלין לפני או לאחר הקדיש - את"ל שהיא מחלוקת בפ " ע שזהו ענין בקבלה, וכמ"ש בשו"ע או"ח סי' כה סי"ג, ומי יבוא אחרי האריז"ל לחלוק עליו בזה,
ויעויין ג"כ במג"א סו"ס תכ"ג דמוכח מלשונו דהא די"א דחולצין אחר קדיש הוא מפני מספר הקדישין.
וע"פ כהנ"ל הנה מה שהביא בסי' יעב"ץ דחולצין התפלין אחר קדיש ואשר, ע"פ הרמ"ע, יש לאמר שש"י בשחרית - ארכבי אתרי רכשי כי הפסקים סותרים זא"ז.
ואין להקשות אמה שפסק רבינו הגדול מהרמ"ע שהנהיג לומר שש"י
בשחרית - ( משטחיות ל' היעב"ץ משמע דהרמ"ע הנהיג שתים: לומר שש"י ולא ברכי נפשי ובשחרית. ויש לברר בשו"ת הרמ"ע, ואינם תח"י) - והוא הי' בזמן האריז"ל, וא"כ למה חולצין אחר קדיש
- וקושיא מעיקרא ליתא דהרמ"ע ס"ל דחולצין התפלין קודם קרה"ת, כמ"ש בשו"ת שלו הובא באחרונים.
- ויש לברר מנהג הספרדים בזמן האריז"ל באמירת שש"י בר"ח, ושכנה"ג אין אצלי לעיין בו, וממנהגי הספרדים עתה אין להביא ראי', כי כמה מנהגים נשתנו מאז ועד עתה -
ג) הערות. ע"פ כהנ"ל ולמנהגנו שאומרים שש"י, בחול, קודם אכ"א ועלינו, לכאורה, לכל הדיעות, יש לחלוץ התפלין קודם הק"י שלאחר עלינו, דמ"ש הרמ"א (סי' כ"ה סי"ג) שיחלוצו אחריו הוא לגירסתו דבעי ד' קדישים בתפלין, ולמנהגו שאמרו שש"י אחר התפלה, משא"כ לדידן, - וראיתי מציינים שבס' ארצות החיים שקו"ט בזה ומביא ראי' מזה שכ' שהאריז"ל הי' חולצן אחר עלינו ולא כתבו אחר ק"י, ובס' אות חיים סי' כה סקי"ז תמה שאשתמיטתי' שע"פ מנהג האריז"ל אין ק"י אחר עלינו, ואין הס' ארצה"ח אצלי לעיין בו.
צ"ע למה אין מונין במספר ג' הקדישים גם הקדיש שקודם הודו (או ב"ש). ובס' אות חיים כ' הטעם, כיון דלפעמים מאחרים לבוא לביהכ"נ. והוא דוחק.

מה שהעיר: למה ציינו בסידור שינוי המסורה אם הוא שם אד' וכה"ג. י"ל דשאני תפלה שהכונה נוגעת ביותר (ובפרט בשמות). ויעויין בהקדמת מהרי"ל

א) מקיף - אין הפירוש סובב ומקיף למעלה בבחי' מקום ח"ו כי לא שייך כלל בחי' מקום ברוחניות אלא ר"ל סובב ומקיף מלמעלה לענין בחי' גילוי השפעה.. ההשפעה שאינה בבחי' גילוי אלא בהסתר והעלם ואין העולמות משיגים אותה אינה נקראת מתלבשת אלא מקפת וסובבת (תניא פמ,ח. וראה תו"א ד"ה ת"ר מצות נ"ח ס"ו).
