To the great Rav, Hashem-fearing chassid,* learned and of many accomplishments, Rav E. E. HaCohen,[1]
I greet you and bless you,
Following my letter of 8 Tevet[2] which you have surely received in its time, I will recall the commentary of the Midrash Mechilta* on the verse "whoever transgresses it shall die." For I have always wondered about the lengthy development it gives here — "when non-Jews surround the Holy Land..." What difference, in such a case, does the form taken by the Shabbat* transgression make?
And it is difficult to say that such transgression is permitted in that case, as I suggested in my previous letter, since the situation ordinarily envisaged by the Sages in such a case involves danger or illness.
Then, in recent days, in the course of another investigation, I found the commentary given to this passage of the Midrash Mechilta* by the responsa Torat Chesed,* by Rabbi Shlomo Zalman of Lublin: "Why does the Mechilta* cite the case of non-Jews surrounding the Holy Land? To indicate that in such a situation, when all Jews may transgress Shabbat* by performing all necessary labor, the sacred day disappears entirely for all of Israel — which is not the case for an individual who was permitted to transgress Shabbat* due to danger.[3]"
This explanation answers the question and shows the difference between the case of the Nazir,* the mortification of Yom Kippur,* and the observance of Shabbat,* as I noted in my previous letter. Indeed, the Nazir* and one who fasts on Yom Kippur* are physically affected by this situation, whereas this is not the case for the observance of Shabbat.*[4] Everything is clarified by what has just been said.

בפי' המכילתא פ' כי תשא עה"פ מחללי' - הנה כל זמן זה הי' מוקשה בעיני אריכות הל' שהקיפו עכו"ם את א"י כו' - דלמאי נפ"מ אופן החילול, ואף את"ל שר"ל שחיללו את השבת דוקא בהיתר (וכמ"ש במכ' הקודם) הרי דוגמא הרגילה בזה בדרז"ל הוא פקו"נ וחולה.
עד שימים אלו ראיתי בשו"ת תורת חסד (להרש"ז מלובלין) חאה"ע ס"ו ס"ב שכ' בפי' מכילתא זו - ביחס לענין אחר - "מדנקט במכילתא בכה"ג שהקיפו עכו"ם את א"י כו' מבואר מזה דלההוא נמי היינו רק בכה"ג, שאז הותר לכל ישראל לחלל שבת בכל המלאכות שיצטרכו כו' ונתחללה השבת לגמרי לכל ישראל אבל ביחיד שהתירו לו לחלל שבת בשביל פ"נ בדבר פרטי כו'" עכ"ל. - ומבואר מהנ"ל בפשיטות, וכן מתורץ - מה שיש לחלק בין נזיר ועינוי דיוהכ"פ לשבת (מ"ש במכ' הקודם), דשם הוא ענין שבגופו משא"כ שבת, ועפהנ"ל מובן.
