To the great Rav, distinguished chassid* who fears Hashem,

HaRav Yaakov Yisrael[1],

I greet and bless you,

I respond to your letter of erev Shabbos Terumah. You ask me, indeed, to do so as quickly as possible. You describe the situation of shechitah* in the city where you previously were, Stockholm, in Sweden. The authorities permit it only insofar as the animal receives an electric shock before being slaughtered. You forbade such a practice[2], but afterward you were informed that rabbanim in Eretz HaKodesh* permit it.

You were also written that the inner organs of animals slaughtered after receiving an electric shock were inspected, and it could be observed that they had sustained no damage. It is also said that if shechitah is not performed after the shock, the animal regains consciousness after some time and may even begin to eat.

A) I respond to all of this. You tell me that a veterinary professor examined an animal that had received an electric shock and was then slaughtered, without observing any notable lesion of the inner organs. I am particularly surprised by such a statement. Those who begin such studies already know that an electric shock capable of killing is not necessarily visible upon the inner organs. It is, in fact, the nervous concussion that causes death.

Even if the inner organs are indeed altered, two situations can be encountered. These alterations may have existed before the shock, but then have been unknown. Or these organs may have had a weakness independently of the shock. Incidentally, the shock may then aggravate the weakness and cause the alterations. In any event, these manifestations are not the direct consequence of the electric shock.

The very definition of an electric shock allows one to establish this, since it causes a nervous concussion that renders insensible. If one increases its intensity — in other words, if the discharge is greater — the animal is not only rendered insensible but also deprived of the ability to move. It is then dead. And it is, of course, impossible to verify the intensity of the discharge after death.

B) Even if the shock is obtained by a very weak electric discharge, it is, generally speaking, the role of a non-Jew to cause this discharge. Moreover, even if it were a Jew, he could not determine its intensity with precision.

Indeed, doctors know that not all human beings react in the same way to electric shocks. Moreover, this reaction can vary, in the same person, from one period to another. This depends upon his nervous state, but also upon the clothing he wears, the place where he finds himself.

Nevertheless, where humans are concerned, all precautions are taken, and instruments are used capable of measuring precisely the intensity of the discharge. It is, of course, impossible to do the same in a slaughterhouse. And it is clear that this intensity will not be modified depending on whether one deals with large or small animals, behemah gasah or behemah dakah*, an animal whose hide is wet or dry. Yet all these affect the power of the discharge.

C) I have seen the letter of permission of the great Rav and scholar, Rav Shlomo Dovid Kahana, and I do not know whether the electric shock as it actually takes place was described to him. In any event, I am surprised and astonished that no mention is made of the permission he gives regarding the movements that are observed in an animal after shechitah.

This subject could be developed, but that will not be done here.

Consequently, since you have already forbidden this practice, it seems to me that you should confirm your position, especially in light of what has just been said.

במענה על מכתבו מעש"ק תרומה אשר בקש לענות עליו בהקדם האפרי ובו מתאר מצב השחיטה במקומו לפנים בשטוקהולם במדינת שוועדען אשר הממשלה מתרת שם השחיטה דוקא ע"י הימום עלעקטרי לפני זה, וכת"ר אסר את זה, אבל אח"כ המציאו לו היתר מרבנים באה"ק ת"ו, כן כתבו לו שהיו מקרים שבדקו את הבהמות הנשחטים אחרי ההימום ובדקו את כל האברים הפנימים ולא מצאו שום ריעותא, וכן אומרים אשר אם אין שוחטים את הבהמה אחרי ההימום, אזי כעבור איזה זמן עומדת על רגלי' אוכלת וכו'.

ובמענה עכ"ז, הנה מ"ש שפראפעסאר ועטערינארי בדק אחר ההימום והשחיטה ולא מצא שום ריעותא ניכרת באברים הפנימים, הנה בפליאה גדולה אני על זה, כי ידוע הדבר אפילו למתחילים בלימודים אלו אשר שאק עלעקטרי הממית אינו מוכרח שתהי' ניכרת באברים הפנימים, כי המיתה נגרמת ע"י זעזוע הניערווין, וגם אם נמצא שינוי באברים הפנימים, ה"ז אחת משתים, או שהי' גם מלפני השאק אלא שלא ידעו אודותם, או שהיתה חלישות בהאבר בלא זה, וכסיבה ארעית מהשאק נתחזקה החלישות עד שהביאה להשינוים, אבל בכ"ז לא זהו ענין השאק, וראי' מוכחת לזה הוא ג"כ כללות ענין ההימום שענינו הוא ג"כ זעזוע הניערווין עד כדי נטילת ההרגש, וכשמגדלים "כמות" או במלות אחרים חוזק הזרם הרי אז ונטלים לא רק את ההרגש אלא גם את כח התנועה וכו, היינו שהבהמה מתה, ומובן שזעזוע הניערווין אי אפשר להבדק בבדיקה לאחר מיתה.

ב) מובן מעצמו שגם אם הימום הנ"ל נעשה ע"י זרם חלש ביותר הרי הנאמנות בזה בנוגע לחוזק הזרם וחלישותו נמסרת עפ"י הרוב לאינו יהודי שהוא הוא העושה ההימום.

וגם אם נמסרת ליהודי הרי גם אצלו אינו ברור הדבר, וכיודע גם לכל רופא בנ"א, שלא כל בנ"א שוים בענין פעולת זרם העלעקטרי אפילו באדם זה גופא לא כל הזמנים שוים הן מצד הניערווין שלו והן גם באופני הלבושים או מקום מעמדו וכיו"ב, אלא שבבנ"א נגשים לטפל בעלעקטרי בזהירות ונעשה זה ע"י כלים שבהם נראה וניכר חוזק הזרם וכו' ואשר כל ענינים אלו הרי אי אפשר להנהיג בהימום בבית המטבחים וכן בודאי לא ישנו חוזק הזרם מבהמה גדולה לקטנה מגסה לדקה בין אם עור לח או יבש וכו' - שכ"ז נוגע לענין פעולת הזרם.

ג) ראיתי העתק מכתב ההכשר של הרה"ג חו"ב וכו' הר"ר שלמה דוד שי' כהנא, ואיני יודע אם הציעו לפניו את ענין ההימום כמו שהוא, אבל בכל זאת נפלאתי ותמהתי ביותר על מה שאינו מזכיר ההיתר שלו בענין הפרכוס דלאחר שחיטה! ויש עוד להאריך בזה ואכ"מ.

אבל המורם מכל זה, שכיון שכבודו כבר כתב דעתו לאיסור לדעתי יחזור על דבריו בזה ובפרט ע"י כל הנכתב לעיל.
