Igrot Kodesh · Letter 1431 — Tzedakah

Volume 5 · Letter 211 · To: grand érudit

By the grace of Hashem,

23 Shevat 5712,

Brooklyn, New York,

To the great scholar, immensely renowned,

distinguished chassid* who fears Hashem,

of illustrious lineage, who multiplies

good deeds, HaRav Eliezer[1] shlita,

Av Beis Din* of Cincinnati,

I greet and bless you,

I have learned that you have just turned seventy. On the occasion of your birthday, I therefore join all those who have sent you their good wishes, and in turn I present my own.

May Hashem grant you good and pleasant days and years, which will enable you to ascend in Torah and to multiply tzedakah* and good deeds, for the benefit of all in general and of each one in particular.

With my wishes, my respects and my brachah,

N.B.: The Mishnah at the end of the fifth perek of Maseches Avos[2] defines seventy years as old age. Such is also the ruling of Shulchan Aruch Yoreh Deah at the beginning of siman 244[3]. But the Siddur of the Arizal*, in the laws of the beis hakneses* found at its beginning, states that one must rise before someone who is sixty years old. This is cited by the Birkei Yosef Yoreh Deah at the same reference. This statement is based upon Tikkunei Zohar, Tikkun 21, page 56a: "One does not speak of advanced age except from sixty years onward. Old age begins at fifty"[4].

The Shaar HaMitzvos and the Shaar HaLikkutim allow one to establish that such is indeed the reason invoked by the Arizal. The Minchas Chinuch on Mitzvah 257[5] states that the opinion of the Arizal also takes into account that of the Targum. Perhaps he did not consult the Shaar HaMitzvos and the Shaar HaLikkutim. In any event, several poskim* hold that one must adopt a stringent opinion introduced by the Zohar, even if it contradicts that expressed in the Talmud. Nothing of the sort is said, however, when there is a contradiction between the Targum and the Talmud.

In fact, one may consider that the Yerushalmi and the Bavli themselves take up the discussion between the Zohar and the Talmud. The Yerushalmi states that kares*[6] is no longer possible from the age of fifty, whereas for the Bavli it can still occur until sixty. See, regarding this, Tosafos at the beginning of Maseches Yevamos, the Mareh Panim, and the Yerushalmi at the beginning of Maseches Bikkurim.

This also enables us to understand the differences in formulation between the Bavli Moed Katan 28a, which states that advanced age begins at seventy, while this mention does not appear in the Yerushalmi Bikkurim.

As for Tikkunei Zohar, it follows the Talmud of Eretz Yisrael and therefore adopts its view.

See the references cited by the Sdei Chemed in his klalim, under the entry Zaken[7], and by the Kehillas Yaakov, by the same author as the Melo HaRoim, under the entry Seivah[8].
