Greetings and blessings,

In the name of the Rebbe shlita*[2], I confirm that he has received your sefer*, Nezer HaKodesh, a commentary on Maseches Tamid, and thanks you very much for sending it to him. You will surely also send to the library of the Rebbe shlita the other works of which you are the author. Be thanked in advance.

Enclosed is a list of notes drawn up by the Rebbe shlita on certain points raised in your sefer.

In accordance with the request of the Rebbe shlita, a Sefer HaMaamarim 5700[3] has been sent to you. Without doubt, it will interest you greatly.

On the beginning of the sefer, p. 5a: You ask the meaning of this assertion of the Mishnah*: "In three places[4]." To what end teach this enumeration?

In my humble opinion, the answer is quite evident. For this is the essential aspect of the law, and there must indeed be three watch-stations, as the verse permits one to establish. The text then states that in the second Beis HaMikdash* the watch was kept in the Beis Avtinas. Here too, this specification is self-evident, for this watch would have been valid even if it took place in three other locations, since the verse does not specifically refer to the Beis Avtinas.

Moreover, if the Mishnah said "One must place watchmen in the Beis Avtinas," as you propose, the doubt would not for that reason be lifted, because:

1. Kohanim* also kept watch in several places of the Beis HaMoked.

2. And what happens if it is not possible to place watchmen in a place mentioned by the Mishnah?

3. How did one proceed in the first and third Beis HaMikdash[5], as well as in the Mishkan*[6]?

The answer to all these questions stems from the fact that the Kohanim guarded the Beis HaMikdash in three places, and that the Mishkan is also considered to be the Beis HaMikdash.

P. 15b, regarding the imperative of teshuvah*: You ask why the Rambam* does not base himself on the verse "and you shall return" to establish that there is indeed an imperative to do teshuvah[7].

In my humble opinion, it is precisely for this reason that the Rambam took the precaution of explaining this verse in his Hilchos Teshuvah, ch. 7, sec. 5. He clarifies that it must be interpreted as an affirmation[8], an assurance given to the Yidden* that at the end of golus* they would attain teshuvah. He deduces this from the manner in which this verse is phrased — as a narrative of what will happen at the end of times.

At the end of this development, on p. 16a, you write that the Torah does not define a sentiment of the heart as a mitzvah*. This has a bearing on the mitzvah of destroying chametz* and conditions the fact that one can do so only in one's heart.

All this is surprising. Several mitzvos are in fact sentiments of the heart — that of believing in the unity of Hashem, of loving Him, of fearing Him. You will also consult the Rambam, Hilchos Korbanos*, ch. 14, sec. 12, who establishes that one may consecrate an animal[9] by thought[10], that there is no need to do so verbally before offering it.

Such is not the view of Rashi and Tosafos at the beginning of the second chapter of Maseches Me'ilah, who state: "As soon as it has been sanctified verbally." You will also consult the Sha'ar HaMelech, Terumos, ch. 4, sec. 16. This subject will not be developed here.

On the other hand, there is one question that does arise here. All the Nevi'im* commanded one to attain teshuvah. It is therefore indeed a necessary condition for the korban* of expiation to be offered on Yom Kippur. From this, why would teshuvah not be a mitzvah?

If I may permit myself to advance an explanation that I have not, for the moment, found in any sefer, I would say in my humble opinion that this imperative[11] does indeed appear in the Torah, in the verse Devarim 10:16: "You shall circumcise the foreskin of your heart, and you shall no longer stiffen your neck." There is here a command to remove the foreskin of the heart and the stiffness of the neck that already exist.

But the verse does not say whether one is in a case where the actual sin has already taken place or has not yet occurred. The two ways together are therefore included in this command.

And one can also understand why the Rambam does not speak of it in his enumeration of the mitzvos. For teshuvah has a general scope and includes the entire Torah. By virtue of this, it cannot be counted, as he himself explains in Sefer HaMitzvos, in the fourth Shoresh[12], where he also cites the imperative "You shall circumcise."

You will also consult the commentary of Rav Y. P. Perla on the Sefer HaMitzvos of Rav Saadya Gaon, parshah 42. He raises questions, based on several Talmudic passages, about the Rambam's assertion that vidui* is the essential aspect of teshuvah.

You will also see the Zohar, vol. 3, p. 122a; the first chapter of Iggeres HaTeshuvah of the Alter Rebbe, author of the Shulchan Aruch*; the Sefer HaMitzvos of the Tzemach Tzedek, on the mitzvah of vidui and teshuvah.

At the end, p. 34b: You comment on the text Le'Chai HaOlamim, "to the One Who possesses eternal life"[13].

You have not really explained the question you pose, and the analysis is therefore not very precise. It may give rise to confusion.

There are here three points:

1. The word Le'Chai may be written with one yud or with two yuds.

2. If one considers it to have only one, it may still be vocalized with a patach — Le'Chai — or with a tzeireh — Le'Chei.

3. The word HaOlamim, with a hei, may also be written Olamim, without a hei.

All this has a bearing on the manner of reading the brachos* of Baruch SheAmar, Yishtabach, Borei Nefashos, and on the piyut* HaAderes VeHaEmunah[14].

Several views may be cited on this matter:

1. The Chok Nasan, at the end of Maseches Tamid, has, it seems, adopted a unique position, holding that one says in all cases Chai HaOlamim, including in the piyut HaAderes VeHaEmunah.

2. In the Siddur of Rav Amram Gaon, Baruch SheAmar and Yishtabach are printed with a single yud, while Borei Nefashos has two. In all cases the word is vocalized with a patach.

3. In the Siddur of Rav Yaakov Emden, it is specified that one must say in Baruch SheAmar, Yishtabach, and Borei Nefashos the formula Chai HaOlamim, with a single yud and a patach. In the piyut HaAderes VeHaEmunah, one says LeChai HaOlamim, with a patach.

4. In the Siddur of the Alter Rebbe, author of the Shulchan Aruch and the Tanya, what is retained in all cases is Chei HaOlamim, with a single yud and a tzeireh. In the piyut HaAderes VeHaEmunah, by contrast, one says LeChai Olamim. The same assertion is found in the Siddur Or Chadash.

The Magen Avraham, ch. 207, gives his view only for Borei Nefashos, which he vocalizes with a tzeireh. One may wonder what his position is for Baruch SheAmar, Yishtabach, and the piyut HaAderes VeHaEmunah. The same doubt also exists regarding the position of the Vilna Gaon. One will also consult the Avudraham, the Birkei Yosef, and the Sha'arei Teshuvah on Orach Chaim, ch. 207; the Iyun Tefillah on the Siddur Otzar HaTefillos at the brachah Baruch SheAmar; the notes of the Ralats on the Mishnah at the end of Maseches Tamid, and other references.

בתחילתו (ה, א) מקשה מה מוסיף בהא דתנא בג' מקומות - במנינא למה לי'.

ולפענ"ד פשוט - מפני כי זהו עיקר הדין, שצ"ל שמירה ובג' מקומות כדילפינן מקרא. ואח"כ מוסיף שבביהמ"ק שני הי' זה בבית אבטינס כו' (ולכאורה ג"כ פשיטא, שאם העמידו שומרים בג' מקומות אחרים, ג"כ יצאו ידי שמירה, דאטו בית אבטינס כו' אמר קרא).

ועוד, אם הי' ל' המשנה: בבית אבטינס כו' צ"ל שומרים, כקושיתו, עדיין נשאר בספק: א) בכמה מקומות בבית המוקד כו' גופא היו מעמידים שומרים כהנים. ב) אם א"א להעמיד בא' ממקומות המנוים במשנה - מה דינו. ג) מהו הדין בביהמ"ק ראשון ושלישי (וכן גם במשכן). אשר כל זה נפשט ממש"כ בג' מקומות הכהנים שומרים בביהמ"ק (ואשכחן משכן דאיקרי מקדש).

טו, ב. בדין עשה דתשובה. מקשה מדוע שבק הרמב"ם "להא דאמרה תורה ושבת - לומר שהוא מצוה לשוב בתשובה".

ולפענ"ד הרמב"ם עצמו נשמר מזה בהל' תשובה (פ"ז ה"ה) ומבאר שם הכתוב, שזהו סיפור דברים והבטחה לישראל שבסוף הגלות יעשו תשובה (וי"ל דטעמו ונימוקו עמו, כי כן הוא פשט סגנון המקרא - סיפור דברים את אשר יקרא באחרית הימים).

ומש"כ בסיום הענין (טז, א) שלא אמרה תורה מצוה על מה שבלב, ונפק"מ לענין קיום תשביתו דחמץ אם מקיימים המצוה ע"י מחשבה שבלב - הוא תמוה, כי כמה מצות בדברים שבלב: ליחדו, לאהבו, ליראו וכו'. ויעויין ג"כ רמב"ם הל' מעה"ק (פי"ד הי"ב) דמוכח שהבהמה מתקדשת ע"י מחשבתו (ולא רק שעל האדם חל חיוב לקדש הבהמה בפיו ולהביאה נדבה). ודלא כרש"י ותוס' וכו' רפ"ב דמעילה שכתבו "משהוקדשה בפה".

ועייג"כ שער המלך תרומות פ"ד הט"ז, ואכ"מ.

אבל מה שיש להקשות בענין זה הוא: כיון שכל הנביאים כולן ציוו על התשובה, תנאי היא בהקרבת חטאת כו' בכפרת יוהכ"פ וכו' - איך אפשר שלא תקבע במצוה.

ולולא דמסתפינא ממה שלא מצאתי זה, לע"ע, בס' בפירוש, הנה לפענ"ד, י"ל בפשיטות אשר בא הציווי ע"ז בתורה - והוא בדברים (י, טז): ומלתם את ערלת לבבכם וערפכם לא תקשו עוד - שפירושו ציווי למול את ערלת הלב ולהסיר את קשיות העורף שישנם כבר . ולא הגדיר הכתוב אם כבר גרמו לעבירה בפועל (ענין התשובה), או לא.

ובמילא שני האופנים נכללו בציווי זה.

ומובן ג"כ מה שלא מנאו הרמב"ם במנין המצות - כי התשובה היא ציווי כולל התורה כ[ו]לה, ומצות כאלו אינם נכנסים במנין, וכמש"כ בסהמ"צ שורש ד', ומביא שם ג"כ ציווי ומלתם גו'.

ויעויין בביאור הרי"פ פערלא לסהמ"צ לרס"ג פרשה מ"ב, מה שהקשה מכמה סוגיות על דעת הרמב"ם שהווידוי עיקר בתשובה.

ולא ביאר בזה כדי הצורך, ובמילא הדברים אינם מדוייקים ונותנים מקום לטעות.

כי הנה ג' פרטים בדבר: א) לחיי - ביו"ד אחת או בשתים. ב) את"ל באחת - נקודתה בפתח או בצירה. ג) העולמים - בה"א או בלא ה"א. ונפק"מ בברכת ב"ש, ישתבח בנ"ר ופיוט האדרת והאמונה.

והנה כמה דיעות בזה: א) בחק נתן בסוף מס' תמיד כנראה השוה מדותיו - לומר בכהנ"ל חי העולמים - גם בפיוט האדרת והאמונה. ב) בסי' ר"ע גאון נדפס בב"ש וישתבח - חי בחד יו"ד, ובבנ"ר - בשני יו"דין. ובכ[ו]לם בפתח. ג) בסי' יעבץ פוסק לומר בב"ש ישתבח ובנ"ר - חה"ע בחד יו"ד ובפתח, ובפיוט האדוה"א - לחי עולמים ובפתח. ד) בסי' רבנו הזקן (בעל השו"ע והתניא) בכהנ"ל - חה"ע בחד יו"ד ובצירה. אבל בפיוט האוה"א לחי עולמים, וכ"כ בס' אור חדש.

המג"א סר"ז - לא גילה דעתו אלא לענין בנ"ר (שצ"ל בצירה) וצ"ע בסברתו בב"ש ישתבח ופיוט האוה"א. וכספק זה הוא ג"כ בדעת הגר"א. ועייג"כ אבודרהם, ברכ"י ושע"ת לאו"ח סר"ז. עיון תפלה בסי' אוצר התפלות בברכת ב"ש. הגהות ראל"צ במשניות סוף תמיד. ועוד.
